Enhancing The Security Of Shipping In Southeast Asia: The Relevance Of International Law, Robert Beckman
International Law Studies
This article outlines the principles of international law governing the right to exercise jurisdiction over ships. It then explains the relevance of UN international crimes conventions to the security of commercial ships. These conventions give States parties jurisdiction to arrest persons present in their territory who are alleged to have committed such crimes and an obligation to either prosecute or extradite them. It then explains the measures that have been taken by the International Maritime Organization to enhance the security of commercial shipping, including its Code of Practice on preventing piracy and “armed robbery against ships” and its measures to …

On 12 October 2000, two men from an organization aligned with al-Qa‘ida loaded a rigid raider (a small boat with glass-reinforced-plastic hull) withexplosives and drove it into the side of the guided-missile destroyer USS Cole (DDG 67). Seventeen sailors lost their lives. This was a seminal event. It epitomized small war versus “big” war and the threat that small-war tactics could present to “big war” fleets. Piracy is an ancient, persistent, and elusive phenomenon in the South China Sea. In the past two decades it has increased substantially, leading to a re- newed interest in piracy and its possible nexus with maritime terrorism, espe- cially after the 11 September 2001 attacks on the United States. Although it has been widely reported and investigated, piracy remains difficult to understand and to control.

Under President Joko Widodo’s administration, Indonesia’s archipelagic outlook has been re-asserted as the basis of Indonesia’s foreign policy, by introducing the concept of Global Maritime Fulcrum (GMF). GMF is aimed put Indonesia as a single maritime power with considerable diplomatic influence in becoming a central role in two vast maritime regions. In the last decade, piracy in the African waters, especially surrounding Somalia, has vastly increased. Due to a previous civil war, absence central government in the country and lack of natural resources, Somalia is presently one of the most underdeveloped countries in the world—which many say is a large stimulus in the rise and expansion of piracy. This article will assess both the problems and potential solutions to contemporary seaborne threats of piracy, robbery, and terrorism, and discuss challenges and opportunities for the domestic and international forums prosecuting the crimes that constitute piracy and maritime terrorism. In particular it will begin with a discussion of the (d)evolution of events in the late 20th Century, which has transformed the old problem of piracy into a modern scourge. This Note discusses the domestic and international economic effects of the recent surge of piracy off the coast of Somalia, and uses Somali piracy as a method of exploring conflicting ideological conditions that arise from globalization. In exploring the underlying motivations for this trend, it identifies a dichotomy between primary needs satisfaction within underdeveloped nations and the satisfaction of secondary interests in developed nations, and explains how globalization may be exacerbating the turn toward piracy.
