Application Of Logistic Regression To Detect The Fraudulent Financial Statements, Marek Sylwestrzak Dec 2016

Application Of Logistic Regression To Detect The Fraudulent Financial Statements, Marek Sylwestrzak

European Management Studies

This paper aims to detect the financial statements fraud based on the financial data of the US companies accused by the US Securities and Exchange Commission of manipulating financial statements under rule 10(b)-5 of the Securities Exchange Act in 2000–2007. Particular attention was paid to the use of logistic regression in the empirical literature for the detection of creative accounting. Based on empirical articles we selected thirteen financial ratios and two models predicting bankruptcy aimed at verifying the research hypotheses. In addition, we tested collinearity and equality of central tendencies between companies that falsify and do not falsify financial statements. …

A Cost Of Doing Business: Defense Contracting Fraud, Shane M. English Dec 2016

A Cost Of Doing Business: Defense Contracting Fraud, Shane M. English

Capstones

The federal government relies heavily on outside contractors to provide essential research and services. Following World War II, the Department of Defense and the military began to rely on approved government contractors to develop, test and improve weapons and tools used to keep soldiers and the nation safe.

Defense contracting is a massive business that commands billions of dollars a year. Despite the magnitude of the United States' contracting system, detecting fraud and preventing bad actors from continuing to profit off of the government has proven difficult. The systems at hand: civil and criminal charges, suspension and debarment have consistently …

Fraud Detections For Online Businesses: A Perspective From Blockchain Technology, Yuanfeng Cai, Dan Zhu

Publications and Research

Background: The reputation system has been designed as an effective mechanism to reduce risks associated with online shopping for customers. However, it is vulnerable to rating fraud. Some raters may inject unfairly high or low ratings to the system so as to promote their own products or demote their competitors.

Method: This study explores the rating fraud by differentiating the subjective fraud from objective fraud. Then it discusses the effectiveness of blockchain technology in objective fraud and its limitation in subjective fraud, especially the rating fraud. Lastly, it systematically analyzes the robustness of blockchain-based reputation systems in each type of …

Cheating In Online Courses For Financial Aid Fraud In The U.S., Robert S. Owen Dec 2016

Cheating In Online Courses For Financial Aid Fraud In The U.S., Robert S. Owen

Administrative Issues Journal

This manuscript reviews issues that differentiate traditional academic cheating from course misconduct that is motivated by a desire to defraud financial aid services in the U.S. Past research on college student cheating has assumed that cheaters are driven by an incentive to obtain undeserved grades in college in order to ultimately obtain a degree. However, researchers on academic dishonesty, professors, and college administrators might not realize that online class members can include virtual "straw" students who are puppets of a financial aid fraud ring leader. Cheating behaviors of straw students differ from cheating behaviors of actual, legitimate students. This has …

Detecting Fraud In Public Procurement, Yajun Wang

Stony Brook Theses and Dissertations Collection, 2006-2020 (closed to submissions)

Fraud in public procurement is a big problem in public sector all over the world, and is very difficult to detect in empirical studies. Common fraud schemes include corruption, collusive bidding, failure to provide the required quality, and false statements, etc. In this paper, I employed game theory, machine learning, and statistical methods to detect fraud risk in Federal Procurement Contract Data, and studied the relationship of fraud, competition and contract types. In the first section, I studied a procurement game and found that if the firms' types are close enough to each other, their strategies regarding whether or not …

A Reduced Labeled Samples (Rls) Framework For Classification Of Imbalanced Concept-Drifting Streaming Data., Elaheh Arabmakki

Electronic Theses and Dissertations

Stream processing frameworks are designed to process the streaming data that arrives in time. An example of such data is stream of emails that a user receives every day. Most of the real world data streams are also imbalanced as is in the stream of emails, which contains few spam emails compared to a lot of legitimate emails. The classification of the imbalanced data stream is challenging due to the several reasons: First of all, data streams are huge and they can not be stored in the memory for one time processing. Second, if the data is imbalanced, the accuracy …

Fair Or Foul?: Sec Administrative Proceedings And Prospects For Reform Through Removal Legislation, Joseph A. Grundfest Dec 2016

Fair Or Foul?: Sec Administrative Proceedings And Prospects For Reform Through Removal Legislation, Joseph A. Grundfest

Fordham Law Review

This Article catalogues the long list of criticisms of the Commission’s administrative proceedings. It also evaluates data describing the outcome of litigated matters and finds that, with the exception of insider trading cases, the Commission has an exceptionally high and statistically indistinguishable record of success in administrative and federal court proceedings alike. The data thus seem not to support the view that the Commission has a generalized home-court advantage in administrative proceedings. Nonetheless, the Commission’s virtually unfettered discretion in forum selection decisions, when it can assign cases to a forum that it controls, raises a plethora of institutional design concerns.

The Roberts Court And The New Textualism, Anton Metlitsky Dec 2016

The Roberts Court And The New Textualism, Anton Metlitsky

Cardozo Law Review

The article explores the Roberts Court's approach to statutory interpretation, focusing on its adherence to the "new textualism," a methodology emphasizing the plain meaning of statutory text. While recent cases like King v. Burwell, Bond v. United States, and Yates v. United States appear to prioritize statutory purpose over textual meaning, the Court's reasoning reinforces its commitment to textualism by framing decisions within textualist methodology, even when outcomes seem to depart from strict textual interpretation.

Audit Committees And Financial Reporting Quality In Singapore, Yuanto Kusnadi, Kwong Sin Leong, Themin Suwardy, Jiwei Wang Nov 2016

Audit Committees And Financial Reporting Quality In Singapore, Yuanto Kusnadi, Kwong Sin Leong, Themin Suwardy, Jiwei Wang

Research Collection School Of Accountancy

We examine three characteristics (independence, expertise, and overlapping membership) of audit committees and their impact on the financial reporting quality for Singapore-listed companies. The main finding is that financial reporting quality will be higher if audit committees have mixed expertise in accounting, finance, and/or supervisory. In addition, we do not find evidence that incremental independence of audit committees enhances financial reporting quality because audit committees already consist of a majority of independent directors. Finally, we fail to find any impact of overlapping membership on audit and remuneration committees on financial reporting quality. Overall, the results have policy implications on improving …

Paper Session Ii: Computer Forensics Field Triage Process Model, Marcus K. Rogers, James Goldman, Rick Mislan, Timothy Wedge, Steve Debrota

Annual ADFSL Conference on Digital Forensics, Security and Law

With the proliferation of digital based evidence, the need for the timely identification, analysis and interpretation of digital evidence is becoming more crucial. In many investigations critical information is required while at the scene or within a short period of time - measured in hours as opposed to days. The traditional cyber forensics approach of seizing a system(s)/media, transporting it to the lab, making a forensic image(s), and then searching the entire system for potential evidence, is no longer appropriate in some circumstances. In cases such as child abductions, pedophiles, missing or exploited persons, time is of the essence. In …

Designing A Data Warehouse For Cyber Crimes, Il-Yeol Song, John D. Maguire, Ki Jung Lee, Namyoun Choi, Xiaohua Hu, Peter Chen

Annual ADFSL Conference on Digital Forensics, Security and Law

One of the greatest challenges facing modern society is the rising tide of cyber crimes. These crimes, since they rarely fit the model of conventional crimes, are difficult to investigate, hard to analyze, and difficult to prosecute. Collecting data in a unified framework is a mandatory step that will assist the investigator in sorting through the mountains of data. In this paper, we explore designing a dimensional model for a data warehouse that can be used in analyzing cyber crime data. We also present some interesting queries and the types of cyber crime analyses that can be performed based on …

Towards A Model Of Senior Citizens’ Motivation To Pursue Cybersecurity Awareness Training: Lecture-Based Vs. Video-Cases Training, Carlene G. Blackwood-Brown

KSU Proceedings on Cybersecurity Education, Research and Practice

Cyber-attacks on Internet users, and in particular senior citizens, who have limited awareness of cybersecurity, have caused billions of dollars in losses annually. To mitigate the effects of cyber-attacks, several researchers have recommended that the cybersecurity awareness levels of Internet users be increased. Cybersecurity awareness training programs are most effective when they involve training that focus on making users more aware so that they can identify cyber-attacks as well as mitigate the effects of the cyber-attacks when they use the Internet. However, it is unclear about what motivates Internet users to pursue cybersecurity awareness training so that they can identify …

Compensation's Role In Deterrence, Russell M. Gold Oct 2016

Compensation's Role In Deterrence, Russell M. Gold

Notre Dame Law Review

There are plenty of noneconomic reasons to care whether victims are compensated in class actions. The traditional law-and-economics view, however, is that when individual claim values are small, there is no reason to care whether victims are compensated. Rather than compensation deterring wrongdoing is tort law’s primary economic objective. And on this score, law-and-economics scholars contend that only the aggregate amount of money that a defendant expects to pay affects deterrence. They say that it does not matter for deterrence purposes how that money is split between victims, lawyers, and charities. This Article challenges that claim about achieving tort law’s …

Word Power: The Impact Of Negative Media Coverage On Disciplining Corporate Pollution, Ming Jia, Li Tong,, P. V. Viswanath, Zhe Zhang

Research Collection Lee Kong Chian School Of Business

Sequences of individual words make up media reports. And sequences of media reports constitute the power of the news media to influence corporate practices. In this paper, we focus on the micro-foundations of news reports to elaborate how an atmosphere of negative news reports following an initial exposure of corporate pollution activity can help stop such activity through their impact on corporate managers. We extend our understanding of the corporate governance effect of news media by considering two new aspects of reports—one, the proportion of words in negative reports relative to the total number of words in all reports; and …

The Price Contagion Effects Of Financial Reporting Fraud And Reputational Losses: Evidence From The Individual Audit Partner Level, Ferdinand A. Gul, Chee Yeow Lim, Kun Wang, Yanping Xu

Research Collection School Of Accountancy

This study investigates the existence of price contagion effects for the low-quality audits of individual audit partners and the associated reputational losses in China. Low-quality partners are identified as those whose clients have been sanctioned by regulators for financial reporting fraud. Our evidence shows that sanctions induce a significant stock price decline among the contagion firms that share common low-quality partners and common low-quality audit firms; however, the decline is greater for the former. We also find that the price contagion effects of low-quality partners are more pronounced for firms located in regions with weak institutional development and less pronounced …

Consumers’ Obsession Becoming Retailers’ Possession: The Way That Retailers Are Benefiting From Consumers’ Presence On Social Media, Vivian Adame Oct 2016

Consumers’ Obsession Becoming Retailers’ Possession: The Way That Retailers Are Benefiting From Consumers’ Presence On Social Media, Vivian Adame

San Diego Law Review

Retailers can profit from consumers’ social media presence in two ways: (1) through inadequate privacy laws; and (2) through retailers’ reposting of consumers intellectual property uploaded to social media sites. The California Legislature passed the Online Privacy Protection Act (CalOPPA), which moved towards protecting the privacy rights of consumers. However, the Legislature’s inability to hold retailers accountable under CalOPPA leaves consumers susceptible to the invasive technologies retailers use to collect social media users’ information, which they in turn sell and profit from. To better protect consumers on social media, the legislature should first enact a privacy law restricting retailers’ and …

$22 Trillion Lost, Zero Wall Street Executives Jailed: Prosecutors Should Utilize Whistleblowers To Establish Criminal Intent, Joseph L. Zales

Notre Dame Journal of International & Comparative Law

The Financial Crisis, which began in the United States on Wall Street in the fall of 2008, cost the global economy trillions of dollars, caused millions of people to lose their jobs, homes, life and retirement savings, and resulted in the collapse or taxpayer-funded government bailout of several century-old, storied financial institutions. Irresponsible risk-taking, fraudulent mortgage and lending practices, and misrepresentations around increasingly complex products are among the many theories that have been put forth as to what caused the Financial Crisis. Importantly, there are numerous state and federal statutes on the books prohibiting and criminalizing such activity. To put …

Reassessing Board Member Allegiance: Ceo Replacement Following Financial Misconduct, David M. Gomulya, Warren Boeker Sep 2016

Reassessing Board Member Allegiance: Ceo Replacement Following Financial Misconduct, David M. Gomulya, Warren Boeker

Research Collection Lee Kong Chian School Of Business

Research summary: We examine how board members' reactions following financial misconduct differ from those following other adverse organizational events, such as poor performance. We hypothesize that inside directors and directors appointed by the CEO may be particularly concerned about their reputation following deceptive financial practices. We demonstrate that directors more closely affiliated with the CEO are more likely to reduce their support for the CEO following financial misconduct, increasing the likelihood of CEO replacement. Enactment of the Sarbanes-Oxley Act similarly alters governance dynamics by creating a greater expectation for sound corporate governance. We demonstrate our findings in U.S. public firms …

Market Failure And Reemergence: A Study Of Chinese Firms Listed In The Us., Hai Lu, Hai Lu, Wei Luo

Research Collection School Of Accountancy

Our study documents a “Lemons” market failure of Chinese firms listed in the US in 2011 and a subsequent rebound by 2013. Our tests reveal that there was little difference in ex ante observable characteristics of fraudulent and non-fraudulent Chinese firms listed in the US prior to 2011 while entrepreneurs appear to have known their type. We document substantial costs of dishonesty and the failure of traditional market signaling mechanisms such as auditor or underwriter quality. We also show a return of Chinese firms after US and Chinese regulatory intervention in 2013 although this intervention was insufficient to fundamentally change …
