Jurisdiction In Nineteenth Century International Law And Its Meaning In The Citizenship Clause Of The Fourteenth Amendment, Robert E. Mensel

Saint Louis University Public Law Review

This article addresses the meaning of the citizenship clauses of the Civil Rights Act of 1866 and the Fourteenth Amendment by augmenting the historical record relevant to those clauses. It argues that the key to understanding their meaning lies in the nineteenth century concept of allegiance, the central concept in the international law of citizenship and subjecthood in the nineteenth century. International law, diplomatic history, and international conflict centered around that concept, reveal complexities not fully explored in the previous scholarly literature on the citizenship clauses. Rural residents in communities face opportunities and obstaclesfor physical activity (PA), health, and wellbeing that differ from those experienced in non-rural settings. Yet, rural people’s interpretations of PA and experience of the PA environment are understudied. This study utilized a descriptive case study approach in three rural New Hampshire communities and engaged rural residents in community participatory action research of the experiential factors that enable or prevent PA for adults and youth in their communities. Qualitative data were collected using photo mapping surveys, participant observations, interviews, and focus groups, analyzed using a constant comparative method, and triangulated across multiple sources. …

In her article "Forgács's Film and Installation Dunai exodus (Danube Exodus)" Zsófia Bán analyzes film maker and video artist Péter Forgács's film The Danube Exodus (1998) and compares it with the installation Dunai exodus. A folyó beszédes áramlatai (Rippling: Currents of the River) (2002). Combined with additional materials, the two works are based on footage by ship captain Nándor Andrásovits documenting two successive journeys of forced displacement aboard his vessel, the Queen Elizabeth. In 2005 a Greek and American interdisciplinary team investigated two ship wrecks off the coast of Chios dating to the 4th-century B.C. and the 2nd/lst century. The project pioneered archaeological methods of precision acoustic, digital image, and chemical survey using an autonomous underwater vehicle (AUV) and in-situ sensors, increasing the speed of data acquisition while decreasing costs. The AUV recorded data revealing the physical dimensions, age, cargo, and preservation of the wrecks. The earlier wreck contained more than 350 amphoras, predominantly of Chian type, while the Hellenistic wreck contained about 40 Dressel 1C amphoras. Molecular biological analysis of two amphoras …

The Upper South River Special Regulation Area (SRA) is a fishery in Augusta County, Virginia that opened as a trout fishery in January 2011. There is a need to estimate the economic impact of the fishery on the local community in order to find the value of the fishery. The economic value of the fishery is important because of its implications in the management practices as well as funding for future restoration and conservation projects. This paper argues that game theory provides powerful, effective new tools to analyze externalities that occur in the context of strategic, multi-party, interactive decision-making. I will attempt to treat this as a non-technical paper and avoid the complex mathematics better left to economists and mathematicians. Instead, a more achievable goal is to illustrate how high-seas open-access fishing is virtually identical to a game situation, treat the fundamentals of game theory, and demonstrate that game theoretic analyses are well-suited and fruitful for designing effective policy responses to fisheries management, particularly with respect to the straddling stocks problem. This article examines recent steps taken by Australia and France to combat illegal fishing in their claimed maritime zones of jurisdiction around their adjacent sub-Antarctic island territories. These steps comprise operational responses and legal developments, including the conclusion of two bilateral treaties on cooperative surveillance and enforcement. Geographical and legal problems associated with addressing the illegal fishing threat in the Southern Ocean are highlighted. Our world is changing more than many individuals could imagine. Climate change is not a hoax. Comprehensive empirical records of changes since 1900 in local, regional, and global temperature clearly indicate that Earth is warming more rapidly than ever in recorded history. In response, some bird species are already shifting, both phenologically (timing) and geographically. However, the majority of birds are not shifting or not shifting fast enough, and this is resulting in population declines. A much smaller number of studies suggest that mammals are also shifting phenologically and geographically.

Currently, there are no copyright protections for fashion designs in the United States. Proposed legislation that would provide such protection has been sitting in Congress for two years. Further, the Lanham Trademark Act only protects the origin of products, such as logos and trademarks. Even with the current available trademark protection, fashion houses, such as Louis Vuitton, and luxury jewelry firms, such as Tiffany & Company, have seen the Second Circuit make it more difficult to assert the protection. Purpose: To critically examine public and corporate governance failures that we argue predisposed the BP oil spill in the Gulf of Mexico, the worst environmental disaster in United States (US) history. Design/methodology/approach: A critical examination of publicly available documentation to identify systemic governance flaws of a marketized government agency and BP’s self-regulated corporate governance. Findings: The spill was overseen by the US Federal Government agency, Minerals Management Service (MMS). Restructured by the Reagan Administration to mimic business, the MMS regulated and collected revenue from offshore oil leases, a conflict of interest that compromised this public agency’s integrity. Biological invasions are a pervasive global change that threatens biodiversity and the functioning of natural ecosystems, yet most studies focus on population impacts. Furthermore, the effects of invasive species on ecosystems are greatest when they introduce a novel disturbance. In this dissertation I reviewed the impact of wild boar (Sus scrofa) on native communities worldwide, identifying research needs. Wild boar overturns extensive areas of vegetation to feed on belowground plant parts, insects and fungi, thus altering native ecosystems integrity. Although they are two very similar net immigration countries, Australia and the US took very different approaches to immigration policy adoption and implementation and to immigration control, in the last two decades of the 20th century. In 2009 five avatar-themed films were released, one of which became the highest grossing film to date, signaling that in addition to their popularity in videogames and virtual worlds, avatars are culturally salient figures which demand scholarly attention. Avatars, virtual environments, and user behavior have evolved significantly since virtual reality captured public and academic attention at the close of the twentieth century, and this dissertation is an attempt to theorize the avatar in contemporary digital culture. This Essay explores relationships between custom and law in the United States in the context of markets for art objects. The Essay argues that these relationships are dynamic, not static, and that law can prompt evolution in customary practice well beyond the law's formal requirements.
