Is A Ban On Non-Competes Supported By Empirical Evidence?, Sarah Oh Lam, Thomas Lenard, Scott Wallsten
Fordham Journal of Corporate & Financial Law
The U.S. Federal Trade Commission (FTC) has proposed a rule to declare virtually all non-compete agreements unfair methods of competition under Section 5 of the FTC Act and therefore, illegal. However, the empirical literature on non-compete agreements cited by the FTC in its Notice for Proposed Rulemaking (“NPRM”) shows mixed results on earnings, job creation, firm formation, entrepreneurship, training, investment, and firm value. Evidence in other current studies also does not support an economy-wide ban. The FTC concludes that the proposed rule would yield net benefits even though by its own admission it lacks the information necessary to conduct a …

This Essay uses a series of survey studies to consider how public understandings of public and private companies map into urgent debates over the role of the corporation in American society. Does a social-media company, for example, owe it to its users to follow the free-speech principles embodied in the First Amendment? May corporate managers pursue environmental, social, and governance (“ESG”) policies that could reduce short-term or long-term profits? How should companies respond to political pushback against their approaches to free expression or ESG?

An Examination Of The Relationship Between Cheating In Online Classes And Technostress: Perceptions Of Business Faculty, Stacy Boyer-Davis, Kevin Berry, Amy Cooper

This research study investigated the relationship between technostress creators (techno-complexity, techno-insecurity, techno-invasion, techno-overload, and techno-uncertainty) and faculty perceptions of student cheating in online classes. Data were collected from faculty members of the Management and Organizational Behavior Teaching Society (MOBTS), a member of the AACSB Business Education Alliance, the American Society of Business and Behavioral Sciences (ASBBS), an interdisciplinary professional organization comprised of faculty teaching in accounting, finance, management, marketing, organizational behavior, and computer information systems, and other research panels during 2021 (N = 94). Brand activism has emerged as a prominent practice among corporations, as they publicly take a stand on contentious socio-political issues such as gender inequality, climate change, or discrimination, often through advertising. While extensive research has been conducted on the impact of brand activism as a marketing tool, examining its effects on sales, brand image, consumer attitudes, and authenticity, only a limited number of studies have studied its influence on public debate and processes of democratic legitimation. This study aims to measure how Muslim consumers have applied Islamic Consumption Theory to regularly consumed products by analyzing the variables of maslahah, final spending, and tawazun Islamic consumption theory against the demand for Fast Moving Consumer Goods (FMCG). Fourty FMCG consumers can be removed in this study and were distributed randomly. The sample was done change to collected with a purposive sampling method, which obtain the primary data in the form of the respondents' answers to the distributed questionnaires. Inspired by the author's experience as the sole Muslim woman in a company of over 100 employees, the capstone project addresses the observed lack of prioritization for minority inclusion in the workplace. The capstone project outlined aims to address this issue by developing a cultural sensitivity and inclusion workshop that surpasses superficial efforts and encourages participants to internally reflect on their daily workplace interactions. The workshop, designed with an experiential approach lasting 1.5-2 hours, seeks to foster practical knowledge and instigate changes towards a more inclusive, equitable, and diverse working environment. When wildfires swept through the island of Maui in Hawai‘i in August 2023, the communities of Olinda, Kula and especially Lahaina were devastated. Thousands of people were displaced, and nearly 100 people were lost. Just like the speed at which the fiery winds consumed these towns, accusations of emergency mismanagement and a host of misinformation spread by word of mouth and online. The primary local government authority for these communities is the County of Maui, currently led by Mayor Richard Bissen. Weakness is the new strength: How vulnerability makes leaders stronger is the result from the meta-analysis of five phenomenological studies designed to generate a theory that explains how exemplar leaders from five different fields used “soft-skills” and four domains of behavior to create mutual shared knowledge, resolve conflict and transform relationships to produce breakthrough results. The four domains of behavior are communication, collaboration, ethics, and emotional intelligence. The sample was composed of 75 exemplar leaders from five different professional fields and included an analysis of over 1,300 pages of interview transcripts as the main data source for the study. The present study examines how corporate women use self-presentation in the workplace to communicate professionalism. The study utilizes Communication Theory of Identity (CTI) to consider the self-presentation experiences of corporate women. CTI identifies four identity layers: personal, relational, enacted, and communal, which interact and influence each other as individuals attempt to define themselves. Through semi-structured, in-depth interviews with corporate women, the present study found the following results: women often receive communication regarding self-presentation standards from peers rather than formal policies, self-presentation expectations have become more casual and diverse, women still encounter challenges resulting in the need to (re)negotiate their identity, …

Artificial intelligence (AI) technology seeks to emulate humans. One aspect is AI-synthesized voices, used in voice assistants (such as Amazon Alexa, Apple Siri, and Google Assistant) to assistive technologies (such as voiceover narration in product videos). For example, there are currently more than 3.25 billion voice assistants; a number that is expected to touch about 8 billion by next year (i.e., 2023) (Statista 2022). With the extensive availability and enhanced accuracy of AI-synthesized voices, consumer research is starting to examine the impact of AI-synthesized voices on consumer information processing and decision making. Local Competition, Multimarket Contact, And Product Quality: Evidence From Internet Service Provision, Kyle Wilson

I investigate the effect of competition on quality in the internet service provision industry: I examine both local competition within markets and multimarket contact among firms across markets. This industry offers an ideal setting, as quality is both objective and measurable. I use data from speedtest.net from 2008 to 2014 to estimate a reduced-form model of the effects of local competition and multimarket contact on realized consumer download speeds. I find that increased multimarket contact leads to decreased download speeds, which is consistent with the mutual forbearance hypothesis. I also find that duopolies lead to faster download speeds than do …
