Illegal, Unreported, and Unregulated (IUU) fishing is widely recognised as a transdisciplinary problem requiring holistic action at the international, regional and national level. The primary aim of the CAPFISH Project is to build capacity to address IUU fishing in developing states, by providing knowledge and tools to government actors on the front line of the fight against IUU fishing. Since the initiation of CAPFISH in 2021, the Project has offered four capacity-building workshops on IUU fishing. Much of the content of the first two workshops was captured in the first edition of this series. The second edition consolidates and expands …

Criminal groups quickly recognized that controlling large swaths of land and illicit and legitimate enterprises linked to illegal gold mining in the Peruvian Amazon enabled them to generate larger profit margins with fewer risks due to the lack of a government law enforcement presence. Gold constitutes an ideal medium for criminal groups to launder proceeds obtained from other illegal activities. Compared to other natural resources and illicit goods, gold is valuable by volume. Also, COVID-19 is not only having an impact on the global economy and surging unemployment. It is driving gold prices to historical record highs since 2012, leading …

Brazil is witnessing a “tussle for the Amazon”—a new and deadly phase in the history of its organized crime groups and their operations. While the country is no stranger to violent criminal organizations, recent years have seen groups building increasingly sophisticated networks, both within and beyond Brazil’s borders. In the strategic state of Amazonas, these developments have sparked a power struggle between several of the country’s largest criminal organizations that has concerning implications for the stability of Brazil as a whole. Often viewed through a myopic lens as an environmental issue or one relegated to fisheries authorities, illegal, unreported, and unregulated (IUU) fishing affects all coastal nations in the Western Hemisphere and has national security implications on the United States. A regional problem requires a regional solution and greater cooperation across agencies, private industry, and governments. Actions to address IUU fishing in Latin America have the potential to achieve greater aims of maritime security in the region. The economic and political environments in Latin America have been advantageous for local, regional, and transnational threat networks. Specifically, technology, increased international trade and economic interdependence, heightened interest in natural resources for profit, synthetic drug production, economic disparities, corruption, impunity, and unstable political conditions have led to a complex web of opportunities that requires new, progressive ways to address criminal activities. The creativity of threat networks along with their entrepreneurial strategies have resulted in increasing power and influence. This article examines the environment-related provisions of the Trans-Pacific Partnership Agreement (TPP) to assess how and how much they contribute to a larger megaregulatory program for the Asia-Pacific region. The TPP calls for ‘high levels’ of environmental protection and effective enforcement; incorporates duties from several multilateral environmental agreements; adds new provisions addressing several important environmental problems; mandates administrative best practices; promotes corporate social responsibility and the use of voluntary certification systems; and …

Over the past three decades Brazil has greatly improved its ability to monitor and control its long border. Achieving better management of the complex frontier security problem required a great deal of patience, trial and error, organizational adaptation, and good leadership. The Brazilian experience yields a number of important lessons for Brazil and for its neighbors in the Western Hemisphere. Improving performance required subordination of military priorities to civilian authorities; the repositioning of forces; better military-police cooperation; interagency and international cooperation; investment in technologies to give Brazil an advantage in the contest for best situational awareness; a long-term commitment; and …

Up in the Air: A Global Estimate of Non-Violent Drone Use 2009-2015
The use of unmanned aerial vehicles (UAVs), or drones, has increased dramatically in recent years. While most attention has gone to military drone use, commercial drones have gained widespread popularity, with uses ranging from leisure activities by hobbyists to humanitarian aid and disaster relief support by non-governmental organizations (NGOs) and activist groups. This use has been hard to quantify and regulate.
In an effort to better understand the rapid growth of non-weaponized drone, this report analyzes cases of worldwide drone use reported during a six-year period (2009-2015). Utilizing a combination of qualitative and quantitative methods, we engage two distinct research …

The grant provided funds for the Schaffer Library at Union College to arrange, describe, and make accessible the archives of citizen activists John S. Apperson, Jr. and Paul Schaefer, whose work is featured in the exhibit. The roots of our national wilderness system, signed into law as the 1964 Wilderness Act by President Lyndon Johnson, run deep in the Adirondacks. The 12,000 kilometers of international boundaries within the Amazon’s lowland rainforest biome form the axis of a borderland region shared by the nine states of Amazonia (Figure 1). These Amazon borderlands contain high concentrations of conservation units and indigenous territories to preserve the transboundary region’s rich ecological and cultural diversity (Figures 2 & 3). However, this biocultural diversity is increasingly threatened by advancing development frontiers and a growing global demand for Amazonian resources.

A healthy Latin America is of critical value to the United States as a global power. It is besieged by a powerful force of resentment engendered by a combination of weak states, social exclusion, criminal violence, and corruption. In the context of attack by radical populism against democratic values, the United States needs a new grand strategy that addresses the causes rather than the symptoms of the malaise. The author argues that such a strategy must strengthen the effectiveness of the democratic state in providing security, justice, and governance, as well as effectively engender a linkage of the 40 percent …

Published as Chapter 7 in Law and Legalization in Transnational Relations, Christian Brütsch & Dirk Lehmkuhl, eds.
This paper analyzes several emerging transnational regulatory systems that engage, but are not centered on state legal systems. Driven primarily by civil society organizations, the new regulatory systems use conventional technical standard setting and certification techniques to establish market-leveraged, social and environmental regulatory programs. These programs resemble state regulatory programs in many important respects, and are increasingly legalized. Individual sectors generally have multiple regulatory programs that compete with, but also mimic and reinforce each other. While forestry is the most developed example, similar …
