Should unauthorized immigrants be allowed to legally work within the borders of the United States? This question is at the heart of the debate over the use of guest worker programs in America. Many believe guest worker programs that include these undocumented immigrants would actually be harmful. They fear these immigrants would not leave the country after their legal status has expired and that the conditions for many American workers would diminish.

Courts have often been cited as the weakest of the three branches of government. I do not necessarily agree with that assessment, but increasingly courts are realizing that that does not, in any event, mean they can or should remain silent or passive and allow our sister branches to determine our fate. Court governance and leadership, eliminating bias, improving access, and judicial independence are critical areas upon which we all must focus. The fourth panel discussion at the National Forum on Judicial Independence explores the way the public thinks about judicial independence and ways in which the media and members of the bar may affect judicial independence. The discussion was led by then-AJA secretary Steve Leben, a state general-jurisdiction trial judge from Kansas. The Market For Legal Education And Freedom Of Association: Why The "Solomon Amendment" Is Constitutional And Law Schools Are Not Expressive Associations, Andrew P. Morriss

William & Mary Bill of Rights Journal

This term the Supreme Court will confront the constitutionality of the Solomon Amendment, which mandates equal access for military recruiters at universities that accept federal funding. The Third Circuit previously held the statute unconstitutional. This Article argues that the Court should reverse and uphold the statute because the lower court failed to consider the cartelized nature of legal education and so assumed that law schools are "expressive associations" entitled to assert First Amendment claims; the court also failed to give proper deference to Congress's exercise of its Article I power to raise and support armies and over-valued law faculties' interest …

Mercer Law Review

This Article surveys construction law decisions handed down by Georgia courts and construction-related legislation enacted by the Georgia General Assembly between June 1, 2004 and May 31, 2005. As in prior years, the selected cases primarily fall within five categories: (1) contracts, (2) torts, (3) mechanics' and materialmen's liens, (4) arbitration, and (5) miscellaneous. Recent legislation is highlighted in Section VI.

How Has The Violence Against Women Act Affected The Response Of The Criminal Justice System To Domestic Violence?, Hyunkag Cho, Dina J. Wilke

The Journal of Sociology & Social Welfare

This study uses an interrupted time series design to examine the association between the Violence Against Women Act of 1994 (VAWA) and several different dimensions of the criminal justice system's involvement in violence against women. These include examining the domestic violence incidence rate, and rates of police notification, arrest, and judicial authorities' involvement. Data from the National Crime Victimization Survey from 1992 to 2003 is used. Results suggest that overall the incidence of domestic violence has decreased while police notification and perpetrator arrest have increased over time. Further, victim involvement with judicial authorities significantly increased after enactment of the VAWA. …
