Negotiating Environmental Crisis Within Forest Ecosystem Restoration Projects In Puncak And Lombok, Indonesia, Sundjaya -, Syarifudin -
Antropologi Indonesia
The Forest Ecosystem Restoration (FER) project is a technological-science attempt to restore the damaged landscape as part of the environmental crisis mitigation. To some extent, the adoption of FER has also altered forest land use practices adopted by rural farmers as part of their livelihood. In rural-urban perspective, FER projects might be considered as a process of transferring environmental burdens from urban-downstream to rural-upstream communities living in the watershed areas. Our qualitative research in two FER project Puncak and Lombok, however, demonstrates how multiple actors, including local communities, actively influence the crisis defining process throughout problematization, mediation, apprehension stages. Such …

The Narratives Of Local Women’S Resilience In Disaster And Climate Change: The Voices Of Indonesian Women In The Watershed Areas, Titiek Kartika Hendrastiti, Siti Kusujiarti, Rambat Nur Sasongko
The Indonesian Journal of Socio-Legal Studies
This study analyzes the narratives of women’s resilience in disaster from the post-colonial feminism approach. Ecological justice and gender issues have been addressed by other studies on Indonesia to amplify the voices of Indonesian women, but few of them focus on women’s narratives. As a culture relying on oral traditions, Indonesian women’s narratives and stories are instrumental in decolonizing the knowledge on ecological justice. Even though feminist perspectives play an instrumental role in addressing ecological justice in Indonesia, studies using post-colonial feminism remain very limited.
This study employs post-colonial feminist ethnography and focuses on three watershed areas in Bengkulu, Indonesia: …

The Dynamics Of Military-Police Relations In Post-Authoritarian Indonesia (1998 To 2020), Bayu A. Yulianto
The Dynamics Of Military-Police Relations In Post-Authoritarian Indonesia (1998 To 2020), Bayu A. Yulianto
Masyarakat, Jurnal Sosiologi
Among myriad significant institutional changes in post-authoritarian Indonesia (1998-present) is the split of Indonesian police (POLRI) from the armed forces (ABRI, renamed into TNI after 1999). No longer locked in a dominant-subordinate configuration, the interaction between both institutions intensified in areas where they intersect. Drawing upon the theory of Strategic Action Field (SAF), this study attempts to capture the dynamics along the newly-established trajectory. It shall be argued that far from being one-dimensional, the relationship between both institutions has been marked by conflict, competition, and cooperation; depending on the SAF. Finally, this research proposes a new framework to assess the …

Asuransi Lingkungan Berdasarkan Polluter Pay Principle Dan Command And Control Untuk Pemulihan Lingkungan Hidup Akibat Pencemaran Dan Kebakaran Hutan, Subagio Aridarmo
"Dharmasisya” Jurnal Program Magister Hukum FHUI
Mining, plantation and industrial business actors are charged with the obligation to pay environmental insurance as a condition for being able to carry out activities or business. The application of environmental insurance is based on the Polluter Pay Principle and Command and Control in the framework of law enforcement in the environmental sector. Current laws and regulations do not guarantee safety and restoration of environmental pollution and/or damage, for example, many business actors do not pay compensation in court decisions in cases of forest and land fires. This makes efforts to repair and restore the environment from pollution and/or damage …

Transformation Of Farmer Resistance In Conservation Areas: Land Occupation By Farmers In Mount Halimun-Salak National Park, West Java, Sulastri Sardjo, Arya Hadi Dharmawan, Dudung Darusman, Ekawati Sri Wahyuni
Masyarakat, Jurnal Sosiologi
A number of studies have shown various agrarian conflicts as a response by local farmers against the policy of national parks that prohibits them from accessing conservation forest areas. However, previous studies had not explained the dynamics of power relations between park authorities and farmers who stand in opposition to these policies. This study employs a qualitative research approach complemented by secondary data to explain the transformation of farmer resistance in the Mount Halimun-Salak National Park (TNGHS) area, namely from their repertoire of everyday resistance to practices of land occupation. Specifically, this study uses the “powercube” analytical framework to explain …

Stakeholder Analysis On Boycott Movement: A Preliminary Study Using Media Contexts, Kresno Agus Hendarto
ASEAN Marketing Journal
Just like the celebrities, social movement depends, to an extent, on media in communicating its activities to the public. The relationship between social movement and media is transactional. On the one hand, social movement needs media to disseminate its activities. On the other hand, media needs social movement as the news source. Scant (beyond very few notable exceptions) empirical research is not available on boycott product as a social movement and stakeholder analysis in Indonesia. The objective of this study is to perform stakeholder analysis on boycott product as a social movement. To do so, the study attempts to answer …

The province of East Kalimantan has the largers tropical forests in Indonesia. throughout the era of the New Order government under President Soeharto the natural resources especially tropical forests were sistematically exploited without any serious effort on the part of the government and private companies to take care of the social and environmental aspect of such exploitation. As a result, severe environmental degradation took place and the local people in the country side lost their sources of livelihood. In the midst of the presence of multinational corporations and private forest concessionaires ironically there were enclaves of poverty. In this area …

Piracy In South East Asia: Indonesian & Regional Responses, Hasjim Djalal
Indonesian Journal of International Law
Piracy in high seas has caused a problem itself because there are no particular jurisdictionof any state that governed it. This particular issue falls onto universal jurisdiction in which any state has a jurisdiction to enforce their national regulation about piracy itself. On the other hand, we don’t have sufficient international instrument which obliges the contracting states initiating a cooperation between them to combat piracy. An international cooperation, and even on regional basis (such as ASEAN and Asia-Pacific region) has already taken initiatives to combat piracy. Indonesia, as one of the states involved in international and regional basis regarding combating …

Defending sovereignty within an island nation is relatively more complex than doing so for a continental state. The number of scattered islands makes straits and seas more penetrable, vulnerable points and targets of asymmetric threats at sea. The aim of this research is to illustrate threats at sea and provide solutions in guarding and monitoring Indonesian coastal borders, which currently require more ships and radar technology as well as other sensing equipment due to longer beaches. The results reveal that firstly, potential asymmetrical threats at sea include former WWII mines, underwater fibre cables, and nuclear submarines belonging to foreign countries …

A Behavioral Approach To Bilateral Cooperation On Criminal Laws: A Case Study On Indonesia’S Extradition And Mutual Legal Assistance Treaties, Harison Citrawan, Muhammad Fedian
Indonesia Law Review
The effectiveness of bilateral agreements in the context of criminal law enforcement remains highly contested. In the Indonesian context, such bilateral cooperation classifies two modalities of indirect law enforcement systems, namely, extradition and mutual legal assistance (MLA) in criminal matters. This article attempts to explain these modalities through a behavioral and rational approach by taking Indonesia’s MLA treaty with Switzerland and its extradition treaty with the Russian Federation as a case study. From this approach, we argue that the state’s decision to cooperate implies the adoption of control and consensus models. However, these two models were induced by political preferences …

Finding Legitmacy On European Union Trade Policy To Limit The Import Of Palm Oil: Will Indonesia Survive (Again)?, Nandang Sutrisno
Indonesian Journal of International Law
In March 2019, the European Union considered palm oil to cause ILUC along with being one of the contributors for emission and pollution. However, the move has been condemned by palm oil exporting States, such as Indonesia. It is accused as a modern, “green protectionist” move to protect national market or other countries importing goods. Since European Union uses environmental justification to restrict palm oil import from Indonesia, it is inherently correlated with the general exception enshrined in Article XX of the GATT relating to the principles of international trade. Under the assessment based on Article XX and judicial decisions …

Indonesian Timber Legality Assurance System (Svlk): In Pursuit Of Sustainability In Forest Governance, M. Yakub Aiyub Kadir
Indonesia Law Review
This paper investigates the Indonesian Timber Legality Assurance (Sistem Verifikasi Legalitas Kayu, SVLK) and its nature to produce legal wood under the European Union-Forest Law Enforcement Governance and Trade (EU-FLEGT) system. It is intended to ensure the exporting states control over legality of wood under new forest governance and its enforcement in EU market. Using a critical legal analysis, this paper argued that the SVLK could present legality in a formalistic way, but it could not guarantee the substantial meaning of benefit for sustainability, participatory and community. Therefore this paper contributes to provide a better understanding of the application of …

Guarding Central Government Control Over Forest: Forest Governance In The Post Decentralization Indonesia, Ali Muhyidin
Jurnal Politik
This article examines whether reform forest governance in Indonesia started in the 1990s, which was partially aimed to promote equity, participation and sustainable forest management, has delivered its promised consequences. In the New Order era, the central government had sole authority in managing forests and granting exploitation rights. This authority has been partially transferred to local governments during a decentralization process to achieve greater efficiency and equity. However, the Indonesian case highlights that such institutional change has not yet produced the expected outcomes. The case indicates a contestation between the local and central government along with institutional resistance, which have …

Space-based earth observation technology applicable to forest inventory and monitoring is well known in the scientific community. High-resolution satellite images form an important data source for forest mapping and change detection at regional and national scales. The value of forest change information derived from remote sensing data is significantly enhanced if this information is integrated into a spatially explicit geographic information system. Satellite-based rapid assessment was conducted to measure spatiotemporal changes in Batudulang forest over the years. The general approach to quantify change in the spatial aspect of the forest involved change detection using moderate-resolution imaging spectro-radiometer satellite-based normalized difference …
