Major corporate scandals and heightened government enforcement of ethical lapses in the workplace continue to emphasize the importance of an effective compliance and ethics program. Compliance and ethics programs effectively became mandatory when the United States Federal Sentencing Commission amended the Federal Sentencing Guidelines for Organizations in 2004 to recognize the existence of an effective compliance and ethics program as a mitigating consideration in the sentencing of organizations convicted of criminal conduct. While legalistic codes, policies, and procedures have become the normative response to the Sentencing Guidelines, soul-less documents in and of themselves will not develop the “thoughtful behavior” upon …

Ethical Implications Of Utilizing Generative Artificial Intelligence In The Legal Profession: A Cautionary Note On Potential Model Rules Of Professional Conduct Violations, Rachel Schworer

The increased use of generative artificial intelligence (“GAI”) in the legal profession raises ethical questions. As a result, this note contemplates some state-adopted Model Rules of Professional Conduct that lawyers could violate if they improperly use GAI or fail to use GAI altogether. GAI enables lawyers to increase their efficiency, enhance their decision-making, and provide cost-efficient services to clients. However, GAI also presents lawyers with biased outputs, a lack of explainability, and hallucinations, as seen in recent cases when ChatGPT cited fictitious cases to lawyers. This is the first article to call for a ban on the use of AI technology designed to influence human decision-making, “Persuasive AI,” for the purpose of recruiting or enrolling human participants in drug trials sponsored by commercial entities. Weakness is the new strength: How vulnerability makes leaders stronger is the result from the meta-analysis of five phenomenological studies designed to generate a theory that explains how exemplar leaders from five different fields used “soft-skills” and four domains of behavior to create mutual shared knowledge, resolve conflict and transform relationships to produce breakthrough results. The four domains of behavior are communication, collaboration, ethics, and emotional intelligence. School Counselor Trainees’ Experiences With Dilemma Discussions In Ethics Education, J. Richelle Joe, Jon Borland

Journal of Counselor Preparation and Supervision

Student-led ethical dilemma discussions were incorporated into counseling ethics instruction for school counselor trainees (SCTs). Phenomenological content analysis was employed to gain insight into the experiences of SCTs who participated in this teaching and learning strategy. Fifteen (n = 15) master’s level SCTs responded to open-ended questions about their experiences with the dilemma discussions. The following themes emerged from the data: (a) social learning, (b) self-awareness, (c) subjective learning experience, and (d) applied learning. A description of the teaching method is discussed as well as implications for counseling ethics instruction.

Does International Humanitarian Law Confer Undue Legitimacy On Violence In War?, Kieran R.J. Tinkler

International Law Studies

International humanitarian law is lauded as a civilizing force that seeks to limit the effects of war for humanitarian reasons. There is, however, an increasing sense that IHL has facilitated rather than restrained military operations by conferring undue legitimacy on violence in war. This article focuses on the nature of the relationship between legitimacy and IHL to ascertain whether this is indeed the case. It concludes that, while IHL alone cannot confer "normative legitimacy" on battlefield conduct, it does frame "empirical legitimacy." According to the US Census Bureau, 90% of businesses in the U.S. are family-owned or controlled. Unfortunately, the succession rates for family-owned businesses are dismal. Only 30% survive a transfer from the founder to a child and only 11% survive a second transfer to the third generation. Two major factors that contribute to this are lack of succession planning and failure to deal with family conflict, both of which are management failures and are often intertwined. Church music leaders in the United States pursue two priorities: technical accuracy and fluency in the music-making of their church ensembles, and, including as many volunteers as possible in those same ensembles. At times, the prioritization of technical competence and inclusion conflict, because volunteers whose playing or singing is less than competent seek to be included in church music groups. Contesting Paul Scharre’s influential vision of “centaur warfighting” and the idea that autonomous weapon systems will replace human warfighters, this article proposes that the manned-unmanned teams of the future are more likely to be minotaurs, teams of humans under the control, supervision, or command of artificial intelligence. It examines the likely composition of the future force and prompts a necessary conversation about the ethical issues raised by minotaur warfighting.

This mixed-method study surveyed and interviewed 60 High Income Country (HIC) US citizens/immigrants and Low-to-Middle-Income-Country (LMIC) citizens of African heritage on their perceptions of mental health services in African communities for implementation and research planning. In this study, ethics was a core emergent theme for global health initiatives and challenges, including political will for ethical change, community gatekeepers, level of government involvement, community-wide participation, public-private sector collaboration, health literacy and education, transparency, continuous monitoring, and consequences for ethical infractions.
