You Can Never Have Too Many Flowers: Nature As A Support For Survivors Of Genocide, War, And Conflict, Adam Hettler

One in five children around the world are surviving war or other violent conflicts. The trauma of disruptions to community, safety, and loss of friends, family, and home can have wide-ranging and life-long impacts on children who survive. While impacts will vary from individual to individual, the trauma can impact mental health, feelings of safety, relationships, ability to learn, and many other aspects of their lives. Many educators in the US and globally are working with refugee students or other students who are navigating the impacts on their brains and bodies of different traumas. This project seeks to answer the …
The Case For Mediation Representation Clinics And Externships, John Lande
The Case For Mediation Representation Clinics And Externships, John Lande
Faculty Publications
This article recommends that law schools offer mediation representation clinics and externship courses to assist self-represented litigants in cases with legally-represented parties. These courses would prepare law students to practice in the modern world. Students would get experience working with real clients, conduct interviews, help clients assess their goals and interests, analyze claims, perform legal research, prepare documents, coordinate with mediators, and negotiate with counterpart attorneys.
The courses would address the needs of multiple stakeholders including self-represented litigants, law students, law schools, courts, attorneys, mediators, and society in general. Law schools would develop these courses in collaboration with many potential …
Sexual Health Education Scope And Sequence, Sara Wadsworth
Sexual Health Education Scope And Sequence, Sara Wadsworth
Honors Projects
Based on a significant amount of prior research, comprehensive sexuality education (CSE) has been identified to be the most effective method of teaching sexual health education (SHAPE America, 2021; World Health Organization, 2023). Comprehensive sexual health education improves healthy behaviors and outcomes, provides useful information, and is positively perceived by students (Gardner, 2015; Kirby, 2002; Robinson et al., 2022). However, the United States’ current sexual health education has not implemented this ideal method, which is shown through state laws, students’ experiences, underdeveloped skills and flawed understanding of concepts, and – most importantly – a lack of resources for teachers (Foley, …
Entertaining And Embracing Professional Identity Development In The 1l Legal Writing Curriculum, Charles Oldfield
Entertaining And Embracing Professional Identity Development In The 1l Legal Writing Curriculum, Charles Oldfield
Akron Law Faculty Publications
Because of their already heavy workload, legal writing faculty sometimes resist taking on new curricular responsibilities, including calls to incorporate ethics and professionalism training in the first-year legal writing curriculum. But the ABA now requires law schools to provide students with opportunities to develop their professional identities throughout their time in law school. This requirement means that faculty will need to add professional identity development to their courses. Rather than resist this change, first-year legal writing faculty should embrace the opportunity by using the Model Rules of Professional Conduct to incorporate concepts of ethics and professionalism in their first-year courses. …

The Amazing Carrie Menkel-Meadow And What Wins When Passions Collide, Lela Love
The Amazing Carrie Menkel-Meadow And What Wins When Passions Collide, Lela Love
Articles
Carrie Menkel-Meadow (sometimes referred to as “Carrie” herein) is famous in the dispute resolution world as one of the field’s founders. Her prolific writing on dispute resolution—negotiation, mediation, arbitration, and the variants of these major processes—evidences an unrivaled passion for the subject. A renaissance thinker, her intellectual explorations also extend to other areas such as women’s rights and restorative justice for victims of egregious wrongs.
Her multiple passions sometimes create dynamic tensions. For example, what happens if mediation norms threaten a woman’s rights? Or if mediators divert the focus of a dispute resolution process to the future, neglecting a horrific …

Creating Lightbulb Moments: Developing Higher-Order Thinking In Family Law Classrooms Through Court Observations, Sonia Gipson Rankin
Creating Lightbulb Moments: Developing Higher-Order Thinking In Family Law Classrooms Through Court Observations, Sonia Gipson Rankin
Faculty Scholarship
This article fills a critical gap in the family law literature by arguing that teaching doctrinal family law in conjunction with the application of established learning theory and pedagogy yields a deeper engagement with the subject matter and leads to more practice-ready lawyers. ABA Standards 301, 303, and 304 do not clearly articulate the distinction between experiential education and experiential learning; doctrinal law classrooms are often bereft of experiential learning activities. By incorporating active learning and inclusive pedagogy in the doctrinal classroom and following recommendations from the MacCrate Report and Family Law Education Reform Project, students will be better prepared …

Litigation Bias, Adam N. Eckart
Litigation Bias, Adam N. Eckart
Suffolk University Law School Faculty Works
There is pervasive litigation bias in law schools. Despite significant interest in transactional law fields among law students, law schools disproportionately teach to the student interested in litigation: litigation-based legal writing assignments outnumber transactional-based ones 19 to 1; litigation-based clinics outnumber transactional ones 9 to 1; and doctrinal classes focus primarily on appellate court cases, often failing to entertain substantive discussion on the creation or content of the documents that led to the dispute. As a result, law school graduates are 44% less prepared for transactional careers than litigation careers.

The Voice Of The Gods Is Crippling: Law School For Helicoptered Millennials, Katerina P. Lewinbuk, Taci Villarreal, Elena Bolonina
St. Mary's Journal on Legal Malpractice & Ethics
As millennials dominate law school classrooms, many professors are recognizing the importance of altering the traditional methods of teaching law. Millennials act, think, and learn differently. Numerous factors are linked to why this new generation of law students is distinctively different than previous generations. This article examines these factors and how they influence millennials’ learning styles. Alternative methods of teaching millennial law students are also discussed and proposed, along with a specific example of a tailored professional responsibility textbook and course to the modern law student.

This article addresses the different topics law schools are teaching and how each either succeeds or fails at teaching students to be technologically competent. This article provides a small guide to some of the proven-successful classes and technologies taught and how they can be incorporated into a law school's current curriculum. This article aims to assist in creating a bright line and uniform standard to assist all law schools in producing "tech-savvy" lawyers. A big part of being technologically competent is the ability to understand and utilize, not rely on, artificial intelligence. This article discusses the use of artificial intelligence …

Keeping Up With A Kardashian: Shedding Legal Educations' Vestigial Trade School Anxiety And Replacing The Dated Casebook Method With Modern Case-Based Learning, Jason G. Dykstra
Hofstra Law Review
Kim Kardashian West's choice to pursue her legal studies via a modernized version of apprenticeship rather than by attending law school represents an alarming vote of no-confidence in the efficacy of current legal education. Simply, legal education remains surprisingly and needlessly static despite decades of harsh criticism and the heightened velocity of change that has enveloped the legal industry. From big law to rural practitioners, the traditional law firm model proved ripe for disruption. This disruption is fueled by several discrete changes in how legal services are provided that cumulatively generated a substantial disruption across the board. They include technological …

Austen Parrish (2014-2022)
This weekend is a time of celebration in Bloomington, as we welcome friends and family of the Class of 2019 for our annual commencement ceremony. It’s an important milestone in our students’ lives. Commencement is also a time for looking back. The past year saw several significant milestones for the IU Maurer School of Law. I’d like to touch on just a few of them in this month’s column.
Seeing Through The Racist Smog: With A Reading Curriculum Based On Culturally Responsive Teaching And Warm Demander Pedagogy, Maren Swann
School of Education and Leadership Student Capstone Projects
There are countless articles about the Achievement Gap, but few offer concrete solutions. While the teaching force is “whitening,” the percentage of students of color is increasing. A small group of researchers have offered two new pedagogies as a way to help students of color and low-income students succeed: culturally responsive teaching and warm demander pedagogy. While there is literature on these two theories of pedagogy, there are few unit plans. This author created a 3rd grade reading unit entitled Readers Workshop Activist Book Review Unit using culturally responsive teaching, warm demander pedagogy and Wiggin’s and McTighe’s “backwards design” curriculum …

Shared Viewpoints Of Enl Teachers About The Challenges They Face: A Q-Methodological Study, Janine Curiale
Selected Full Text Dissertations, 2011-
Since the 1900s, the United States has become more diverse due to an increase in the number of languages spoken across the continent due in part to the rise in immigration from different countries. This has altered the structure of schools and led to a greater need for classroom supports in the area of language development. Specifically, the English as a New Language (ENL) teachers have become a more prominent figure in the schools and classrooms by providing support for students whose first language is not English. There are many positive outcomes and challenges that arise in the schools for …

Changing The Modal Law School: Rethinking U.S. Legal Education In (Most) Schools, Nancy B. Rapoport
Dickinson Law Review (2017-Present)
This essay argues that discussions of educational reform in U.S. law schools have suffered from a fundamental misconception: that the education provided in all of the American Bar Association-accredited schools is roughly the same. A better description of the educational opportunities provided by ABA-accredited law schools would group the schools into three rough clusters: the “elite” law schools, the modal (most frequently occurring) law schools, and the precarious law schools. Because the elite law schools do not need much “reforming,” the better focus of reform would concentrate on the modal and precarious schools; however, both elite and modal law schools …

This report summarizes the results of the Center for the Study of Applied Legal Education’s (CSALE) 2016-17 Survey of Applied Legal Education. The 2016-17 Survey was CSALE’s fourth triennial survey of law clinic and field placement (i.e., externship) courses and educators. The results provide insight into the state of applied legal education in areas like program design, capacity, administration, funding, and pedagogy, and the role of applied legal education and educators in the legal academy. Law schools, legal educators, scholars, and oversight agencies rely on CSALE’s data. They do so with the summary results provided here, the earlier Reports …
The Downside Of Requiring Additional Experiential Courses In Law School, Douglas A. Kahn
The Downside Of Requiring Additional Experiential Courses In Law School, Douglas A. Kahn
Articles
In recent years, the bar has expressed dissatisfaction with what is considered by some to be inadequate preparation of law students to begin practicing law immediately after graduation. There are several reasons why this has become a matter of concern for the legal profession. The profession itself has undergone significant changes. Although there are a few exceptions, most law firms no longer wish to spend time training their young associates or allowing them much time to develop the skills they need. First, clients are unwilling to pay for the time a young lawyer spends in acquiring needed skills. Second, the …

Transactional Clinics As Change Agents In The Trump Era: Lessons From Two Contexts, Priya Baskaran, Michael Haber
Scholarly Articles in Law Reviews & Journals
The results of the 2016 presidential election and the efforts by the Trump administration to make sweeping changes to a wide range of federal policies have left communities across the country feeling overwhelmed and threatened. In its first year, the Trump administration has been working steadily to slash budgets for health care, housing, infrastructure, schools, and other public benefits that help low-income and middle-class Americans, while adopting policies and engaging in rhetoric that has made many immigrants, Muslims, people of color, and LGBTQ people feel increasingly vulnerable and marginalized.

On a substantive and ethical level, I tell my students to take on faith that if you were to do all of this and take all this into account, if you were to apply the conflict of interest and the disqualifications rules, it could make it extremely difficult or many of the firms involved in these matters to avoid being conflicted out; especially, if the parties and the kind of firms involved were not dealing with these conflicts and issues until a problem arose. The question I ask my students again at this point is what could be done. What …
