We were warned to temper our high hopes for a bold new Obama era of human rights. After all, President Obama would have “a lot on his plate”: a serious economic crisis, high unemployment, over forty million people without health insurance, “two wars,” global volatility. But it’s very hard not to be dismayed by some of the continuities from the Bush to the Obama administration, as well as by some Janus-faced policy decisions with damning human rights implications. This Article will survey the key episodes of transitional justice in various countries since the 1970s, and then apply the lessons gleaned to the transition of Serbia during the first five years following the deposition of authoritarian ruler Slobodan Milosevic in October 200, and the subsequent establishment of democratic rule...This article will show that the empirical evidence demonstrates that the outcome of the transitional justice process a country undertakes, upon its political stability, needs to be taken into account when fashioning said process.

Rotten To The Core: Project Capture And The Failure Of Judicial Reform In Mongolia, Brent T. White

East Asia Law Review

Despite claims by international donor agencies that judicial reform efforts in Mongolia have been a great success, this Article argues that Mongolian courts continue to grossly lack integrity, transparency, and accountability-and are perceived by the Mongolian public as more corrupt today than when donor-funded judicial reform efforts began almost a decade ago. This Article further argues that the failure of judicial reform in Mongolia stems in significant part from the "capture" of donor-funded judicial reform efforts by elites within the Mongolian judicial sector. In this paper, Dr. A. Sarjoh Bah and Dr. Kwesi Aning, addresses three critical transnational challenges, referred to as the “triple threats” confronting West Africa, namely: governance, drug trafficking and small arms and light weapons. They contend that the combined effects of these threats could undermine the security and stability of the entire sub-region. Consequently the analysis focuses on policy responses by the Economic Community of West African States (ECOWAS) in confronting the triple threats and offers specific recommendations on how these responses can be enhanced. Dealing With Political Ferment In Latin America: The Populist Revival, The Emergence Of The Center, And Implications For U.S. Policy, Hal Brands Dr.

The current political dynamics in Latin America is analyzed, and their meaning for the United States is evaluated. The author argues that references to a uniform “left turn” in the region are misleading, and that Latin America is actually witnessing a dynamic competition between two very different forms of governance. Represented by leaders like Hugo Chávez, Evo Morales, and others, radical populism emphasizes the politics of grievance and a penchant for extreme solutions. Moderate, centrist governance can be found in countries like Chile, Brazil, Mexico, Colombia, and Uruguay. It stresses diplomatic pragmatism, the protection of democratic practices, and the need …

Over the past decade, the United States Institute of Peace (USIP) has trained members of police and military forces around the world to prepare them to participate in international peacekeeping operations or to contribute to post-conflict stabilization and rule of law interventions in their own or in other war-torn countries. Most of the training takes place outside the United States, from remote, rugged bases to centrally located schools and academies, from Senegal to Nepal, from Italy to the Philippines. The spotlight is, in other words, on those items that senior Army and Department of Defense leaders should consider in providing military advice and formulating military strategy. At present, the U.S. military is engaged in a changing situation in Iraq and an increasing presence in Afghanistan, as well as efforts to restore balance in force sizing and structure.

War And Hiv In Latin America, Shawn Smallman

Conflict has shaped the HIV pandemic from its inception, from the spread of HIV-1 in Central Africa, to the diffusion of HIV-2 from Portuguese Africa to the globe. At the same time, the relationship between HIV and conflict has been non-linear and poorly understood. Nancy Mock and her colleagues have been almost the only scholars to propose a model to understand this relationship. Their work suggests that several key variables (such as the time scale of the conflict, the characteristics of the parties involved, and the geographic scale of the fighting) explain wide variations in how warfare appears to have …

The Relocation Of Crime, Catherine C. De Fontenay

We add a new sector called Crime to a traditional two-sector two-input Heckscher-Ohlin model of trade between countries. Trade is found to increase crime in the resource-rich country and to reduce crime in the resource-poor country by an equal amount. The negative externality from increased crime can be strong enough to cancel out the gains from trade for the resource-rich country. The paper also explores the impact of aid, capital flows, and migration on crime rates, and how crime shapes the degree of specialization in each economy.

In late 2007, the U.S. and Mexican governments unveiled the Merida Initiative. A 3-year, $1.4 billion counternarcotics assistance program, the Merida Initiative is designed to combat the drug-fueled violence that has ravaged Mexico of late. The initiative aims to strengthen the Mexican police and military, permitting them to take the offensive in the fight against Mexico’s powerful cartels. As currently designed, however, the Merida Initiative is unlikely to have a meaningful, long-term impact in restraining the drug trade and drug-related violence. Focussing largely on security, enforcement, and interdiction issues, it pays comparatively little attention to the deeper structural problems that …

Human Trafficking And Global Policy: A Study On The Casual Factors Of Human Trafficking, Ashley Margarida

Victims of human trafficking may be exploited for prostitution, sweatshop labor, domestic work, and as child soldiers for armed conflicts. Elements of human trafficking include deception, recruitment, transportation, coercion, exploitation, and forced labor. Statistics of individuals trafficked vary according to source, but it is estimated that 700,000 to 4 million individuals become new victims of human trafficking every year. The literature on policies pertaining to human trafficking demonstrates a lack of international collaboration and inattention to the causal factors associated with human trafficking. This studied hypothesized that a positive relationship exists between a country’s view on prostitution, tolerance of male …
