Healer, Witness, Or Double Agent? Reexamining The Ethics Of Forensic Psychiatry, Matthew U. Scherer

In recent years, psychiatrists have become ever more prevalent in American courtrooms. Consequently, the issue of when the usual rules of medical ethics should apply to forensic psychiatric encounters has taken on increased importance and is a continuing topic of discussion among both legal and medical scholars. A number of approaches to the problem of forensic psychiatric ethics have been proposed, but none adequately addresses the issues that arise when a forensic encounter develops therapeutic characteristics. This article looks to the rules governing the lawyer-client relationship as a model for a new approach to forensic psychiatric ethics. This new model …

Contracts And Automation: Exploring The Normativity Of Automation In The Context Of U.S. Contract Law And E.U. Consumer Protection Directives, Daniel Barnhizer
Yearbook of Antitrust and Regulatory Studies
Given a choice between two systems of contract rules, a court or legislature may have a normative obligation to adopt the rule that is more susceptible to coding and automation. This paper explores the ramifications of that normative proposition through the lens of multiple contract doctrines that traditionally involve “messy” judgments or multiple interacting judgments regarding which human beings are – arguably – capable of making finely nuanced analyses. Using the common law doctrine of unconscionability and Polish Civil Code Article 385 on unfair terms in consumer contracts, this paper explores the differences between contract rules that require human analysis …

For more than a decade, an innovative clinic at DePaul has offered advice to students through the Croak Student Legal Services (CSLS) program. Now, an endowment campaign in honor of the clinic’s founding director, the Rev. Thomas Croak, C.M. (JD ’91), has raised more than $130,000 from Chicago law firms and attorneys to ensure that the program can serve students for years to come.

While affordable housing is the foundation of neighborhood revitalization, retail commercial development is also a pressing development issue facing urban legacy city neighborhoods. Retail opportunity in urban legacy city neighborhoods has been decimated over many years as population has declined, and competing commercial centers have blossomed. And yet, retail commercial development holds opportunities for local community resident investment and entrepreneurship, training of youth and others in entry-level jobs, and creation of vibrant opportunities for resident and business interaction.

A Long And Pricey Road To Freedom For New York's Aging Prisoners, Khorri Atkinson

This character-driven capstone examines the impact New York’s growing aging inmates – defined as those over 50 – have on the criminal justice system.
The stories of those who are in and have been through the system, suggest that reform effort is still dragging slowly. The sentencing policies and healthcare costs continue to have lasting consequences for inmates, their relatives and taxpayers. And early release programs, such as commutation, pardon and parole, also tend to shy away from people serving decades in prison for violent crimes because of the lingering tough-on-crime era.

Residents across New York City—particularly those living in rent-stabilized or rent-controlled apartments—are subject to concerted, persistent harassment at the hands of landlords determined to replace them with higher-rent paying tenants or tenants who will remain compliant in response to the landlords’ negligence or illegal actions. Although tenant harassment is illegal in New York City, the laws and penalties of New York City Housing Court have proven to be an ineffective system for tenants and insufficient deterrent against landlords who stand to make significant financial gains from deregulating apartments and who often get slapped with little to no fines for their …

Increasingly, lawyers and decision-makers are recognizing the limitations and consequences of current approaches to attorney regulation. Inspired by developments in other countries, regulators in the United States and Canada have started the process of exploring innovative approaches, including proactive management-based regulation. The term, proactive-management regulation (PMBR), was first used by Professor Ted Schneyer to refer to a regulatory approach designed to promote ethical law practice by assisting lawyers with practice management.
The seed for PMBR was first planted in the Australian state of New South Wales (NSW). It grew out of the legislation that allowed limited liability and non-lawyer ownership …

New York City’S Affordable Housing Lottery: Inconsistent Screening Methods And Lack Of Government Oversight, Donna M. Airoldi

New York City offers substantial tax credits and subsidies to developers to entice them to include affordable housing units in their projects. The city oversees the random assigning of numbers for the affordable housing lottery through its online system, Housing Connect, but it cedes oversight of the process to developers and third-party managers — known as marketing agents — who use inconsistent and unclear screening measures when selecting applicants for buildings, sometimes rejecting those who actually qualify for these high-demand apartments. This article shows through examples of individual applicants how confusing the rules can be.

Forty years after New York City began to "deinstitutionalize" its mental health system in hopes of building community-based care, the city is still falling short. This investigative project, undertaken by six reporters at CUNY's Graduate School of Journalism, uncovers the treatment gaps facing mentally ill New Yorkers, who are among the most vulnerable in the city. The project follows them to the actual places where they seek care: hospitals, clinics, homeless shelters, prisons and schools.

Local governments typically insure themselves against all kinds of losses, from property damage to legal liability. For small- and medium-sized governments, this usually means purchasing insurance from private insurers or participating in municipal risk pools. Insurance for regulatory takings claims, however, is generally unavailable. This previously unnoticed gap in municipal insurance coverage could lead risk averse local governments to underregulate and underenforce existing regulations where property owners threaten to bring takings claims. This seemingly technical observation turns out to have profound implications for theoretical accounts of the Takings Clause that focus on government regulatory incentives.
