Presidential Succession And Inability: Before And After The Twenty-Fifth Amendment, John D. Feerick

Fordham Law Review

The Framers of the Constitution did not spend a great deal of time on the succession provisions, but just enough to get the nation started. The Twenty-Fifth Amendment answered questions they left open in the area of presidential inability and gave further significance to the Vice Presidency, which had been adopted almost as an afterthought. As strong as the system of presidential succession may appear, complacency can easily set in, leading to an unwillingness to confront gaps and defects that reveal themselves along the way.

Objective: Patients commonly have impaired arm trunk coordination following a stroke. The trunk compensation often used by stroke patients may hinder recovery of the affected arm. Given that the extent to which constraint-induced therapy (CIT) affects arm-trunk coordination has not been investigated previously, this study examines how distributed CIT (dCIT) affects arm trunk coordination and trunk compensation strategy, as well as functional performance and quality of life.Materials and Methods: Sixteen participants (at least 6 months post-onset) after stroke were randomly assigned to either the dCIT group which received training 2 hours daily for 3 weeks, with the unaffected arm restrained …

Background: The latency of the P300 component of the event related-potential (ERP) is an index of stimulus classification speed. In this study, we assessed the mental chronometry of stimulus discrimination and decision execution by study the effect of congruence visual stimuli and and compatibility on ERP and reaction time.Methods: The reaction time was divided into two sections based on the peak amplitude of P300. Neuromyelitis optica is a rare demyelinating disease. Radicular pain as the initial presentation of monophasic neuromyelitis optica has not been previously reported. We present a case of monophasic neuromyelitis optica in a 69-year-old female who suffered 1 year (from 2004/6 to 2005/5) from back pain that radiated to the lower extremities. Fifth lumbar radiculopathy was the first diagnosis. Despite treatment with laser discectomy on 2005/2/15, her pain, lower extremity weakness, and bilateral visual acuity worsened. Three weeks after surgery, she came to our hospital for help and was admitted for evaluation. The diagnosis of neuromyelitis optica was confirmed later. Prednisolone …

Sporadic heterotopic ossification is a common complication in patients with spinal cord injury, traumatic brain injury, electrical burns, hip fracture, elbow fracture or total hip arthroplasty. However, multiple heterotopic ossifications in a traumatic brain injury case are quite rare. We report a case of a 23 year-old female patient with traumatic brain injury and a right femoral open fracture due to a traffic accident. She started to develop local erythema, swelling, warmth and pain over the left elbow and right hip about two months after the accident. Objectives: To better understand the current utilization of rehabilitation services and to project future trends, this study investigated the primary reasons for rehabilitation services referrals in a medical center in Taiwan. Methods: We reviewarticleed records of those patients who visited rehabilitation clinics (4,305 new and 12,163 returned patients) or received a rehabilitation consultation during their hospital stay (1,345 patients) between June and October 2007 at the National Taiwan University Hospital. In this article, we introduce the Michigan State University (MSU) School of Agrifood Governance and Technoscience. Centered on the work of Dr. Lawrence Busch, the MSU School examines how science, the market, and the state function in food and agriculture, and possibilities to make these institutions more democratic, equitable, and just. Research by the MSU School consists of four specific foci: (1) actor-network theory and commodity studies, (2) standards, (3) third-party certification and tripartite standards regimes, and (4) supermarkets and supply chain management. The last several centuries have been marked first by a tendency toward the use of standards to standardize, and then by the use of standards to differentiate. Both have been built on the legal edifice of the state. More recently, in response to the rapid rise of neoliberalism, standardized differentiation has increased in scope and has become part of a larger Tripartite Standards Regime (TSR) consisting of standards, certifications, and accreditations. With neoliberal reforms and economic globalization, much of the regulation of food and agriculture is shifting from the state to the private sphere. Building on Busch’s work on science, the state, and the market, this paper examines the ways in which the governance of food and agriculture has become increasingly scientized with the use of third-party certification (TPC). TPC is a rule-based governance mechanism that consists of technical rules and procedures, which are based on scientific norms and practices. A Note On The Economy Of Qualities: Attributing Production Practices To Agricultural Practices, B. James Deaton, Lawrence Busch, Warren J. Samuels, Paul B. Thompson

Agricultural products are valued for many attributes including those that describe production practices. These production attributes are established through public and private efforts to promulgate standards and labels that differentiate products based on labor treatment, environmental impact, animal welfare, and other practices that occur during production. Organizations, like third-party certifiers, coordinate information and give credence to products in a way that enables consumers to differentiate products by production practices. Libertarian and utilitarian arguments may be used in the normative debate surrounding the appropriate role of government in sponsoring standards and labels that inform consumers about the modes of production.

Speech sound errors have been noted as the most common speech disorder among children. However, recent studies about pronunciation errors among preschool children are lacking. Our aim was to evaluate the characteristics and frequency of pronunciation errors among pre-school children with phonological disorder in Taiwan. Between December 2006 and November 2008, we recruited children visiting our outpatient department for evaluation of speech sound errors. Children with speech delay, hearing loss, mental retardation, orofacial abnormalities, chromosomal abnormalities and other pervasive developmental disorders identified by clinical evaluation and clinical birth histories acquired from their families were excluded. We report an unusual case of a 13-year-old boy with moyamoya disease whose predominant manifestation was right hemichorea with initial dystonic spasms of the right limbs and face. A diffusion-weighted MR image of the brain in the initial stage showed no infarcted or other parenchymal lesions. However, MR angiography and intracranial angiography showed stenosis of the bilateral internal carotid and middle cerebral artery with prominent basal collaterals, which was compatible with moyamoya disease. Chorea or hemichorea is one of the rarer presenting features of moyamoya disease. Our findings suggest that moyamoya disease should be included in the differential diagnosis of …

Work related cumulative posterior interosseous neuropathy is a rare cumulative trauma disorder. To the best of our knowledge, a locksmith with this kind of disorder has never been reported. The locksmith was a 57-year-old man, and he had to perform repeated supination and pronation movements when working. He complained of weakness of right third and fourth finger extension when typing on a computer keyboard. Radial deviation was also noted when his wrist was extended. Papillary thyroid carcinoma is a type of well-differentiated thyroid cancer. This type of cancer is often diagnosed in patients found with palpable neck mass or lymph node enlargement. The clinical characteristics of papillary thyroid carcinoma are slow disease progression, less tendency for distant metastasis, and better prognosis than other types of thyroid cancer. The diagnosis of thyroid cancer is primarily based on the identification of pathological tissue obtained through echo-guide fine needle aspiration biopsy. Polyethylene is an important component of a knee prosthesis, but wear of this material is one of the most frequent complications following total knee arthroplasty. Diagnosis of polyethylene wear is based mainly on history, physical examination, and plain radiographs. Hirayama disease is a rare disease with unique clinical manifestations. It was first reported by Japanese physician Keizo Hirayama, and tends to develop in young people in their teens and early twenties, predominantly in men. The lower cervical spinal anterior horn cells are usually involved, resulting in asymmetric muscular atrophy or weakness of distal upper extremity. The onset is insidious and gradual. Background: Vitamin B12 deficiency may be associated with variable neurological involvement, and myelopathy is the most common disorder associated with this deficiency. However, initial presentation with autonomic dysfunction is very rare.Case: The present report describes the case of a 76-year-old man who initially presented with recurrent syncope, followed by impaired vibration and proprioception, and then progressive weakness of the limbs. Result: The findings of a hematological study, blood biochemistry, gastric biopsy by panendoscopy, and electrophysiological examinations all supported the diagnosis of chronic atrophic gastritis-related vitamin B12 deficiency associated with macrocytic anemia, myelopathy, peripheral neuropathy, and autonomic dysfunction. Ultrasound imaging provides a unique and complete representation of tongue structure in almost all planes of interest and is rapid enough to record real-time tongue movement during speech. Recording tongue movement with ultrasound is non-invasive, and has not been shown to have any biologic effects in humans at diagnostic intensities. Myeloid sarcoma (MS) is a rare disease. MS is a malignant solid tumor resulting from the extramedullary proliferation of myeloblasts or immature myeloid cells.It is often described in association with acute myeloid leukemia (AML). In the absence of overt leukemia, MS is rarely considered in the differential diagnosis of a soft-tissue mass, and the diagnosis of MS is usually delayed or misdiagnosed. Penelitian ini bertujuan mengetahui bias item tes keterampilan proses sains pola divergen dan modifikasinya sebagai tes kreativitas biologi SMA untuk assessment for learning. Penelitian menggunakan intrumen keterampilan proses sains pola divergen untuk biologi SMA (Bambang Subali, 2009). Dua dari enam instrumen pengukur keterampilan proses sains tersebut dimodifikasi menjadi instrumen pengukur kreativitas keterampilan proses sains dan diujikan pada 1095 peserta didik. Penskoran dalam skala politomus dan dianalisis menurut Partial Credit Model 1-PL dengan program QUEST. Analisis bias didasarkan faktor gender, lokasi, dan jenjang kelas. In 2006, an outbreak of E. coli O157:H7 associated with California spinach resulted in widespread illness across the United States. The magnitude of the outbreak and the resulting media attention demanded a change in the governance of leafy green produce. Drawing from more than 130 personal interviews, this paper critically examines how powerful players in the produce industry organized a strategic approach to governing leafy greens production in California. Agrifood scholars working within a political economy framework increasingly draw upon the concept of governance to analyze the regulation of global agricultural and food systems. An important limitation of this approach is that it fails to explain how governance strategies are legitimated. Merging theories of performativity with Global Value Chains (GVC) analysis, I explore how standards are used within GVCs to govern interactions among actors and to perform a multiplicity of ‘sustainabilities.’ Specifically, this paper presents four case studies of certified tea production in Tanzania (i.e., the Ethical Tea Partnership, Fairtrade, Organic, and Rainforest Alliance) to reveal how visions of sustainability are enacted by different actors in each certified value chain.
