Typical And Atypical (Flexible) Forms Of Employment. Between Security And Flexibility, Andrzej Patulski Dec 2019

Typical And Atypical (Flexible) Forms Of Employment. Between Security And Flexibility, Andrzej Patulski

European Management Studies

This article indicates that the traditional model of full-time employment based on an employment contract for an unfixed term – where the employee carries out a certain kind of work under the guidance of the employer and in a location and at times designated by the employer – becomes doubtful for some categories of employees (e.g. top managers, advisers, experts, those compiling various assessments and evaluations, providing legal and financial-economic services, giving lectures, providing various forms of mediation and agency, investor supervision). From the macro point of view and from the organizational point of view, we must answer the questions: …

This article provides a critical analysis of the Trump Administration’s zero-tolerance policy that separated migrant families at the Southwest United States border from April to June 2018. It will provide a statistical analysis regarding the number of migrant children that were separated from their parents during this time period, and it will describe the poor living conditions that many of these children were subjected to as they waited for their parent’s immigration cases to be decided. Additionally, this article will also critically analyze the United States’ history of mistreating migrant children who started to flee their war-torn countries in Central …

Third-Party Funding: The Road To Compatibility In International Arbitration, Vienna Messina Dec 2019

Third-Party Funding: The Road To Compatibility In International Arbitration, Vienna Messina

Brooklyn Journal of International Law

Third-party funding in global commerce and dispute resolution has gained considerable traction in the last few decades. The rise in complex international arbitration cases has encouraged a demand for third-party funding arrangements since the disputes involve large amounts of money in addition to high legal costs. This Note explores the implications of third-party funding on the practice of international arbitration, particularly with the expansion of arbitral institutions’ doctrinal rules to address the use of third-party funding. Much of the pre-existing research and literature highlights the issues that third-party funding poses in international arbitration proceedings, but fails to consider a broader, …

From Enemy Asset To National Showcase: France’S Seizure And Circulation Of The Matsukata Collection (1944-1958), Léa Saint-Raymond, Maxime Georges Métraux

Artl@s Bulletin

Sequestered by the French State as an "enemy asset" in 1944, Kojiro Matsukata’s collection was used as a national showcase through exhibitions until 1958. Few catalogues were transparent as to the works’ provenance from the collection. When we map and visualize this historical information, a significant contrast appears between the “real” circulation of artworks, as recorded in governmental archives, and the "official" circulation listed in catalogues. This discrepancy points to a propaganda effort in such a way as to bolster an artistic narrative that was key to French national pride, and studying it can further explain why the French decided …

The Third Wave Of Graduate Labor Unions, Anthony Walker Dec 2019

The Third Wave Of Graduate Labor Unions, Anthony Walker

Theses - ALL

A 2016 NLRB decision that made graduate labor unions legal has contributed significantly to a wave of graduate organizing, continuing a 50-year history of graduate unions. This research investigates this contemporary wave of graduate unionization using two papers, which take a theoretical and an empirical approach respectively. The first paper uses a Marxist analysis to connect the narrow antagonism between graduates and management with larger-scale phenomena that involves other workers too, such as the growing population of contingent academic workers. It describes how corporate interests have influenced higher education and administrators have become managers of workers in order to help …

How New York City Is Failing Students With Special Needs—And Why Minority Kids Have It The Worst, Pamela Subizar Dec 2019

How New York City Is Failing Students With Special Needs—And Why Minority Kids Have It The Worst, Pamela Subizar

Capstones

Under federal law, children are guaranteed free, appropriate education, but reports have found failures at every level of the New York City special education system. Despite some improvements by the city in recent years, initial evaluations are still delayed, and mandated services go unprovided. Complaints filed against the city have multiplied. Thousands of parents have to sacrifice savings and time fighting for better services. This report describes the particular challenges faced by minority families using data analysis, interviews with experts, and stories.

Latino students depend on these public services the most—they represent half of NYC students in special education programs. …
