This is a reflective, analytical essay remarking on the role that Blackness has and continues to play in the construction, understanding and application of "black letter law." This essay is written from a Black and BlaQueer perspective and displays how a shift in standpoint--moving from the invisible, standard white "reasonable person"--underscores and illuminates the current legal and sociopolitical crisis we find ourselves in. On July 2nd, 1862, President Abraham Lincoln signed the first Morrill Act to establish colleges for educating the middle-class and the poor in the field of agriculture, military tactic, and mechanics without excluding the classical studies (Smith & Wilson, as cited in Comer et al., 2006; Thelin, 2011; Seals, 1998; Mayberry, 1991; National Archives & Record Administration [NARA], n.d.a; Neyland). Twenty-eight years later, Congress authorized the second Morrill Act, and eventually established 17 land-grant colleges for African Americans. This literature review presents an analysis of race ideology within U.S. society and schools in order to understand how such ideologies are transmitted to African American students through Eurocentric curricula and thus can perpetuate racism. Recognizing that American curricula originates from social control elements and that schools are institutions responsible for preparing students for the world they live in (Apple, 2004; Apple & King, 1983; Giroux, 2001; and Giroux & Penna, 1979); I focus on African American students’ experience with a Eurocentric curriculum and how this curriculum influences their social identity and ability to successfully navigate society. In this Article, written on the heels of Race + IP 2017, a conference we co-organized with Amit Basole1 and Jessica Silbey,we propose and articulate a theoretical framework for an interdisciplinary movement that we call Critical Race Intellectual Property (Critical Race IP).Specifically, we argue that given trends toward maximalist intellectual property policy, it is now more important than ever to study the racial investments and implications of the laws of copyright, trademark, patent, right of publicity, trade secret, and unfair competition in a manner that draws upon Critical Race Theory (CRT).
