Historically, various systems and institutions across diverse civilizations have been established to meet the many needs that interweave the fabric of society. One, and perhaps the most significant of these institutions is the waqf/hubus system. Characterized by the designation of a property or revenue stream as mortmain and the investment of the usufruct for the benefit of (often predetermined) beneficiaries, this form of charitable endowment is hailed as a cornerstone of Islamic civilization. [Excerpt] From the perspective of the early twenty‑first century, we can chide the good professor for not carefully considering the consequences of what he wished for half a century ago. For it is clear that the force of this conservative movement in America was in fact “stronger than most of us [knew]” or could have imagined in 1950, or, indeed, in 1968.
