Human Rights Pragmatism And Human Dignity, David Luban Dec 2013

Human Rights Pragmatism And Human Dignity, David Luban

Georgetown Law Faculty Publications and Other Works

Human rights sound a lot like moral rights: rights that we have because we are human. Many philosophers think it follows that the list of international human rights must therefore be founded on some philosophical account of moral rights or of human dignity. More recently, other philosophers have rejected this foundationalist picture of international human rights (“foundationalist” meaning that moral rights are the foundation of international human rights). These critics argue that international human rights need no philosophical foundation; instead, we should look to the actual practices of human rights: the practices of international institutions, tribunals, NGOs, monitors, and activists. …

It provides basic needs and critical services in one day at one location. It originated in San Francisco and was later adopted and revised by the U.S. Interagency Council on Homelessness (USICH) to decrease homelessness in major American cities (Knetch & Martinez, 2009). A Solution Hiding In Plain Sight: Special Education And Better Outcomes For Students With Social, Emotional, And Behavioral Challenges, Yael Cannon, Michael J. Gregory, Julie Waterstone Dec 2013

A Solution Hiding In Plain Sight: Special Education And Better Outcomes For Students With Social, Emotional, And Behavioral Challenges, Yael Cannon, Michael J. Gregory, Julie Waterstone

Faculty Scholarship

This Article will contribute to the ongoing dialogue about special education and the IDEA in two ways. First, it will describe patterns that have emerged from our work with individual children and families that shed light on how common IDEA implementation failures increase the risk of poor outcomes for students with social, emotional and behavioral challenges. Critiques of the law and proposals to amend it should be grounded in an understanding of exactly how and why it is falling short of meeting its promise to these children. Our hope is that mapping the common implementation failures we have seen in …

The Role Of Multicultural Planning In Rural Nebraska, Case Studies Of Four Mid-Sized Cities, Pakiza Shirinova Dec 2013

The Role Of Multicultural Planning In Rural Nebraska, Case Studies Of Four Mid-Sized Cities, Pakiza Shirinova

Community and Regional Planning Program: Theses

The purpose of this study is to analyze multicultural planning practices in rural Nebraska towns. Due to the increased influx of Hispanic population in Schuyler, Lexington, South Sioux City and Crete of Nebraska in the period from 1990 to 2010, this research focuses on uncovering social and economic impacts that Hispanic immigration is leaving on receiving communities. Also, this study reviews current comprehensive plans of the communities selected for this research to determine whether multicultural policies are being defined and incorporated into the vision of community development. A survey of planning consultants, city administrators and community members further contribute to …

Fighting For Success : The Use Of Resources By Ngos In The Anti-Human Trafficking Social Movement., Lisa Stapleton 1978-

Electronic Theses and Dissertations

This thesis is an archival document analysis that will illustrate the importance of effective use of resources on the overall success of an anti-human trafficking organization. While there are multiple studies on resource mobilization and movements in general, little work has emerged regarding successful mobilization strategies in the anti-human trafficking movement. With my research, I pay particular attention to two groups and consider how their interactions with various resources influence their success. Comparing a more successful organization to a less successful organization provides the best assessment of a social movement and the process by which it meets its objectives. Results …

Cases And Controversies: Some Things To Do With Contracts Cases, Charles L. Knapp Dec 2013

Cases And Controversies: Some Things To Do With Contracts Cases, Charles L. Knapp

Washington Law Review

As a co-author of one of the two dozen or more currently-in-print Contracts casebooks, I obviously have both a point of view about, and a personal stake in, the survival of this particular method of instruction. Whether the legal casebook—or any other book, in the form of bound sheets of paper—will remain a part of our academic culture much longer is clearly up for grabs, however. Electronic records have so many advantages over the printed page that, at least for many purposes, they will surely become the dominant form of preserving, retrieving, and transmitting information, if indeed they are not …

Contract Stories: Importance Of The Contextual Approach To Law, Larry A. Dimatteo Dec 2013

Contract Stories: Importance Of The Contextual Approach To Law, Larry A. Dimatteo

Washington Law Review

How law is taught is at the center of the debate over the need to change legal education to better prepare students for a difficult and changing marketplace for legal services. This Article analyzes the benefits of using “stories” to teach law. The stories to be discussed relate to contract law: this Article asks whether they can be used to improve the method and content of teaching law. The ruminations offered on teaching contract law, however, are also relevant to teaching other core, first-year law courses.

Reproductive Injustice In The New Millennium, Sybil Shainwald Dec 2013

Reproductive Injustice In The New Millennium, Sybil Shainwald

William & Mary Journal of Race, Gender, and Social Justice

A reexamination of the history of abortion law in the United States is essential to an understanding of recent changes. Part I of this Article will provide a synopsis of the early Anglo-American view of abortion at common law, the early anti-abortion statutes, and the state of abortion during the early twentieth century. Part II will discuss the liberalization of abortion laws, as well as the ways in which the law pertaining to a woman’s right to choose has evolved since 1973. Finally, Part III will analyze the constitutionality of the current wave of restrictions.
