Audit Committee And Internal Control Effectiveness In Public Sector Entities, Cosmas R. Masanja Dec 2022

Audit Committee And Internal Control Effectiveness In Public Sector Entities, Cosmas R. Masanja

Business Management Review

This paper reports the findings of a study that examined the audit committee and internal control effectiveness nexus. The study worked on the assertion that the audit committee of the board enhances internal control effectiveness, which is widely documented and supported, more so in the private sector. As a result, many public sector entities ' governing boards are increasingly establishing such audit committees. Yet, it is unclear to what extent such increase in audit committees contribute to public sector entities ' internal control effectiveness, especially in developing economies. This study, therefore, examined the explanatory power of the audit committee ' …

Aggregation Bias And Input-Output Regionalization: Detail Or Accuracy?, Randall Jackson, Caroline Welter, Gary Cornwall Dec 2022

Aggregation Bias And Input-Output Regionalization: Detail Or Accuracy?, Randall Jackson, Caroline Welter, Gary Cornwall

Regional Research Institute Working Papers

Conventional wisdom holds that results from input-output (IO) models with greater sectoral detail are superior to those from models with less detail. However, there is an implicit assumption that the more detailed data are as accurate as their aggregated counterparts. In this paper, we explore the tradeoffs between sectoral detail and model accuracy in the context of IO regionalization, a practical context in which greater sectoral detail is commonly achieved via the imputation of missing values. This reality is especially apparent for increasingly smaller geographical regions where privacy concerns result in more suppressed and undisclosed data. As the number (or …

The Concept Of “Elderly Citizens” In The Indonesian Constitution: A Critical Analysis, Ari Wahyudi Hertanto, Satya Arinanto, Jufrina Rizal

Indonesia Law Review

Human existence is the most important element of the law and the state. They contribute greatly to the growth and development of a nation. Despite their great contribution, all human beings will experience a gradual decrease in their physical and psychological capacity due to ageing. According to the latest Central Statistics Agency report, there exists 29.3 million elderly citizens in Indonesia. This figure is equivalent to 10.82% of the total population. To anticipate this demographic condition, the government ought to ensure the welfare of its elderly citizens in accordance with the mandate of the 1945 Constitution. However, the 1945 Constitution …

The Legal Ethics Of Lying About American Democracy, Andrew M. Perlman Dec 2022

The Legal Ethics Of Lying About American Democracy, Andrew M. Perlman

Suffolk University Law School Faculty Works

Numerous lawyers contributed to the disinformation campaign that led to the storming of the U.S. Capitol on January 6, 2021. Some of the lawyers filed lawsuits that questioned the legitimacy of the presidential election, and others spread falsehoods while acting as legislators or in similar high profile roles. This chapter explores the potential disciplinary consequences of their behavior and the larger implications of their conduct for American democracy. One theme of this chapter is that, when lawyers make claims about elections, the consequences of misinformation are severe and threaten to undermine trust in our democratic institutions. Given the stakes, the …

Conflict Resolution Procedures Within The Courtroom: Between The Adversarial And Inquisitorial Traditions, Amos Gabrieli, Michal Alberstein Dec 2022

Conflict Resolution Procedures Within The Courtroom: Between The Adversarial And Inquisitorial Traditions, Amos Gabrieli, Michal Alberstein

Georgia Journal of International & Comparative Law

Modern courts have evolved around two central legal traditions—the adversarial and the inquisitorial. The two traditions have historically reflected different approaches towards consent and authority or towards conflict resolution and strict application of the law. Yet with the blurring of boundaries between the two legal traditions, and alongside various reforms in adversarial and inquisitorial legal systems, new practices of judicial conflict resolution within the courtroom have developed. This Article will compare the two legal traditions and examine the assimilation of ideologies and procedures typical to conflict resolution processes into the work of judges, as they strive to end civil legal …

Preparing Future School Counselors To Work With English Language Learners, Jennifer S. Watkinson, Qi Shi, Hope Slezak, Rachel Litvin

Journal of Counselor Preparation and Supervision

English Language Learners (ELLs) are one of the fastest growing student groups in the United States, yet school counselors often feel unprepared to address their unique needs. To better prepare school counselors to work with ELLs, counselor educators can integrate experiential learning activities that are grounded practice. Yet, little is known about the types of work experiences school counselors encounter when working with ELL students. This phenomenological study described the experiences of eight, first year school counselors who work with ELLs. Findings inform the types of training scenarios counselor educators can use to prepare school counselors-in-training (SCIT) to work with …

The Impact Of The Covid-19 Pandemic On Risk Factors For Fatal Intimate Partner Violence And Domestic Violence Services Provided, Faith E. Alves

Honors Theses

The current study assessed the COVID-19 pandemic-related changes in risk factors for fatal intimate partner violence (IPV) among female victims. It additionally analyzed IPV services received before and during the pandemic. Data came from a system that most domestic violence (DV) agencies in Connecticut utilize to record their contacts with their clients, including an initial screening through a police-social service intervention. Results indicated that unemployment of the partner was significantly higher in the during-COVID group. Additionally, the delivery of criminal justice services was significantly higher in the pre-COVID group whereas delivery of law enforcement services was significantly higher in the …

DNP and Student Works

Homelessness impacts over half a million individuals in the United States and increases the risk of physical, emotional, social, and financial distress, potentially leading to violence, abuse or harm. Individuals experiencing intimate partner violence (IPV) are at an increased risk of becoming homeless. Homeless shelters in Duluth, MN, without specific IPV focus, do not have formal IPV training in place. The goal of this project was to educate staff and volunteers at a warming center in Duluth, MN on how to identify IPV, implement an evidence-based screening tool, and provide appropriate resource referrals to victims of IPV.

Abolishing The Evidence-Based Paradigm, Erin Collins Dec 2022

Abolishing The Evidence-Based Paradigm, Erin Collins

BYU Law Review

The belief that policies and procedures should be data-driven and “evidence-based” has become criminal law’s leading paradigm for reform. This evidence-based paradigm, which promotes quantitative data collection and empirical analysis to shape and assess reforms, has been widely embraced for its potential to cure the emotional and political pathologies that led to mass incarceration. It has influenced reforms across the criminal procedure spectrum, from predictive policing through actuarial sentencing. The paradigm’s appeal is clear: it promises an objective approach that lets data – not politics – lead the way and purports to have no agenda beyond identifying effective, efficient reforms. …

Gatekeeping Admissions: Access To Justice And Inclusive Admissions Processes, Sarah Kriekle Dec 2022

Gatekeeping Admissions: Access To Justice And Inclusive Admissions Processes, Sarah Kriekle

Dalhousie Journal of Legal Studies

Law schools are the gatekeepers to the legal profession, and there are multiple social barriers that impact access to a legal education across a proportionally diverse range of people. This article will first rely on existing literature to demonstrate why diversity in the legal profession is an access to justice issue and to illustrate the current homogeneity that exists within the profession. This article will then argue that two primary factors prevent law schools from attracting a more diverse student body. The first factor is the over-reliance on numerical statistics like grade point average (GPA) and Law School Admissions Test …

As Americans live longer, the prevalence of Alzheimer’s disease and related dementias will increase. Caregivers are critical to the care and life quality of people with dementia. Yet, dementia caregivers are at increased risk for health issues, social isolation, and financial challenges. To help educators with the University of Kentucky Cooperative Extension Service work with their local Alzheimer’s Association and the University of Louisville to better support dementia families, we explored caregiver needs and service utilization using an online survey. Our findings highlighted the need for counseling/support, care management skills, resource education, self-care strategies, and legal services. Extension Service Educators …

Gateways To The Internet Ecosystem – Enabling And Discovery Tools In The Age Of Global Online Platforms, Judit Firniksz, Borbála Tünde Dömötörfy, Péter Mezei

Yearbook of Antitrust and Regulatory Studies

The Google Shopping case has provided significant lessons that reach beyond antitrust enforcement. ‘Enabling and discovery tools’ create a layer that serves as a gateway to the Internet ecosystem. Therefore, on the one hand, they play a key role in ensuring the openness of the Internet ecosystem, and on the other hand, they exercise a primary influence on consumer experiences and their cognitive processes, which in turn determine online consumer transactions. Enabling and discovery tools, such as adopting design methods based on applied behavioural sciences (for example: user experience design (UX) and user interface design (UI)), create global challenges at …

Not So Civil Commitment: A Proposal For Statutory Reform Grounded In Procedural Justice, Margaret J. Lederer Dec 2022

Not So Civil Commitment: A Proposal For Statutory Reform Grounded In Procedural Justice, Margaret J. Lederer

Duke Law Journal

Every year, millions of Americans struggle with serious mental illness. Of them, thousands experience civil, or involuntary, commitment—that is, hospitals invoke the coercive power of the state to force these individuals into psychiatric hospitals against their will. Whether someone requires hospitalization is a complex question of psychology, medicine, and substantive law.

But the process of civil commitment itself is troubling. Across the board, states fail to afford those facing civil commitment meaningful procedural protections. Current state laws subject individuals facing commitment to extended periods of confinement with little to no judicial intervention. Indeed, individuals facing commitment may wait weeks or …

Navigating Beyond The Lodestar: Borrowing The Federal Sentencing Guidelines To Provide Fee-Shifting Predictability, Matthew Ahn Dec 2022

Navigating Beyond The Lodestar: Borrowing The Federal Sentencing Guidelines To Provide Fee-Shifting Predictability, Matthew Ahn

Dickinson Law Review (2017-Present)

The lodestar has been the dominant calculation method for fee-shifting awards for nearly 40 years. But the lodestar has numerous persistent issues: it leads to extra litigation and judicial effort, it results in highly variable fee awards, and it incentivizes plaintiffs’ attorneys to bill extravagantly and reject settlement. This Article argues that these issues with the lodestar, along with many others, result from a mismatch between the lodestar and the purpose of the underlying fee-shifting statutes, which is to encourage attorneys to bring suits that would not normally be economically viable. Encouraging attorneys to do so requires the fee awards …

Assessing The Mental Health Of Women At The Intersection Of Intimate Partner Violence And Animal Cruelty: Personal And Population Level Risk Factors For Co-Victimization, Alaina M. Beauchamp

Dissertations and Theses (Open Access)

One predictor of intimate partner violence (IPV) occurring in the home is pet abuse. The high prevalence of pet cruelty among IPV relationship can create a significant barrier to seeking help due to the inability to bring the pet or concern for the pet’s wellbeing. This human-animal bond is a more common source of emotional support among victims with experiences of pet abuse, as opposed to women whose pets had not been abused. This study 1) explored the relationship between victims of IPV and their pets, the dynamics and characteristics of situations of co-victimization (i.e., abuse of both a human …

An Essay On Ideology And Legal Education In Micro Jurisdictions: The Example Of Jersey, David Marrani Dec 2022

An Essay On Ideology And Legal Education In Micro Jurisdictions: The Example Of Jersey, David Marrani

Journal of Civil Law Studies

This article explores the question of legal education in micro jurisdictions using the case of Jersey, a British Crown Dependency, positioned geographically, historically and culturally between two larger jurisdictions, France and the UK. It analyses how Jersey’s legal training is pulled towards those large “big neighbours,” rather than focusing on what makes its specificity and attraction. It questions how legal education in micro-jurisdiction is actually linked to ideology. The article starts with the following question: are we taking micro jurisdictions seriously? It then considers the routes to legal qualification in micro jurisdictions, before focusing specifically on the case of Jersey …

Navigating Acculturative Stress: A Guide For Supporting Newcomer Students In California Esl Classrooms, Daniela Lopera Ruiz

Master's Projects and Capstones

Acculturation has been widely studied as a post-migration phenomenon that individuals face when coming in contact with their new recipient culture and environment. The different experiences, tasks, and requirements that newcomers must endure upon arrival may lead to their suffering prolonged periods of discomfort. This moderate, intermediate, or acute feeling of uneasiness is defined as acculturative stress. In it, the continued exposure to stressors such as adjusting to a new culture, rules, behavioral patterns, a second language, finding housing, and obtaining an education and employment can lead to trauma. This field project has been designed to provide educators and allies …

Theses and Dissertations

For this dissertation, I conduct an ethnography of three antitrafficking programs; interview 38 activists and survivors of trafficking; and analyze organizational texts, websites, and social media. I examine the history of the antitrafficking movement. Among the three organizations, activists provide housing; food, clothing, and hygiene items; medical services; mental health services and counseling; mentorship; education for survivors; a 24-hour hotline; outreach; case management and referrals; training for law enforcement; a drop-in center; and education and awareness events. I examine activists’ diagnostic, prognostic, and motivational framing of sex trafficking, and other framing tactics, such as frame alignment, frame diffusion, frame resonance, …
