Japan is undoubtedly one of the foremost economic powers in the world and is internationally recognized as a democratic leader among modern nations. The economy's rapid growth in the mid-twentieth century has been attributed to its booming technical industries, including its electronic and automobile industries. However, Japan is unique in that it has retained traditions associated with typically less advanced nations-namely, a regressive human rights agenda. Although cultural, ethnic, and social minorities continue to exist on Japanese soil today, Japan's social policy of Nihonjinron allows the majority of the population to disregard such minorities and perpetuate the government's vision of …

This paper is a descriptive analysis of the main aspect of the job of game wardens, the apprehension of poachers. Based on data from interviews with 62 game wardens the author describes the actions of game wardens in attempting to enforce wildlife conservation laws. Extensive quotations from interviews with game wardens are presented. The analysis is focused around their responses to guiding questions regarding the probability of apprehension of poachers. These include: (1) poaching alone, (2) very experienced at poaching, (3) nevertalks about their poaching activities, (4) the use of informants, (5) remaining mobile, (6) being familiar with the geographic …

Gizzard Shad (Dorosoma Cepedianum) Expansion And Reproduction In The Upper Colorado River Basin, Sam T. Finney, Mark H. Fuller

Gizzard shad (Dorosoma cepedianum) were introduced into the Colorado River Basin circa 1996 via an unintentional contaminated stocking. Gizzard shad were collected throughout much of the Upper Colorado River Basin in 2005, 2006, and 2007. These collections document a rapid range expansion of this introduced species and a threat to intact fisheries.

Mandatory minimum sentences are anathema to judges due to, it is commonly said, judges’ “utter lack of power to do anything for the exceptional defendants that move them.” In the case of Weldon Angelos, for example, U.S. District Judge Paul Cassell lamented that sentencing Mr. Angelos to 55 years in prison “is unjust, cruel, and even irrational. [The court] reluctantly concludes that it has no choice.” The Judicial Conference has consistently opposed mandatory minimum sentences for more than 50 years, because it, too, has concluded that mandatory sentences give judges no choice in sentencing. In June 1905, attorneys for the Northern Central Railway Company filed suit in Baltimore Superior Court against the United Railways and Electric Company. The suit charged that United Railways owed Northern Central for a portion of the expenses incurred by Northern to repair two bridges in the City of Baltimore, Maryland. Northern Central’s railroad lines ran under the bridges and United Railways’ streetcar lines ran across them. The amount claimed was relatively small for a company the size of the Northern Central and the possibility of collecting somewhat remote even if the case were decided in its favor. However, the …

The Alluring And Manipulative "Spider Women" Of The Silver Screen: Femmes Fatales Of The Hard-Boiled Fiction, Classic Noir And Contemporary Noir Periods, Gretchen Brinker

This thesis delves into three categories of femmes fatales: the ones of hard-boiled fiction/classic noir and contemporary noir. Moreover, it generates several comparisons among those aforementioned categories, and extrapolates on them. Third wave feminism and how it draws relevance/is significant to the Bound and The Last Seduction films is additionally explored in this thesis. This thesis will discuss the similarities of the femmes fatales of the '30s/1940s-50s and contemporary noir (1980s-90s), while delving into differences between them.

Incorporating Recreational And Artisanal Fishing Fleets In Atlantic Billfish Management, Ayeisha A. Brinson

Atlantic billfish include sailfish (Istiophorus platypterus), blue marlin (Makaira nigricans), white marlin (Kajikia albida, formerly Tetrapturus albidus) and the spearfishes (Tetrapturus); these fishes are found in tropical and subtropical waters. The spearfishes include the longbill spearfish (T. pfluegeri), the Mediterranean spearfish (T. belone) and the roundscale spearfish (T. georgii). The International Commission for the Conservation of Atlantic Tunas (ICCAT) is the regional fishery management organization that conducts research to determine the condition of tuna and billfish resources and supports international cooperative management. ICCAT has determined that blue marlin and white marlin are overfished; the status of sailfish and spearfish are …

Circumventing Congress: How The Federal Courts Opened The Door To Impeaching Criminal Defendants With Prior Convictions, Jeffrey Bellin

This Article spotlights the flawed analytical framework at the heart of the federal courts’ approach to one of the most controversial trial practices in American criminal jurisprudence — the admission of prior convictions to impeach the credibility of defendants who testify. As the Article explains, the flawed approach is a byproduct of the courts’ reliance on a five-factor analytical framework to implement the governing legal standard enacted by Congress in Federal Rule of Evidence 609. Tracing the evolution of the fivefactor framework from its roots in pre-Rule 609 case law, the Article demonstrates that the courts’ reinterpretation of the framework …

This review examines the literature available on the state of the environment and environmental protection in the Russian Federation. As the largest country on Earth, rich in natural resources and biodiversity, Russia's problems and policies have global consequences. Environmental quality and management are influenced by the legacy of Soviet economic planning and authoritarian governance, as well as by Russia's post-Soviet economic recession and current strategies of economic development. Russia achieved a reduction in some pollutants owing to the collapse of industrial production in the 1990s, but many environmental indicators suggest growing degradation. Biogeography is the study of the geographical distribution of biological organisms. Mathematical equations that govern the distribution of organisms were first discovered and developed during the 1960s. The mindset of the engineer is that we can learn from nature. This motivates the application of biogeography to optimization problems. Just as the mathematics of biological genetics inspired the development of genetic algorithms (GAs), and the mathematics of biological neurons inspired the development of artificial neural networks, this paper considers the mathematics of biogeography as the basis for the development of a new field: biogeography-based optimization (BBO). Off-Highway Vehicle (OHV) use has grown enormously on Utah’s public lands and is one of the most contentious and difficult issues for federal, state, and local land management agencies to address and provide for. Despite OHV use’s meteoric rise in popularity and its ongoing public conflicts, little is known about OHV recreationists. This thesis develops a typology that identifies within-activity differences related to recreation specialization; it also determines differences in OHV owners’ environmental attitudes and motivations. Findings show Utah’s owners comprise a range of use along the recreation specialization continuum. Results also indicate that an OHV owners’ specialization level is …

International migration, with its complex web of economic, social, demographic, and political consequences, is a theme that dominates national and international interests. This thesis explores a connection between illegal African immigration to Spain and a recent phenomenon of Senegalese immigration to Argentina through an examination of historical trajectories of immigration, legal and illegal entries, and migration legislation. In particular the focus will be on the role of Spanish national migration law and border control as a deterrent against illegal African immigration and a resultant wave of Senegalese immigrants representing a new phenomenon of ecologically pushed migration from Sub-Saharan Africa.

Across America, homeless students face a myriad of barriers that impede education and school access and success of homeless children. The purpose of this study was to determine the barriers to enrollment and school success for homeless students. The ultimate goal was to provide information to parents, teachers, administrators, and school districts that could serve as a vital resource tool in educating homeless students while removing barriers.
The participants consisted of 215 certified teachers, school administrators, and homeless liaisons in 23 school districts representing the populations that provide afterschool instruction to homeless students. The study was conducted in the spring …

This research examines the prospects for developing an economic diversification policy for The Bahamas, utilizing agritourism. The Bahamas is plagued with the dominance of one traditional sector, tourism combined with the lack of economic innovation and the inability to maintain domestic demand for food security, which has the potential for economic crisis if there are any serious 'external shocks' or setbacks in mainstream tourism. Movements, Resource Selection, And Risk Analyses For Parasitic Disease In An Expanding Moose Population In The Northern Great Plains, James J. Maskey Jr.

Little is known regarding moose ecology in North Dakota, and a decline in moose in northeastern North Dakota may be linked to parasites of white-tailed deer (Parelaphostrongylus tenuis and Fascioloides magna). I investigated the ecology of moose, including the potential effects of parasitic disease. I used global positioning system collars to estimate home ranges and habitat selection and collected fecal samples for diet estimates. I reviewed historical data and examined livers moose for evidence of F. magna infection. I examined 3730 white-tailed deer for P. tenuis and investigated whether prevalence had increased since 1991. This article makes a critical contribution to the fields of environmental and corporate law. It explains a problem in the citizen enforcement of environmental statutes: the issue of how to establish and secure standing to sue. The article then recommends a novel solution based in corporate law: the application of ultra vires statutes. The article significantly contributes to the scholarly literature on ultra vires statutes by: (1) examining thoroughly the history of the ultra vires doctrine, especially in early American history, (2) clarifying that scholars and practitioners should now cite ultra vires statutes rather than the doctrine, (3) reviewing recent …
