Progressivist Origins of the 2003 California Gubernatorial Recall, was written in Sacramento in the midst of the first statewide recall of an elected official in California. The paper explores the nature of the recall procedure and its implementation in the state, and is chiefly an inquiry into the relatedness of the current incarnation and its Progressivist root. It focuses particularly on the recall of Governor Gray Davis, and details how shifting attitudes towards public participation have altered the procedure over time.

Faith Based Initiatives And Black Churches: Relationships In A Small City, Said Sewell Iii

Journal of Rural Social Sciences

This exploratory study examined characteristics of black churches in a small southern city that affected the likelihood that such churches would play an active role in faith-based community services. A formal mail survey of church ministers in black Protestant churches in this city was employed. Results were discussed in light of federal policies that promote faith-based initiatives to meet local social service needs. The results indicated that the majority of the black churches in this study were active in addressing local needs through indirect (sermons, lobbying local governments) rather than direct (program development and implementation) means. We apply a commodity systems analysis to examine a series of changes that are transforming Alabama's pulp and paper industry. Alabama is a critical area for investigation because it lies at the heart of North America's principle pulp and paper production zone. Industry restructuring is a complex process involving the reorganization of capital and corporate ownership, as well as changes in technologies, which affect the labor process. For example, a recent spate of corporate mergers has resulted in concentration of mill ownership and has accelerated the prevalence of sub-contracting. Prosecuting Martha: Federal Prosecutorial Power And The Need For A Law Of Counts, Michael L. Seigel, Christopher Slobogin

Martha Stewart's case illustrates a wide variety of prosecutorial decision-making. We have defended the U.S. Attorney's decision to investigate and prosecute Stewart, but called into question the further decision to charge her with five counts. As a way of curtailing the redundant charging phenomenon, which is widespread, we have suggested that the courts develop a law of counts to cabin prosecutorial charging discretion. Thus, our proposal to create a law of counts would not require prosecutors to act against their short- or long-term interests. Rather, it would be implemented by judges using the interpretive method, without going so far as …

The prevalence of mental health problems in the juvenile offender population is substantially higher than that of the general population (Cocozza & Skowyra, 2000). Studies estimate that one in five juvenile offenders has serious mental health problems, which is nearly twice the rate of occurrence of mental illness in children and adults in the general population (NMHA Fact Sheet #l). However, there have been several methodological problems encountered in previous research. These include the use of inconsistent definitions and measurements of mental illness; the use of biased, nonrandom samples, a reliance on retrospective case report data, and the use of …

This report presents the findings of a site and equipment feasibility study, as well as, a permit overview for the installation of a vessel sewage pumpout system for servicing commercial and recreational vessels in the City of Boston. As part of the analysis, we reviewed a number of sites located within the City of Boston’s jurisdiction in Boston Harbor. We contacted facilities that have made recent investments in commercial grade pumpouts to learn more about the available technology. In analyzing the permit process, we reviewed local zoning requirements and had conversations with relevant City and state officials.

Solid-Like Dynamics In Ultrathin Films Of Polymeric Liquids, Gaurav Singh, Ravi F. Saraf, Yves Martin

In this letter, we demonstrate that, at mesoscales, nonferroelectric liquid films of polydimethyl siloxane. exhibit significant electrostriction not present in the corresponding bulk state. Remarkably, the observed electrostrictive effect has a response time ,20 ms in contrast to .5 ms recorded in conventional bulk ~ferroelectric polymers. The emergence of this fast electrostrictive strain in thin films is explained in terms of the amalgamation of two contrasting dynamic features—the influence of a highly mobile, viscous layer ~at the air/film interface. on the less-mobile, but fast responding, solid-like layer at the film/substrate interface. The effect is observed for thickness below 200 nm.

The Supreme Court established a two-part test for determining when an invention is "on sale" under 35 U.S.C. §102(b) in Pfaff v. Wells Electronics, Inc. For the on-sale bar to be triggered, the invention must be "ready for patenting" and subject of a "commercial offer for sale." In Minnesota Mining & Manufacturing v. Chemque, Inc., the Federal Circuit expounded on what constitutes a commercial offer for sale. This iBrief explores what is considered a "commercial offer for sale."
