Dialogue And Hierarchy In Charter Interpretation: A Comment On R. V. Mills, Jamie Cameron Dec 2000

Dialogue And Hierarchy In Charter Interpretation: A Comment On R. V. Mills, Jamie Cameron

Articles & Book Chapters

This case comment focuses on two issues of methodology: the first concerns constitutional interpretation and the democratic process, or the dialogue issue, and the second, the relationship between Charter guarantees, or the hierarchy issue. To set the stage, an initial section provides an overview of the Stinchcombe/O'Connor/Mills trilogy, and is followed by a more detailed analysis of Mills that examines the tension between judicial and legislative decision making, before considering how Parliament and the Court altered O'Connor's model for balancing the rights of the accused and complainants. On the latter issue, though the article does not comment in detail on …

Convicting And Unconvicting The Innocent, Donald E. Wilkes Jr. Dec 2000

Convicting And Unconvicting The Innocent, Donald E. Wilkes Jr.

Popular Media

"When justice disappears," Immanuel Kant wrote, "it is no longer worth while for men to live on earth."

Justice disappears where there is injustice, and the most glaring form of injustice is the erroneous conviction of the innocent. Indeed, the greatest injustice that a legal system can perpetrate against the individual is to punish him or her for a crime they didn't commit, while the ne plus ultra of injustices is the wrongful conviction and subsequent execution of an innocent person. Viewed in this light, what is the current state of justice in America? Is the problem of convicting, even …

Gender Differences In The Effect Of Child Maltreatment On Criminal Activity Over The Life Course, Ryan E. Spohn Dec 2000

Gender Differences In The Effect Of Child Maltreatment On Criminal Activity Over The Life Course, Ryan E. Spohn

Criminology and Criminal Justice Faculty Publications

This paper adds to a growing body of knowledge regarding the criminal consequences of childhood victimization. A prospective research design is used to compare a group of maltreated youth to a matched control group in order to determine the extent to which child abuse and neglect influence both juvenile delinquency and adult crime. Controlling for race and sex, abused and neglected children are more likely to have a juvenile arrest record. In addition, controlling for involvement in juvenile crime, child maltreatment also influences adult criminality. Motivated by the findings of qualitative studies focusing on female offenders, I examine gender differences …

A Qualitative Study Of The Women And Children's Residential Treatment Center Substance Abuse Treatment Program, Phillip Elwyn Gilbert Dec 2000

A Qualitative Study Of The Women And Children's Residential Treatment Center Substance Abuse Treatment Program, Phillip Elwyn Gilbert

Psychology

This thesis presents the results of a formative process evaluation of the Fairbanks Native Association Women and Children's Residential Treatment Center abuse program using interviews, participant observation, and grounded theory methods of qualitative research. Eight clients and eight staff were interviewed across the domains of culture, spirituality and family. A theory of program operation emanated from and was grounded in the data: program functioning was significantly affected by the relationship perceived by the clients to exist between themselves, (their needs, values, desires, goals and world view) and the program's goals and priorities.
