Os princípios constitucionais mais susceptíveis de ser invocados em tempos de crise (quando se presta atenção à Constituição), o da proibição do retrocesso e o da reserva do possível, precisam de ser repensados. Não atirados um contra o outro, e defendidos, ora um ora outro, ao sabor de paixões, mas compreendidos ambos como concorrendo para a defesa da Constituição em situações limite. Certamente há algo maior por detrás desses dois princípios aparentemente contraditórios.

[Excerpt] During the past two decades there have been significant changes in employment systems across industrialized countries. Converging Divergences: Worldwide Changes in Employment Systems, by Harry C. Katz and Owen Darbishire, examines changes since 1980 in employment practices in seven industrialized countries—the United States, the United Kingdom, Australia, Germany, Japan, Sweden, and Italy—with a focus on the automotive and telecommunications industries. Katz and Darbishire find that variations in employment patterns within these countries have been increasing over the past two decades. [Excerpt] Over the 85-year period from 1748/50 to 1832/34, real per capita expenditures on poor relief increased at an average rate of approximately 1 percent per year. There were also important changes in the administration of relief with respect to able-bodied laborers during the period. Policies providing relief outside of workhouses to unemployed and under-employed able-bodied laborers became widespread during the 1770s and 1780s in the grain-producing South and East of England. The so-called Speenhamland system of outdoor relief flourished until 1834, when it was abolished by the Poor Law Amendment Act. The aim of the thesis is to provide …

This article examines Charles Villers's Essay on the Spirit and Influence of Luther's Reformation (1804) in its intellectual and historical context. Exiled from France after 1792, Villers intervened in important French and German debates about the relationship of religion, history, and philosophy. The article shows how he took up a German Protestant discussion on the meaning of the Reformation that had been underway from the 1770s through the end of the century, including efforts by Kantians to seize the mantle of Protestantism for themselves. Building on recent literature, this paper discusses four ways of studying the relation between religion and nationalism. The first is to treat religion and nationalism, along with ethnicity and race, as analogous phenomena. The second is to specify ways in which religion helps explain things about nationalism - its origin, its power, or its distinctive character in particular cases. The third is to treat religion as part of nationalism, and to specify modes of interpenetration and intertwining. The fourth is to posit a distinctively religious form of nationalism.
