Faith Based Initiatives And Black Churches: Relationships In A Small City, Said Sewell Iii

Journal of Rural Social Sciences

This exploratory study examined characteristics of black churches in a small southern city that affected the likelihood that such churches would play an active role in faith-based community services. A formal mail survey of church ministers in black Protestant churches in this city was employed. Results were discussed in light of federal policies that promote faith-based initiatives to meet local social service needs. The results indicated that the majority of the black churches in this study were active in addressing local needs through indirect (sermons, lobbying local governments) rather than direct (program development and implementation) means. Prosecuting Martha: Federal Prosecutorial Power And The Need For A Law Of Counts, Michael L. Seigel, Christopher Slobogin

Martha Stewart's case illustrates a wide variety of prosecutorial decision-making. We have defended the U.S. Attorney's decision to investigate and prosecute Stewart, but called into question the further decision to charge her with five counts. As a way of curtailing the redundant charging phenomenon, which is widespread, we have suggested that the courts develop a law of counts to cabin prosecutorial charging discretion. Thus, our proposal to create a law of counts would not require prosecutors to act against their short- or long-term interests. Rather, it would be implemented by judges using the interpretive method, without going so far as …

The prevalence of mental health problems in the juvenile offender population is substantially higher than that of the general population (Cocozza & Skowyra, 2000). Studies estimate that one in five juvenile offenders has serious mental health problems, which is nearly twice the rate of occurrence of mental illness in children and adults in the general population (NMHA Fact Sheet #l). However, there have been several methodological problems encountered in previous research. These include the use of inconsistent definitions and measurements of mental illness; the use of biased, nonrandom samples, a reliance on retrospective case report data, and the use of …

A Review Of Color Vision In White-Tailed Deer, Kurt C. Vercauteren, Michael J. Pipas

United States Department of Agriculture Wildlife Services: Staff Publications

A better understanding of the color vision abilities of white-tailed deer (Odocoileus virginianus) helps to determine how these animals interpret their environment. We review and summarize the literature related to the color vision abilities of white-tailed deer. Physiological measurements using advanced techniques such as molecular genetics, electroretinography, and electron microscopy have demonstrated conclusively that whitetailed deer possess the anatomical requisites for color vision. Operant conditioning techniques employed in pen studies using trained cervids confirm that deer see color. The eyes of white-tailed deer are characterized by 3 classes of photopigments: a short-wavelengthsensitive cone mechanism, a middle-wavelength-sensitive cone mechanism, …

The Self-Incrimination Clause Explained And Its Future Predicted, Ronald Jay Allen, M. Kristin Mace

Public Law and Legal Theory Papers

Like many areas of the law, the Fifth Amendment has defied theoretical explanation by scholars. We examine whether the fifth amendment cases can be explained with a relatively simple theory, and find that they can. The key to that theory is the recognition that, although never acknowledged by the Court, its cases make plain that "testimony" is the substantive content of cognition - the propositions with truth-value that people hold or generate (as distinct from the ability to hold or generate propositions with truth-value). This observation leads to a comprehensive positive theory of the Fifth Amendment right: the government may …

The underutilization of mental health services by Latinos has been a growing concern in research and clinical practice. This has become increasingly important as the population of Latinos in the United States rapidly rises and the evidence that many are not receiving needed mental health services accumulates. To provide an understanding of the issues, this article provides an overview of risk factors that may influence the mental health of Latinos and examines prevalence rates of psychopathology and service utilization trends. Conventional economic and political theory predicts that the states will underregulate the degradation or destruction of natural resources within their borders when some or all of the resulting adverse effects fall outside their borders, that is, upon out-of-staters. Academic critics of the federalization of environmental law agree with this conventional view at an abstract level, but, in their view, only the physical effects of the destruction of a natural resource on out-of-staters should count as an interstate externality that can justify federal intervention. Marginalized Transition Models For Longitudinal Binary Data With Ignorable And Nonignorable Dropout, Brenda F. Kurland, Patrick J. Heagerty

UW Biostatistics Working Paper Series

We extend the marginalized transition model of Heagerty (2002) to accommodate nonignorable monotone dropout. Using a selection model, weakly identified dropout parameters are held constant and their effects evaluated through sensitivity analysis. For data missing at random (MAR), efficiency of inverse probability of censoring weighted generalized estimating equations (IPCW-GEE) is as low as 40% compared to a likelihood-based marginalized transition model (MTM) with comparable modeling burden. MTM and IPCW-GEE regression parameters both display misspecification bias for MAR and nonignorable missing data, and both reduce bias noticeably by improving model fit
