In popular consciousness and culture, equality is often considered to be the preeminent socialist value. Equality, on this view, sits at the heart of the socialist ideal, and those who ascribe great value to equality will, other things being equal, find themselves more predisposed towards socialism than those who do not. However, in recent years egalitarian accounts of the socialist ideal have increasingly come under criticism from defenders of an alternative, freedom-based approach to understanding the values that underpin socialist commitment. In this dissertation, I provide an account of the protections to which most captive non-human animals are morally entitled when they participate in health-related research. At least in the animal ethics literature, it is uncontroversial that the protections currently afforded to captive research animals are inadequate. This has much to do with the fact that most animals who serve as research participants are 1) sentient and, thus, have important morally considerable interests; 2) unable to provide informed consent to their research participation; and 3) seriously harmed as a result of their participation.

For Axel Honneth, not all social problems can be understood as injustices. Therefore, he introduces the additional diagnostic concept of social pathology. In his book Freedom’s Right (FR), it is defined as an accumulation of persons’ inability to adequately participate in social institutions due to misunderstanding them. In contrast, injustices consist in the denial of access to social institutions for certain groups. I develop and defend a positionalist theory of identity as a basis from which to resist identity-based violence. On this account, identities are the social positions that individuals occupy due to belief that operate upon them. This contrasts with and is intended to replace the dominant intrinsicist model, which conceives of identity as something about individuals in and of themselves. Taking gender as a focal point, I develop three overarching positionalist kinds: monogyne, polygyne, and androgyne. The second conjunct of the Republic’s account of justice—that justice is “not meddling in the work of another”—has been neglected in Plato literature. This paper argues that the conjunct does more work than merely reiterating the content of the first conjunct—that justice is “doing one’s own work.” I argue that Socrates develops the concept at work in this conjunct from its introduction with the Principle of Specialization in Book II to its final deployment in the finished conception of justice in Book IV. In Righting Health Policy, D. Robert MacDougall argues that bioethics needs but does not have adequate tools for justifying law and policy. Bioethics’ tools are mostly theories about what we owe each other. But justifying laws and policies requires more; at a minimum, it requires tools for explaining the legitimacy of actions intended to control or influence others. It consequently requires political, rather than moral, philosophy. After showing how bioethicists have consistently failed to use tools suitable for achieving their political aims, MacDougall develops an interpretation of Kant’s political philosophy. Canadian courts have struggled with delay for decades. The advent of the COVID-19 pandemic added to an already difficult situation. Courts were required to take swift action, which they did. Despite this, they have faced criticism concerning the approach taken. I will argue that this criticism is not warranted and has more to do with the perceptions of the courts’ past performance than it has to do with their response to the pandemic. Regardless, the systemic delay in Canadian courts has become an issue of ethics which overshadows any success they have had in the current pandemic.

John Rawls’ influential A Theory of Justice presents a liberal theory in which individuals gain “a sense of justice” that commits them to the success of the just society above other interests or life plans. Critics of Rawlsian liberalism such as Taylor, Sandel, MacIntyre, Walzer, and the communitarians have variously complained that his theory inadequately accounts for individual commitment to community as distinct from commitment to the whole of society. In Nietzsche scholarship, little has been done regarding Nietzsche’s reflections on penology and criminology. This dissertation aims to critically examine Friedrich Nietzsche’s thoughts on justice, punishment, and the criminal and to show that his interest in these topics runs throughout his writings. Nietzsche attacked the tradition of Western justice theory and the idea that justice consists in giving each their due. I argue that in place of this notion of justice, he puts forth a non-metaphysical, naturalistic account of justice that refuses to judge and hold man accountable. Impartiality—and the appearance of impartiality—are the foundation of judicial decision-making, judicial morality, and the public’s trust in the rule of law. Recusal, in which a jurist voluntarily removes himself or herself from participating in a case, is a process that attempts to preserve and promote the substance and the appearance of judicial impartiality. Nevertheless, the traditional common law recusal process, prevalent in many of our state court systems, manifestly subverts basic legal and ethical norms.

This dissertation is a study of the intellectual practice of the Platonic character, Socrates, with emphasis on the presentation of dialectical engagement with authority. I argue that authority, conceptually and in practice, constitutes a serious problem for Socrates. On my reading, the problems of authority are indicative of an inappropriate understanding of the soul and the ailing condition of the sociopolitical practices of Athenian culture. I suggest that Plato’s Socrates is devoted to the personal and political improvement of his fellow citizens, and society at large, through dialectical engagement which seeks to undermine authority. In this dissertation, I advance a novel eco-political theory of territory that grounds a people’s territorial rights in its right to political self-determination understood as inextricably and normatively bound up with its right to ecological integrity and duty of ecological sustainability. I develop a social ontology of the people as the holder of territorial rights based on its members’ place-based common activities that aim at their own independent governance rather than in terms of state institutions, cultural nationhood, ethnogeography, political identity, or shared conceptions of justice.
