The Process And Role Of The Judiciary In Election Administration Dispute Resolution In Indonesia, Eny Kusadarini, Anang Priyanto, Sri Hartini
Jurnal Civics: Media Kajian Kewarganegaraan
Election administrative violations occur at the time of the implementation of the general election by election organizers and contestants. Sometimes, they do not realize that they have committed a violation. Since the general election during the reformation period after the fall of the New Order in Indonesia, there have been frequent violations of election administration resolved through administrative courts through the State Administrative Court. The dispute resolution was carried out after complaints were made through Bawaslu and DKPP as administrative dispute resolution (ADR) institutions and did not bring results. This administrative violation is considered detrimental to the candidate contesting the …

With regard to conducting criminal offense, a notary could be accounted for the deed that they make, based on what they see, what they witness and what they experience in a legal act. Thus, the research is concerning with the responsibility of a notary who has made a violation that causes a loss to other …

The Failed Attempt To Overthrow The American Government: Crime And Insurrection, Frances P. Bernat
Journal of Criminal Justice and Law
President Trump, refusing to concede the 2020 Presidential election, claimed that there was election fraud. On January 6, 2021, the date set to finalize the election results by Congress, President Trump implored hundreds of thousands of his followers to march to the Capitol and “Stop the Steal.” Inside and outside the Capitol building, the police were overpowered by a mob of Trump supporters who did not want to have Joe Biden be formally declared the next U.S. President. The siege on the Capitol, in a failed attempted overthrow of the national government, was thwarted later that night. In the early …

American Surrogacy: Babies For Sale?, Madison Edwards
American Surrogacy: Babies For Sale?, Madison Edwards
Honors Projects
More surrogacy contracts are fulfilled in the United States than in any other country (Bromfield, 2016, p. 193). In 2014, there were approximately 2,000 surrogacy arrangements in the U.S., yet the market is totally unregulated (Shellnutt and Grizzle, 2018, p. 31). Given that 1 in 6 American couples face infertility, there will continue to be a demand for alternative and assisted reproductive options (Shellnutt and Grizzle, 2018, p. 34). This paper seeks to explore several areas of surrogacy, including contract enforcement, potential problems parties in surrogacy agreements face, current legislation, the role of religion in surrogacy, and specific case studies. …

Race, Rallies, And Rhetoric: How Trump’S Political Discourse Contributed To The Capitol Riot, Heather Alaniz, Kimberly D. Dodson, Jared R. Dmello
Journal of Criminal Justice and Law
The January 6, 2021, Capitol riot in Washington D.C. reflects one of the worst moments for democracy in U.S. History. Estimates indicate 10% of the individuals arrested following the Capitol riot had connections to far right militias and other right-wing extremist groups. To investigate the events that led up to the Capitol riot, this study provides a descriptive analysis of Trump’s public rhetoric between 2015-2020 citing tweets, speeches, and news interviews where his words created an environment for violence among his supporters prior to and throughout his presidency.
Police Officer Political Identity And Their Opinions Of Public Protests, Lois V. Woods, Kimberly K. Blackmon
Police Officer Political Identity And Their Opinions Of Public Protests, Lois V. Woods, Kimberly K. Blackmon
Journal of Criminal Justice and Law
Purpose: Controversy surrounding the BLM movement and the insurrection at the US Capitol on January 6, 2021, has been felt even within the ranks of policing. Participation of police officers in the Capitol riot seemed to be at odds with the duty and responsibility of those officers who sustained serious injuries that day. Method: Using data collected from active law enforcement officers, the current study examines how political identity may play a role in a police officer’s perceptions of law enforcement engagement in political protests. Results: The only significant difference found was police refraining from engaging in or participating with …

Acknowledgment Of Culture And Stereotypes: Black Participants’ Perceptions Of Specific Therapist Behaviors, Tsotso T. Ablorh
Graduate Masters Theses
Mental health disparities for Black people of diverse ethnicities compared to people of other racial identities has been well-documented (Alegría et al., 2008; Maura & Weisman de Mamani, 2017). Research addressing this pervasive systemic and interpersonal problem often focuses on client-related factors that create or intensify barriers to care. However clinician-related factors (i.e., racial identity, multicultural training, implicit biases, behavior, etc.) also have a significant impact on barriers to care, retention in therapy, and clinical outcomes for people of African descent (Larrison & Schoppelrey, 2011; Owen, Imel, Adelson, & Rodolfa, 2012). Researchers suggest that the favoring of historically white perspectives, …

The Illegally Traded Elephant In The Room: Species Terrorism & Combating Illegal Wildlife Trade, Áine Dillon
The Illegally Traded Elephant In The Room: Species Terrorism & Combating Illegal Wildlife Trade, Áine Dillon
Pace International Law Review
The illegal wildlife trade has been a dilemma for decades
and remains prevalent globally – international intervention is
required now. While most countries participate in the Convention
on International Trade in Endangered Species of Wild
Fauna and Flora (“CITES”), not all countries have the same approaches
to combating the illegal wildlife trade. Unique approaches
can be beneficial because each illegally traded species
requires a different response, and countries with limited resources
can also participate. However, the lack of a unified response
hinders the global fight against the illegal wildlife trade.
While traditional methods to combat crime, such as passing
laws, …
The Online Criminal Trial As A Public Trial, Stephen Smith
The Online Criminal Trial As A Public Trial, Stephen Smith
Faculty Publications
There are two ways of favorably conceiving online trials in Sixth Amendment terms. One is that an online trial is a public trial, by its terms. The other is that an online trial may not be public, for Sixth Amendment purposes, but may nonetheless satisfy applicable constitutional demands for trials considered “closed.” This Essay proposes both: that an online trial is fundamentally “public” for Sixth Amendment purposes and, if it is not, it may still be a constitutional accommodation of the Sixth Amendment’s public trial guarantee, in appropriate circumstances.
The constitutionality of an online trial may be largely an idle …

Does Performance Management Effectiveness Matter? Testing The Expanded Expectations Disconfirmation Model Of Local Disaster Risk Reduction, Reginald G. Ugaddan
Does Performance Management Effectiveness Matter? Testing The Expanded Expectations Disconfirmation Model Of Local Disaster Risk Reduction, Reginald G. Ugaddan
Asia-Pacific Social Science Review
With the heightened demand for the public sector to adopt various measures needed for disaster management, local governments are expected to employ adaptive and innovative organizational approaches in enhancing the quality of local disaster management. Primarily, although studies have examined various predictors of disaster management performance, few explored the possible contribution of the performance management system through the lens of the expectancy disconfirmation model (EDM). Also, the study examines and finds support for EDM, positing that it functions well in light of local government employees’ perception of disaster management performance. Employing data from a regional survey in the Philippines of …

Cyberbullying Victimization As A Predictor Of Depressive Symptoms Among Selected Adolescents Amidst The Covid-19 Pandemic, Jeyaseelan Maria Michael, Marc Eric Reyes
Makara Human Behavior Studies in Asia
Cyberbullying victimization has become a significant mental health concern, particularly among adolescents at risk of experiencing negative consequences like depression. As the outbreak of the Covid-19 pandemic forced everyone to stay at home and participate in all their educational, recreational, and entertainment activities online, this study investigated the relationship between cyberbullying victimization (CV) and depressive symptoms among 612 college students in Tamilnadu, India. We hypothesized that experiences of cyberbullying victimization would predict depressive symptoms among the participants. Adolescent participants aged 18 to 19 years old from colleges in Tamilnadu completed an online survey composed of the Cybervictimization questionnaire for adolescents …
