Jurisdiction In Nineteenth Century International Law And Its Meaning In The Citizenship Clause Of The Fourteenth Amendment, Robert E. Mensel
Jurisdiction In Nineteenth Century International Law And Its Meaning In The Citizenship Clause Of The Fourteenth Amendment, Robert E. Mensel
Saint Louis University Public Law Review
This article addresses the meaning of the citizenship clauses of the Civil Rights Act of 1866 and the Fourteenth Amendment by augmenting the historical record relevant to those clauses. It argues that the key to understanding their meaning lies in the nineteenth century concept of allegiance, the central concept in the international law of citizenship and subjecthood in the nineteenth century. International law, diplomatic history, and international conflict centered around that concept, reveal complexities not fully explored in the previous scholarly literature on the citizenship clauses. Conflicting national claims to the allegiance of subjects and citizens and to the duties …
Partnering To Enable Active Rural Living: Pearl Project, Deborah H. John, Barbara Mccahan, Suzanne Gaulocher
Partnering To Enable Active Rural Living: Pearl Project, Deborah H. John, Barbara Mccahan, Suzanne Gaulocher
Journal of Rural Social Sciences
Rural residents in communities face opportunities and obstaclesfor physical activity (PA), health, and wellbeing that differ from those experienced in non-rural settings. Yet, rural people’s interpretations of PA and experience of the PA environment are understudied. This study utilized a descriptive case study approach in three rural New Hampshire communities and engaged rural residents in community participatory action research of the experiential factors that enable or prevent PA for adults and youth in their communities. Qualitative data were collected using photo mapping surveys, participant observations, interviews, and focus groups, analyzed using a constant comparative method, and triangulated across multiple sources. …

Forgács's Film And Installation Dunai Exodus (Danube Exodus), Zsófia Bán
CLCWeb: Comparative Literature and Culture
In her article "Forgács's Film and Installation Dunai exodus (Danube Exodus)" Zsófia Bán analyzes film maker and video artist Péter Forgács's film The Danube Exodus (1998) and compares it with the installation Dunai exodus. A folyó beszédes áramlatai (Rippling: Currents of the River) (2002). Combined with additional materials, the two works are based on footage by ship captain Nándor Andrásovits documenting two successive journeys of forced displacement aboard his vessel, the Queen Elizabeth. Bán's analysis includes the 1939 event of the Jewish exodus from Slovakia to the Black Sea with the eventual goal of reaching Palestine followed by …

Christopher N. Roman
In 2005 a Greek and American interdisciplinary team investigated two ship wrecks off the coast of Chios dating to the 4th-century B.C. and the 2nd/lst century. The project pioneered archaeological methods of precision acoustic, digital image, and chemical survey using an autonomous underwater vehicle (AUV) and in-situ sensors, increasing the speed of data acquisition while decreasing costs. The AUV recorded data revealing the physical dimensions, age, cargo, and preservation of the wrecks. The earlier wreck contained more than 350 amphoras, predominantly of Chian type, while the Hellenistic wreck contained about 40 Dressel 1C amphoras. Molecular biological analysis of two amphoras …

The Threat To The U.S. 7th Fleet By The Chinese, Mohammed Lamrani
Masters Theses, 2010-2019
This research identifies key sciences and technologies that are possessed or sought after by the People’s Liberation Army Navy (PLAN). An overview of Chinese naval history is presented to better understand the possible reasons for China’s expansion to the South China Sea. By looking at Chinese official news reports as well as statements by Chinese military and other high ranking officials, a Chinese perspective is developed. Types of defense purchases, spending, and military espionage are evaluated to reflect the new-found capabilities and current technologies of interest for the Chinese Armed Forces. The threat to the US 7th fleet is increasing …
Economic Analysis Of The Upper South River Special Regulation Area In Augusta County, Virginia, Brian Rapp
Economic Analysis Of The Upper South River Special Regulation Area In Augusta County, Virginia, Brian Rapp
Masters Theses, 2010-2019
The Upper South River Special Regulation Area (SRA) is a fishery in Augusta County, Virginia that opened as a trout fishery in January 2011. There is a need to estimate the economic impact of the fishery on the local community in order to find the value of the fishery. The economic value of the fishery is important because of its implications in the management practices as well as funding for future restoration and conservation projects. In this study, the economic impact was estimated to be $78,181 from January 2011 through June 2012. This was calculated based on prior surveys and …

Oil, Power, And Discourse: How Chevron Evaded Its Dues To The Indigenous Communities Of The Ecuadorian Amazon, Kine Norland
Oil, Power, And Discourse: How Chevron Evaded Its Dues To The Indigenous Communities Of The Ecuadorian Amazon, Kine Norland
Master's Theses
Abstract
The principal objectives of this thesis were to shed lights on the backside of oil and to question the great power of big corporations. I researched why Chevron refused to acknowledge its legal obligation to remedy the complex problems it has caused in the Ecuadorian Rainforest. The catastrophes the indigenous communities have been facing are about to change as a result of grass root mobilization against Chevron. By the use of observations, discourse analysis of the media, and the use of theories from Michel Foucault, I was able to explain how Chevron has managed to escape from the terrible …
The Atlantic Bluefin Tuna: A Public Policy Approach To Saving An Iconic Species, Timothy Patrick O'Brien
The Atlantic Bluefin Tuna: A Public Policy Approach To Saving An Iconic Species, Timothy Patrick O'Brien
Theses and Dissertations
The Atlantic Bluefin Tuna (Thunnus thynnus) is perhaps the most magnificent and most marvelous nomadic wild animal living in the world. It lives in the deep blue waters of the Atlantic Ocean and is one of the largest of the world’s fin fish and the largest of the 48 other species of tuna (Kuhn, 1996). It is a species that seems to have been designed and sculpted by an artist—sleek, smooth, and beautiful—instead of having been a product of an evolutionary process. Today, the existence and future of the Atlantic Bluefin Tuna is in question because of the constant overexploitation …

Gaming The System: Bio-Economics, Game Theory, & Fisheries Management, Richard A. Grisel
Gaming The System: Bio-Economics, Game Theory, & Fisheries Management, Richard A. Grisel
Richard A Grisel
This paper argues that game theory provides powerful, effective new tools to analyze externalities that occur in the context of strategic, multi-party, interactive decision-making. I will attempt to treat this as a non-technical paper and avoid the complex mathematics better left to economists and mathematicians. Instead, a more achievable goal is to illustrate how high-seas open-access fishing is virtually identical to a game situation, treat the fundamentals of game theory, and demonstrate that game theoretic analyses are well-suited and fruitful for designing effective policy responses to fisheries management, particularly with respect to the straddling stocks problem. Indeed, one seminal fisheries …

Pushing The Limits Of The Law Of The Sea Convention: Australian And French Cooperative Surveillance And Enforcement In The Southern Ocean, Warwick Gullett, Clive Schofield
Pushing The Limits Of The Law Of The Sea Convention: Australian And French Cooperative Surveillance And Enforcement In The Southern Ocean, Warwick Gullett, Clive Schofield
Warwick Gullett
This article examines recent steps taken by Australia and France to combat illegal fishing in their claimed maritime zones of jurisdiction around their adjacent sub-Antarctic island territories. These steps comprise operational responses and legal developments, including the conclusion of two bilateral treaties on cooperative surveillance and enforcement. Geographical and legal problems associated with addressing the illegal fishing threat in the Southern Ocean are highlighted. It is concluded that when they come to be tested by international legal authorities, some of the more innovative legal measures under discussion are likely to be appraised as being in conflict with some provisions of …

Australia's Maritime Challenges And Priorities: Recent Developments And Future Prospects, Robin M. Warner
Robin Warner
Australia, witb its lengthy coastline, vast maritime jurisdiction and multiple offshore territories, undoubtedly fits the description of a maritime nation: but it was not until the issue of Australia's Oceans Policy in 1998 Ihat a comprehensive statement of Australia's maritime challenges and priorities emerged at the Federal Government level. The Oceans Policy arliculated a diverse array of challenges and priorities relating to Australia's maritime interests, including the conservation of marine biological diversity, the maintenance of ecologically sustainable fisheries, the prevention of marine pollution, the development of lhe offshore petroleum and minerals industry, the definition or Australia's maritime juridiction and the …

The Effects Of Climate Change And Overexploitation On Birds And Mammals: Phenological Shifts, Range Shifts, And Population Changes, Rachel Denny
Honors Theses
Our world is changing more than many individuals could imagine. Climate change is not a hoax. Comprehensive empirical records of changes since 1900 in local, regional, and global temperature clearly indicate that Earth is warming more rapidly than ever in recorded history. In response, some bird species are already shifting, both phenologically (timing) and geographically. However, the majority of birds are not shifting or not shifting fast enough, and this is resulting in population declines. A much smaller number of studies suggest that mammals are also shifting phenologically and geographically.
If we do not alter our current behaviors soon, Earth …

The Look For Less: A Survey Of Intellectual Property Protections In The Fashion Industry, Nicole Giambarrese
The Look For Less: A Survey Of Intellectual Property Protections In The Fashion Industry, Nicole Giambarrese
Touro Law Review
Currently, there are no copyright protections for fashion designs in the United States. Proposed legislation that would provide such protection has been sitting in Congress for two years. Further, the Lanham Trademark Act only protects the origin of products, such as logos and trademarks. Even with the current available trademark protection, fashion houses, such as Louis Vuitton, and luxury jewelry firms, such as Tiffany & Company, have seen the Second Circuit make it more difficult to assert the protection. This increasing difficulty is due to a fear of overextending monopolies and taking an affirmative stance on who has the burden …

The Bp Gulf Oil Spill: Public And Corporate Governance Failures, Carolyn Windsor, Patty Mcnicholas
11th Australasian Centre for Social and Environmental Accounting Research (A-CSEAR) Conference
Purpose: To critically examine public and corporate governance failures that we argue predisposed the BP oil spill in the Gulf of Mexico, the worst environmental disaster in United States (US) history. Design/methodology/approach: A critical examination of publicly available documentation to identify systemic governance flaws of a marketized government agency and BP’s self-regulated corporate governance. Findings: The spill was overseen by the US Federal Government agency, Minerals Management Service (MMS). Restructured by the Reagan Administration to mimic business, the MMS regulated and collected revenue from offshore oil leases, a conflict of interest that compromised this public agency’s integrity. Neo-classical economics and …

Multi-Level Impacts Of Introduced Wild Boar On Patagonian Ecosystems, Maria Noelia Barrios Garcia Moar
Multi-Level Impacts Of Introduced Wild Boar On Patagonian Ecosystems, Maria Noelia Barrios Garcia Moar
Doctoral Dissertations
Biological invasions are a pervasive global change that threatens biodiversity and the functioning of natural ecosystems, yet most studies focus on population impacts. Furthermore, the effects of invasive species on ecosystems are greatest when they introduce a novel disturbance. In this dissertation I reviewed the impact of wild boar (Sus scrofa) on native communities worldwide, identifying research needs. Wild boar overturns extensive areas of vegetation to feed on belowground plant parts, insects and fungi, thus altering native ecosystems integrity. By means of observational and experimental studies I addressed some of the research gaps on the impact of wild …
Immigration Policies In Times Of Crisis A Comparative Study Of The United States And Australia, Nicholas Corvino
Immigration Policies In Times Of Crisis A Comparative Study Of The United States And Australia, Nicholas Corvino
HIM 1990-2015
Although they are two very similar net immigration countries, Australia and the US took very different approaches to immigration policy adoption and implementation and to immigration control, in the last two decades of the 20th century. The literature explains these different approaches by invoking the influence of interest groups, human rights initiatives and the reaction of state institutions to public pressure. This paper proposes an alternative explanation for the difference in immigration policy and control: crisis. Crisis, or a sense thereof, is what leads the population to mobilize and to put pressure on the government for more efficient policies and …

Image Bodies, Avatar Ontologies: Rendering The Virtual In Digital Culture, Adam M. Davis
Dissertations
In 2009 five avatar-themed films were released, one of which became the highest grossing film to date, signaling that in addition to their popularity in videogames and virtual worlds, avatars are culturally salient figures which demand scholarly attention. Avatars, virtual environments, and user behavior have evolved significantly since virtual reality captured public and academic attention at the close of the twentieth century, and this dissertation is an attempt to theorize the avatar in contemporary digital culture. By interlacing new media philosophy and analyses of cinematic texts I situate the avatar at the nexus between digital images and interactive bodies, with …
Artful Good Faith: An Essay On Law, Custom, And Intermediaries In Art Markets, Deborah A. Demott
Artful Good Faith: An Essay On Law, Custom, And Intermediaries In Art Markets, Deborah A. Demott
Duke Law Journal
This Essay explores relationships between custom and law in the United States in the context of markets for art objects. The Essay argues that these relationships are dynamic, not static, and that law can prompt evolution in customary practice well beyond the law's formal requirements. Understanding these relationships in the context of art markets requires due attention to two components distinctive to art markets: the role of dealers and auction houses as transactional intermediaries as well as the role of museums as end-collectors. In the last decade, the business practices of major transactional intermediaries reflected a significant shift in customary …
