As the rate of AI adoption by lawyers steadily climbs, unfortunately so has the number of incidents of AI misuse by attorneys. For some time, courts satisfied themselves with giving offending lawyers warnings, ordering them to take additional CLE, and/or administering relatively nominal monetary sanctions. Lately, however, frustrated judges throughout the country have upped the ante by not only assessing increasingly higher sanctions but also imposing case dismissals and suspensions or disciplinary referrals for the lawyers involved. Is Being A Shareholder ‘In Name Only’ A Problem?, Daniel Schulte Jd
The Journal of the Michigan Dental Association
This column addresses the legal risks for Michigan dentists entering "shareholder in name only" agreements with non-dentist entities. Michigan law requires dental practices to be owned by licensed dentists to ensure professional control over public healthcare. Arrangements where management companies or manufacturers can reclaim stock for a nominal fee effectively strip the dentist of true ownership. This lack of control can lead to ethical conflicts, such as pressure to sell specific appliances regardless of professional judgment. Engaging in such schemes may endanger a dentist's license by thwarting state laws intended to protect clinical independence.

AI's rapid evolution and integration into society has had and will continue to influence how distance education programs teach their students profoundly. This study aimed to explore the opinions of higher education distance education Provost administrators, program managers, directors, department chairs, and other subject matter experts on the perceived impact of AI in the classroom. This study used a qualitative, phenomenological approach to examine how AI impacts students, faculty, program delivery, institutional policies, and university budgets. The recent explosion of artificial intelligence and generative AI undeniably impacts our federal and state courts. Currently, ABA Model Rule 1.1 and its Comment include a broad requirement of technological competence for an ethical practice. This Article will identify the technical competence obligations embodied in Model Rule 1.1 and examine the implications of AI for technological competence standards. In his second term, President Donald Trump has launched an unprecedented assault on the nation's largest law firms. Through a series of executive orders and highly unusual EEOC (Equal Employment Opportunity Commission) actions, the Trump regime has sought to undermine the independence of the private bar. In response, targeted firms have been forced to make a choice: to appease the administration or to fight back. This Essay considers those choices the interrelated nature of parallel settlements and suits-and the choice that the majority of firms have made to stay silent. Artificial Intelligence (AI) is changing our society and bringing the legal profession with it. The use of Generative AI (GenAI) in legal proceedings has received negative publicity from high profile mishaps in court filings. In one case, attorneys used the publicly available online GenAI tool, ChatGPT, to write a legal brief in which ChatGPT proceeded to make up its own citations. Following this, among other instances of the misuse of GenAI, courts have begun to require disclosures and limit the use of GenAI technology. The increased use of generative artificial intelligence (“GAI”) in the legal profession raises ethical questions. As a result, this note contemplates some state-adopted Model Rules of Professional Conduct that lawyers could violate if they improperly use GAI or fail to use GAI altogether. GAI enables lawyers to increase their efficiency, enhance their decision-making, and provide cost-efficient services to clients. However, GAI also presents lawyers with biased outputs, a lack of explainability, and hallucinations, as seen in recent cases when ChatGPT cited fictitious cases to lawyers. Does being a lawyer mean more than the mere pursuit of a client’s cause and resulting (hoped for) financial success and professional standing, while avoiding discipline? This article invites a consideration of what it means to be a true “professional” in the practice of law. First, the article explores the definition of the term “professional,” and proceeds to examine the obligations undertaken by lawyers (a) in their oath of admission, and (b) in codes of professional conduct. In nearly every jurisdiction, applicants to the bar must pass the Multistate Professional Responsibility Examination (MPRE). Its purpose, according to its owner, the National Conference of Bar Examiners (NCBE), is "to measure candidates' knowledge and understanding of established standards related to the professional conduct of lawyers." It does test whether an examinee has kept in short-term memory the rules and exceptions that make up part of the understanding of what it means to serve as a lawyer. An extraordinarily number of Americans either cannot afford or cannot find lawyers to assist them on civil legal matters. And an increasing number of Americans turn either to on-line apps or to nonlawyer professionals whose practices may overlap in whole or in part with what lawyers do. Although individuals receive much needed assistance, these alternative providers often confront allegations of committing the unauthorized practice of law. The mitigation investigation that is essential in every capital case requires a multidisciplinary team. The duty to conduct this investigation is clearly established federal law, as well as an ethical obligation of counsel. The mitigation evidence that is uncovered is of vital importance to the rights of the individual accused of a capital offense, but also to reliable outcomes since all decisionmakers—including prosecutors, jurors, and judges—need the most complete and accurate picture of the person facing the punishment of last resort. This thesis proposes that there is a lack of public confidence in federal law enforcement agencies and that this is because these agencies have become political weapons, investigating individuals rather than crimes, in violation of the U.S. Constitution. Following multiple scandals, from the historical targeting of the Civil Rights movement to present attempts to designate parents critical of school administrators as domestic terrorists, wholesale reform of these agencies is urgent. Global commercial third-party funding has given rise to wide-ranging regulatory approaches worldwide. Consequently, funders can engage in cross-border regulatory arbitrage by exploiting regulatory gaps within and among nations. This Article argues that the global community of nations should articulate a universal approach to the behavioral expectations of third-party funders operating transnationally, independent of local laws regarding the technical business of funding. It asserts that the key to fostering the ethical development of the third-party funding industry is to develop a globally applicable but locally enforced code of conduct or professional responsibility for the industry. Connotations of space sustainability include addressing all bases so that space activity develops to maximize human benefit. This Article reports the first qualitative empirical study of U.S. tax lawyers. We interviewed women lawyers who were tax planning specialists. Though this is the first such study of U.S. tax lawyers, this methodology has been used often to study the professional ethics of other tax practitioners around the world. We had three research questions that we sought to answer through dynamic conversations on topics such as the distinctions between good and bad tax plans and good and bad tax lawyers and also the joys and stresses of tax practice. Encalada Egúsquiza, an academic who studies border issues, discusses the reality that Child Migrants (CM) face, “They are minors traveling alone, then they have to appear in immigration courts, regardless of age. We're talking about children, in some cases, toddlers, without lawyers, who have to face a court that wants to deport them.” United States immigration policy fails to aid CMs who arrive at the U.S.-Mexico border; in a practice of exclusionary policy, it further traumatizes children who have journeyed to the U.S. alone.
