Equity And The Global Policy On Climate Change: A Law And Economic Perspective, Andri G. Wibisana Dec 2012

Equity And The Global Policy On Climate Change: A Law And Economic Perspective, Andri G. Wibisana

Indonesia Law Review

The opponents of the global commitment to reduce greenhouse gases (GHGs) emissions seem to have shifted their arguments from the one emphasing on the issue of uncertainty to the one focusing on the economic burdens disproportionately placed on the current generation in general, and some developed countries in particular. Inevitably, the issue of equity becomes of highly importance in the recent climate policy debates. This paper attempts to analyze the implementation of equity principles, i.e. intergenerational and intragenerational equity, in the global climate policy. In doing so, it will first briefly outline some prominent economic appraisals on the impacts of …

Nature's Ritalin : The Effects Of Green Spaces On Symptoms Of Attention-Deficit/Hyperactivity Disorder, Roger A. Sideman

Theses, Dissertations, and Projects

This qualitative study explored the effects of exposure to natural green spaces on symptoms of Attention-deficit/hyperactivity disorder (ADHD) among diagnosed college students. Six students from three universities in the San Francisco Bay Area were interviewed regarding the impact of experiences in urban green spaces and wilderness on their perceived attentional functioning, stress, and mood. The study sought to: 1) contribute to the growing base of literature and research on Attention Restoration Theory (ART); 2) offer a potential non-pharmacological alternative treatment for ADHD; and 3) further develop within the field of social work an understanding of the natural environment as it …

Ecopsychology And Race : An Exploratory Study, Luke B. Woodward Dec 2012

Ecopsychology And Race : An Exploratory Study, Luke B. Woodward

Theses, Dissertations, and Projects

While ecopsychology has brought critical attention to the relationship between the natural environment and the human psyche, very little has been written about how race and racism shape our experience of the natural world. This qualitative study asked the following central question: How are race and racism relevant to ecopsychology in theory and practice? Twelve semistructured interviews were conducted with a racially diverse group of ecopsychologists, environmental justice activists and spiritual leaders. Interview data emphasized the importance of employing a broad definition of ecopsychology that encompasses not only the relationship between psyche and nature, but the relationship between psyche, nature …

Risk, Vulnerability, And Hazards: The Industrial Canal And The Lower Ninth Ward, Jerry V. Graves Jr.

LSU New Orleans Theses and Dissertations

The purpose of this study is to identify, analyze, and describe the social outcomes that may be affected by the environmental risks generated by infrastructure projects; to examine the ways in which vulnerability and exposure to hazards may increase risk in neighborhoods over time; and to examine the implications of addressing the exacerbation of exposure to natural hazards within the traditional environmental justice framework. The Industrial Canal and Lower Ninth Ward were selected as the subjects of this case study because the canal has existed on the perimeter of the neighborhood for nearly one century, isolating Lower Ninth Ward residents …

Characterization Of Urban Agricultural Practices And Gardeners’ Perceptions In Bronx Community Gardens, New York City., Michelle Melissa Althaus Ottmann, Juliana A. Maantay, Kristen Grady, Nilce N. Fonte

Cities and the Environment (CATE)

This study investigates urban agricultural practices in the community gardens in the Bronx, New York City, United States, due to their historical role of helping bring peace and a sense of community to areas that suffered from violence and social injustice. Through semi-structured interviews with the gardeners, visits to observe the gardens, and a spatial analysis of community socio-demographic characteristics using Geographic Information Systems (GIS), we characterize the community gardens visited, and survey the gardeners’ perceptions regarding the benefits and challenges that are involved in the activity. The GISc analysis results showed that there is a much higher rate of …

Indigenous Peoples And Epistemic Injustice: Science, Ethics, And Human Rights, Rebecca Tsosie Dec 2012

Indigenous Peoples And Epistemic Injustice: Science, Ethics, And Human Rights, Rebecca Tsosie

Washington Law Review

This Article explores the use of science as a tool of public policy and examines how science policy impacts indigenous peoples in the areas of environmental protection, public health, and repatriation. Professor Tsosie draws on Miranda Fricker’s account of “epistemic injustice” to show how indigenous peoples have been harmed by the domestic legal system and the policies that guide the implementation of the law in those three arenas. Professor Tsosie argues that the theme of “discovery,” which is pivotal to scientific inquiry, has governed the violation of indigenous peoples’ human rights since the colonial era. Today, science policy is overtly …

Discrimination In The Marcellus Shale: The Dormant Commerce Clause And Hydraulic Fracturing Waste Disposal, Eric Michel Dec 2012

Discrimination In The Marcellus Shale: The Dormant Commerce Clause And Hydraulic Fracturing Waste Disposal, Eric Michel

Chicago-Kent Law Review

The environmentally controversial process of hydraulic fracturing (commonly referred to as "fracking") has led to a recent explosion in the supply and sale of natural gas in the United States. However, every fracking operation creates a sizable amount of toxic wastewater that requires disposal, and drillers in Pennsylvania have increasingly been shipping their waste across the border to Ohio because of Pennsylvania's inadequate internal disposal options. In response, Ohio has passed legislation that taxes out-of-state fracking waste at a greater rate than waste derived from natural gas drilling within its borders. This Note examines whether Ohio's taxing scheme violates the …

End Of The Line: Tracking The Commodity Chain Of The Electronic Waste Industry, Jacquelynn A. Doyon Dec 2012

End Of The Line: Tracking The Commodity Chain Of The Electronic Waste Industry, Jacquelynn A. Doyon

Dissertations

This study examines the transfer of electronic waste (e-waste) from core to peripheral nations, specifically coastal nations in Africa. The theoretical perspective marries green criminology with world systems theory in examining the ways in which marginalized populations bear the burden of hazardous waste disposal across the globe. The study is comparative, looking at legislation in the United States as well as international legislation and enforcement, and also employs case study methodology, contrasting e-waste disposal in Nigeria and Ghana. The final intent of this research is to determine whether or not the violation of national and/or international legislation regarding the transfer …

Nurturing The Seeds Of Food Justice: Unearthing The Impact Of Institutionalized Racism On Access To Healthy Food In Urban African-American Communities., Kate Meals Dec 2012

Nurturing The Seeds Of Food Justice: Unearthing The Impact Of Institutionalized Racism On Access To Healthy Food In Urban African-American Communities., Kate Meals

The Scholar: St. Mary's Law Review on Race and Social Justice

Comprehensive change to our food systems must include a combination of community-based solutions and the elimination of racism from all structural levels. An anti-racist analysis of hunger is necessary to contextualize the power dynamics and structures responsible for food inequality. In recent decades, globalization and exponential population growth have pushed the boundaries of economic, social, and ecological sustainability, threatening global food security. Despite the fact that it is fundamental to human survival, adequate access to food is often viewed as a privilege, rather than a basic human right. These practices work to maintain a food system crisis that disproportionally impacts …

Key Strategies Of Sustainable Real Estate Decision-Making In The United States: A Delphi Study Of The Stakeholders, Pernille Christensen Dec 2012

Key Strategies Of Sustainable Real Estate Decision-Making In The United States: A Delphi Study Of The Stakeholders, Pernille Christensen

All Dissertations

Sustainable real estate is a growing sector within the commercial real estate industry, yet there is still a lack of consistency among the multitude of sustainability performance measurements and reporting requirements around the world. As a result of this confusion, stakeholders have developed different strategies and requirements for sustainability, which in turn makes it difficult to communicate with other stakeholders about sustainability in real estate. Without the ability to communicate with other stakeholders about sustainability efforts, comparison of sustainable real estate becomes a challenge, thus impeding progress towards a competitive sustainable real estate market.
This study presents the results of …

Cooperation, Competition And The Development Of Institutional Capacity: Civil Rights And Public Transportation In Southern Nevada, Bruce Erwin Turner Dec 2012

Cooperation, Competition And The Development Of Institutional Capacity: Civil Rights And Public Transportation In Southern Nevada, Bruce Erwin Turner

UNLV Theses, Dissertations, Professional Papers, and Capstones

This study examines the implementation of social goals through government action and the context and relations of agencies charged with demonstrating and enforcing equality in transit. Specifically, I explain complexities involved in the top-down federal mandate to demonstrate equal transit service for minority communities and low income residents. Institutional entrepreneurship by local government agencies influenced the legislation and regulation that they were charged to enforce. The local Metropolitan Planning Organizations (MPOs), created to enable a local voice in major capital road projects, acquired new institutional capabilities as federal agencies tasked them with implementing new social goals. Engineers and planners, initially …

Creating The Park Cool Island In An Inner-City Neighborhood: Heat Mitigation Strategy For Phoenix, Az, Juan Declet-Barreto, Anthony J. Brazel, Chris A. Martin, Winston T. L. Chow, Sharon L. Harlan Dec 2012

Creating The Park Cool Island In An Inner-City Neighborhood: Heat Mitigation Strategy For Phoenix, Az, Juan Declet-Barreto, Anthony J. Brazel, Chris A. Martin, Winston T. L. Chow, Sharon L. Harlan

Research Collection School of Social Sciences

We conducted microclimate simulations in ENVI-Met 3.1 to evaluate the impact of vegetation in lowering temperatures during an extreme heat event in an urban core neighborhood park in Phoenix, Arizona. We predicted air and surface temperatures under two different vegetation regimes: existing conditions representative of Phoenix urban core neighborhoods, and a proposed scenario informed by principles of landscape design and architecture and Urban Heat Island mitigation strategies. We found significant potential air and surface temperature reductions between representative and proposed vegetation scenarios: 1) a Park Cool Island effect that extended to non-vegetated surfaces; 2) a net cooling of air underneath …

Praying Hands: Influences Of Religiosity And Spirituality On Sexual Risk-Taking Among Black, College-Attending Emerging Adults, Tralonda C. Triplett

Open Access Dissertations

The Centers for Disease Control and Prevention have confirmed persistent disproportionate burdens of HIV/AIDS among Black populations in the United States. While treatment advancements have greatly improved qualities of life for persons living with HIV/AIDS, prevention efforts remain focused to reduce incidence among vulnerable populations. Research distinguishing emerging adulthood in the US has characterized it entailing identity formations influencing sexual risk-taking. Religiosity and spirituality have remained pivotal in Black cultures influencing beliefs and normative behaviors around pre-marital sex. The Praying Hands study combines ethnic, demographic, contextual and socio-environmental factors to investigate influences of religiosity and spirituality on HIV risks among …

The Duty To Advise The Lorax: Environmental Advocacy And The Risk Of Reform, Keith W. Rizzardi Nov 2012

The Duty To Advise The Lorax: Environmental Advocacy And The Risk Of Reform, Keith W. Rizzardi

William & Mary Environmental Law and Policy Review

Lawyers have an ethical duty to advise their clients on moral, economic, social, and political matters. When applied to the changing field of environmental law, this abstract notion becomes provocative. Lawyers should advise their environmental advocacy clients of the possibility that their efforts to apply statutes or rules might initially succeed, but subsequent legislative reactions might defund, reform, or repeal the laws the client’s case relied upon. As a client’s sophistication decreases, or as the risk of adverse reactions to the client’s environmental advocacy increases, the lawyer’s duty to advise the client of these risks can shift from discretionary to …

Thinking Beyond Borders: Critical Pedagogy In A Neoliberal Economy, Sarah E. White Nov 2012

Thinking Beyond Borders: Critical Pedagogy In A Neoliberal Economy, Sarah E. White

Capstone Collection

The aim of the capstone is to explore the role of critical pedagogy as a transformative philosophy for critical consciousness by examining the Freireian methodologies of the organization Thinking Beyond Borders. TBB is a ‘gap-year’ program designed for youth to study international development in 8 countries over 8 months with the goal of questioning assumptions. With the ideological hegemony of classical neoliberal economics increasing inequality through globalization, alternative educational paradigms that promote critical and creative thinking are needed. What can be done within education to cultivate citizens capable of mitigating and transcending the homogenizing tendencies of globalization, nurturing a ‘global …
