Constitutions, The State And Law In Republican Venezuela (1830-2025), Rogelio Pérez-Perdomo

Latin American & Caribbean Law Review

This panoramic article poses the question of the relation between the state, the constitution and the law in Venezuelan republican history. In the 19th century, Venezuela became independent, congresses approved constitutions that organized the national state, comprehensive legal codes and legislation were produced and the universities developed legal studies and produced a small number of lawyers. Nevertheless, the law had little impact on a turbulent and impoverished country, and lawyers mainly found occupation in the state and political system. In the 20th century, Venezuela constructed a powerful state that pacified the country that created conditions for a relatively prosperous economy. …

This legal column addresses the severe regulatory and legal risks of employing a dental hygienist whose license has lapsed. MDA Legal Counsel explains that under Michigan law (MCL 333.16222(1)), licensed health care professionals are mandatory reporters and must notify the Michigan Department of Licensing and Regulatory Affairs (LARA) upon learning of unlicensed practice. Continuing to employ an unlicensed hygienist exposes the dental practice to administrative sanctions, loss of licensure, and liability. Practice owners are advised to verify employee licenses regularly and screen for unresolved administrative complaints

Social Bonds In Specialized Courts: An Expanded Integrated Model Of Treatment Court Effectiveness, Christopher Salvatore

Midwest Social Sciences Journal

Specialized court programs, which began with drug treatment courts, now include reentry, domestic violence, prostitution, mental health, veterans, and other problem solving courts, have been shown to reduce recidivism and provide improvements in participant outcomes. Over the last thirty years, scholars have provided theoretical explanations for these programs, including therapeutic jurisprudence, life course theory, deterrence, risk-needs-responsivity, and procedural justice. These theoretical paradigms have not fully integrated the central role of relationships and prosocial connections in specialized courts. This study aims to explore the feasibility of implementing safe harbors in transfer pricing regulations in Indonesia. Safe harbors are alternative tax policies for taxpayers on specific transactions, which can exempt them from general provisions if meets certain specific regulations set by the tax authority (United Nations, 2017). Using a qualitative methodology, this study explores data from various literature and the results of interviews with experts in the field of transfer pricing. บทความนี้มุ่งศึกษาถึงการคุ้มครองสิทธิอนามัยเจริญพันธุ์ของสตรีและผู้มีความหลากหลายทางเพศในบริบทประเทศไทย ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน เช่น อนุสัญญาว่าด้วยการขจัดการเลือกปฏิบัติต่อสตรีในทุกรูปแบบ (CEDAW) หลักการยอกยาการ์ตา และเป้าหมายการพัฒนาที่ยั่งยืนข้อที่ 5 ซึ่งต่างยืนยันถึงสิทธิในการเข้าถึงสุขภาพทางเพศและอนามัยเจริญพันธุ์อย่างเสมอภาคและปราศจากการเลือกปฏิบัติ จากการศึกษาพบว่า แม้ประเทศไทยจะมีความก้าวหน้าในเชิงกฎหมายและนโยบาย แต่ยังคงเผชิญอุปสรรคสำคัญ อาทิ อคติจากผู้ให้บริการ ความเหลื่อมล้ำทางเศรษฐกิจและภูมิศาสตร์ ตลอดจนข้อจำกัดทางกฎหมายที่ยังไม่สอดคล้องกับมาตรฐานสิทธิมนุษยชนสากล การศึกษาวิจัยนี้จึงมุ่งศึกษาพัฒนาการและปัญหาทางกฎหมายและนโยบายของประเทศไทยที่เกี่ยวข้อง เช่น การยุติการตั้งครรภ์ การขยายสิทธิประโยชน์ด้านการคุมกำเนิด การบริการอนามัยเจริญพันธุ์ รวมถึงสิทธิในการเข้าถึงบริการยาฮอร์โมนและการยืนยันเพศสภาพ โดยศึกษาเปรียบเทียบกับการคุ้มครองสิทธิอนามัยเจริญพันธุ์ในสหราชอาณาจักร เยอรมนี และอินเดีย อันเป็นตัวอย่างการพัฒนากลไกกฎหมายและนโยบายที่ช่วยลดความเหลื่อมล้ำและสร้างระบบบริการที่เป็นมิตร เพื่อยกระดับกลไกทางกฎหมายและนโยบายสาธารณะของไทยให้สามารถส่งเสริมและสนับสนุนสิทธิอนามัยเจริญพันธุ์เกิดขึ้นจริง ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน และบรรลุเป้าหมายการพัฒนาอย่างยั่งยืนได้ต่อไป

Getting A Special Education: Parents, Lawyers, And The Politics Of Disability In Postwar Pennsylvania, Emma Gabriel

Swarthmore Undergraduate History Journal

This paper explores the relationship between white parent advocates in Pennsylvania and public interest lawyers, whose litigation efforts legitimized the construction of an implicitly white disabled class in the mid-twentieth century. This analysis sheds light on the ways in which school reform became a key element in the simultaneous construction and renegotiation of intellectual disability and race in the postwar era, and foregrounded the adoption of the Individuals with Disabilities Education Act (IDEA) in 1975.

Revenge porn, which is the distribution of pornographic material without the victim's consent, is a serious and growing problem online. This practice is usually carried out by ex-partners in revenge, by distributing intimate images or videos of the victim to the internet. This research aims to identify the impact of revenge porn on victims, as well as assess the effectiveness of existing legal protection. The method used is a qualitative approach through literature study. Despite the lack of serious interrogation at the federal constitutional level of economic regulations, there continues to be a fairly robust, energetic attention at the level of state constitutional law to so-called economic liberties. In a number of key cases, including, for example, matters involving occupational licensing, state courts have looked to unique features of their respective state constitutions to assess whether and to what extent regulations undertaken under the police power go too far. This article helps military lawyers work with allies.  By comparing the Law of Armed Conflict (LOAC) Manuals printed by the United States, the United Kingdom, France, Germany, and Australia, this article identifies consequential differences in the interpretation of LOAC between these five countries.  The article discusses four such differences: definitions of foundational principles, incursion into a neutral or nonparticipating State during a conflict, the role of doubt in making targeting decisions, and the degree of protection accorded to the environment from the effects of attacks.  While these differences point to possible challenges for cooperation between the United States and its …

Literacy education in the United States has long centered on standardized English and formal classroom instruction. While intended as a universal benchmark, this approach systematically overlooks and delegitimizes the rich literacy history and traditions rooted in Black families and communities. Through the application of frameworks such as New Literacy Studies, Gee's Theory of Discourse Communities, Yosso's Community  Cultural Wealth model, and Critical Race Theory, this article reframes Black family literacy through a social, cultural, and historical lens. As the rate of AI adoption by lawyers steadily climbs, unfortunately so has the number of incidents of AI misuse by attorneys. For some time, courts satisfied themselves with giving offending lawyers warnings, ordering them to take additional CLE, and/or administering relatively nominal monetary sanctions. Lately, however, frustrated judges throughout the country have upped the ante by not only assessing increasingly higher sanctions but also imposing case dismissals and suspensions or disciplinary referrals for the lawyers involved. This legal column addresses whether improper dental billing resulting from misunderstanding plan requirements constitutes fraud. The author explains the legal elements necessary to establish fraud, including knowledge, intent, and damages. The article distinguishes billing errors and contract violations from fraudulent conduct and encourages dentists to review participation agreements and billing policies to minimize compliance risks.

This review engages with Rehan Abeyratne's book Courts and LGBTQ+ Rights in an Age of Judicial Retrenchment, which examines judicial responses to LGBTQ+ claims over the past two decades across three jurisdictions — the United States, India, and Hong Kong. Abeyratne argues that the apex courts in these countries have grown more inward-looking and have enabled the rise of illiberal and authoritarian forces; however, LGBTQ+ rights have emerged as an exceptional site where these courts continue to extend minimal remedies and adopt a tone of empathy, positioning themselves as the last bastion of liberal constitutionalism.
