Brief For The Coalition Against Patent Abuse As Amicus Curiae In Support No Party, Charles Duan
Brief For The Coalition Against Patent Abuse As Amicus Curiae In Support No Party, Charles Duan
Amicus Briefs
Perhaps unexpectedly, a case on the constitutionality of the Patent Trial and Appeal Board has major significance to the pressing policy crisis of drug prices in the United States. Erroneously issued patents monopolize medical therapies, making them unaffordable or inaccessible to numerous Americans. The inter partes review proceedings that the Board conducts have repeatedly and successfully overcome such patents, enabling competition and dramatically lowering prices. This Court should ensure the continued viability of the Board and of inter partes review, by preserving the Board’s objectivity and independence from executive branch political influence.

When Technology Works: A Case Study Using Instructional Rounds And The Samr Model, Gregory Warsen, Richard Vandermolen
Peer Reviewed Articles
Billions of dollars are spent each year in the United States on technology for schools, and researchers in this case study wanted to determine the degree to which individual computing devices (ICDs) enhance the learning experience of students in grades six to twelve. The leadership practice of instructional rounds (City, Elmore, Fiarmen & Teitel, 2011) combined with the SAMR model (substitution, augmentation, modification and redefinition) (Puentadura, 2014) of technology integration was utilized in this case study to capture how ICDs are being used and the impact this use is having on learning. This method detected use rates far above what …

Investment in capital, new technology, and agricultural techniques has not been considered endeavors worthwhile in a medieval economy because of a lack of strong property rights and no incentive on the part of lords and barons to lend money to or grant rights peasant farmers. Therefore, the medieval economy and standards of living at that time often have been characterized as non-dynamic and static due to insufficient investment in innovative techniques and technology. The capital investment undertaken typically would have been in livestock, homes, or public investment in canals, bridges, and roads, although investment in the latter would have been …

Business Models For Post-Crisis Information Ecosystems, Antje Mays
Library Presentations
Since early 2020, the global COVID-19 pandemic has interrupted activity across business, education, research, and communities. Public health safety precautions have forced drastic reductions in economic and educational activity, resulting in widespread economic uncertainty and sizeable budget cuts. With library budgets already declining since the 2001-2002 recession following the dotcom crash and more steeply since the 2007-2009 Great Recession spawned by the financial crash, the pandemic has accelerated trends that were already underway. Libraries’ reduced purchasing power places the information ecosystem at risk of contraction in the race to contain costs.
While economic contexts and publishing forms have changed considerably. …

In this study, we examined parents' (n = 260) perceptions of their own and their children's use of social media and other types of communication technologies in the beginning stages of coronavirus disease 2019 (COVID-19) related sanctions (e.g., social distancing) in the United States. We also examined associations between social media and technology use and anxiety. On average, parents reported that both they and their children (especially teenagers aged 13-18) had increased technology and social media use since the beginning of social distancing. Moreover, even after controlling for demographic factors, structural equation models showed that parents and children with …

Structural Sensor Surveillance, Andrew Guthrie Ferguson
Articles in Law Reviews & Other Academic Journals
City infrastructure is getting smarter. Embedded smart sensors in roads, lampposts, and electrical grids offer the government a way to regulate municipal resources and the police a new power to monitor citizens. This structural sensor surveillance, however, raises a difficult constitutional question: Does the creation of continuously-recording, aggregated, long-term data collection systems violate the Fourth Amendment? After all, recent Supreme Court cases suggest that technologies that allow police to monitor location, reveal personal patterns, and track personal details for long periods of time are Fourth Amendment searches which require a probable cause warrant. This Article uses the innovation of smart …

COVID-19 has created pressing and widespread needs for vaccines, medical treatments, PPE, and other medical technologies, needs that may conflict--indeed, have already begun to conflict--with the exclusive rights conferred by United States patents. The U.S. government has a legal mechanism to overcome this conflict: government use of patented technologies at the cost of government paid compensation under 28 U. S.C. § 1498. But while many have recognized the theoretical possibility of government patent use under that statute, there is today conventional wisdom that § 1498 is too exceptional, unpredictable, and dramatic for practical use, to the point that it ought …

Global Cities And Socioeconomic Inequality: A Pathways Inquiry, Herman Boschken
Faculty Publications, School of Management
Inequality in metropolitan areas is part of a paradoxical triangle of competing motives over resources allocation. Chief among inequality/equity rivals is the penchant for urban economic development, but in recent decades, ecological sustainability has also become increasingly important in this triangle. To understand inequality in global cities in such a context, one must recognize the intensity of economic development motives for those particular metropolitan areas seeking to maintain worldwide centrality, connectivity and command over the forces of globalization. As a comparative analysis of 53 large U.S. metropolitan areas, this paper examines the apparatus of a global city in response to …

During the COVID-10 pandemic, infected persons have been quarantined in segregated facilities. Individuals who have been in contact with the infected persons may be subject to self-isolation measures or stay-home notices. Technological tools such as proximity and contact tracing apps are used to identify those who have been in close contact with infected persons. The contact tracing QR code used in Singapore's SafeEntry requires the submission of personal information (including names and identification numbers) prior to entry into certain public places such as malls, factories and restaurants.
