The Interactive Dynamics Of Transnational Business Governance: A Challenge For Transnational Legal Theory, Stepan Wood, Kenneth W. Abbott, Julia Black, Burkard Eberlein, Errol E. Meidinger
Journal Articles
Conflict, convergence, cooperation, competition and other interactions among governance actors and institutions have long fascinated scholars of transnational law, yet transnational legal theorists’ accounts of such interactions are for the most part tentative, incomplete and unsystematic. Having elsewhere proposed an overarching conceptual framework for the study of transnational business governance interactions (TBGI), in this article we propose criteria for middle-range theory-building. We argue that a portfolio of theoretical perspectives on transnational governance interactions should account for the multiplicity of interacting entities and scales of interaction; the co-evolution of social agency and structure; the multiple components of regulatory governance; the role …

Increased Minimum Toe Clearance Variability In Patients With Peripheral Arterial Disease, Troy Rand, Shane R. Wurdeman, Jason M. Johanning, Iraklis Pipinos, Sara A. Myers
Journal Articles
Individuals with peripheral arterial disease (PAD) report difficulty walking and experience 73% more falls than their healthy counterparts, but no studies have investigated functional mechanisms contributing to increased falls. Minimum toe clearance (MTC) is the minimum vertical distance between the toe of the swinging leg and the walking surface when the leg is swinging, and decreased values are associated with an increased risk for falls. This study is the first such analysis in patients with PAD. Eighteen individuals with PAD and eighteen healthy controls walked on a treadmill before and after the onset of claudication pain. Mean MTC and the …

Step Activity And Stride-To-Stride Fluctuations Are Negatively Correlated In Individuals With Transtibial Amputation, Jenny A. Kent, Nicholas Stergiou, Shane Wurdeman
Journal Articles
Background
Variability occurs naturally from stride to stride in healthy gait. It has been shown that individuals with lower limb loss have significantly increased stride-to-stride fluctuations during walking. This is considered indicative of movement disorganization and is associated with less healthy movement. Given that lower limb prosthesis users perform on average less physical activity than able bodied individuals, the purpose of this study was to determine whether increased fluctuations also correspond to a reduced level of activity in daily life.
Methods
Twenty-two transtibial amputees wore an activity monitor (Actigraph, Pensacola, FL, USA) for 3 weeks. Lower limb kinematics during treadmill …

Human locomotor adaptation requires feedback and feed-forward control processes to maintain an appropriate walking pattern. Adaptation may require the use of visual and proprioceptive input to decode altered movement dynamics and generate an appropriate response. After a person transfers from an extreme sensory environment and back, as astronauts do when they return from spaceflight, the prolonged period required for re-adaptation can pose a significant burden. In our previous paper, we showed that plantar tactile vibration during a split-belt adaptation task did not interfere with the treadmill adaptation however, larger overground transfer effects with a slower decay resulted. Such effects, in …

Bivalve aquaculture relies on naturally occurring phytoplankton, zooplankton, and detritus as food sources, thereby avoiding external nutrient inputs that are commonly associated with finfish aquaculture. High filtration rates and concentrated bivalve biomass within aquacul- ture operations, however, result in intense biodeposition of particulate organic matter (POM) on surrounding sediments, with potential adverse environmental impacts. Estimating the net deposi- tional flux is difficult in shallow waters due to methodological constraints and dynamic processes such as resuspension and advection. In this study, we combined sediment trap deployments with simulations from a mechanistic sediment flux model to estimate seasonal POM deposition, resus- pension, …
Mixed Weibull Distribution Model Of Dc Dielectric Breakdowns With Dual Defect Modes, Allen Andersen, Jr Dennison
Mixed Weibull Distribution Model Of Dc Dielectric Breakdowns With Dual Defect Modes, Allen Andersen, Jr Dennison
Journal Articles
This work provides physical insight into common statistical models for DC dielectric breakdown field strengths. Voltage step-up tests were performed on low density polyethylene films. The merits of generalizations to widely-used empirical Weibull models are discussed. The cumulative probability distributions of the breakdown fields were fit to standard two- and three-parameter Weibull distributions. Mixed two-parameter Weibull distributions, sometimes used in the literature to model multiple breakdown modes, were found to yield the best fits to the data. In addition, the same data were fit to a physically-motivated dual-defect mean field model incorporating both low- and high-energy defect modes with different …

BACKGROUND: Convention dictates that an axillary view be obtained when evaluating proximal humerus fractures (PHF). However, the axillary view is frequently omitted because of pain and technical considerations. Furthermore, its diagnostic utility is unclear in this setting.
QUESTIONS/PURPOSES: The purpose of this study was to (1) determine the rate of obtaining an adequate axillary X-ray and complete shoulder series at a level I trauma center, (2) understand the cost of ordering and attempting an axillary radiograph, and (3) determine if axillary radiographs influence the management of PHF.
PATIENTS AND METHODS: PHF treated between 2009 and 2011 that were ordered for …

We systematically reviewed the literature to estimate the incubation and latent periods of Ebola virus disease. We found limited epidemiological data from individuals with discrete 1-day exposures. Available data suggest that the incubation and latent periods may differ, and mathematical models may be improved by distinguishing between the two periods.

Pope Francis, Environmental Anthropologist, John Copeland Nagle
Journal Articles
In June 2015, after much anticipation and a few leaks, Pope Francis released his encyclical entitled “Laudato Si’: On Care for Our Common Home. “Laudato si’” means “praise be to you,” a phrase that appears repeatedly in Saint Francis’ Canticle of the Sun poem. The encyclical itself has been widely praised and widely reported, far more than one would expect from an explicitly religious document. The encyclical is breathtakingly ambitious. Much of it is addressed to “every person living on this planet,” while specific parts speak to Catholics and others to religious believers generally. It surveys a sweeping range of …
Pre-Breakdown Arcing As A Proxy For Dc Dielectric Breakdown Testing Of Polymeric Insulators, Allen Andersen, Jr Dennison
Pre-Breakdown Arcing As A Proxy For Dc Dielectric Breakdown Testing Of Polymeric Insulators, Allen Andersen, Jr Dennison
Journal Articles
Pre-breakdown arcing is proposed as a key indicator of DC breakdown properties of polymeric dielectric materials. Voltage step-up tests were performed for films of low-density polyethylene (LDPE) at ramp rates significantly lower than is common in most studies, allowing for the observation of both breakdown and transient pre-breakdown current spikes. The distributions of the breakdowns versus applied field were compared with the more frequent pre-breakdown arcs. A strong correlation was observed for LDPE between the distribution of breakdowns in step-up tests and the distribution of pre-breakdown arcing. Pre-breakdown arcing distributions are much easier to obtain than breakdown distributions and may …

Locomotor Sensory Organization Test: How Sensory Conflict Affects The Temporal Structure Of Sway Variability During Gait, Jung Hung Chien, Mukul Mukherjee, Ka-Chun Siu, Nikolaos Stergiou
Journal Articles
When maintaining postural stability temporally under increased sensory conflict, a more rigid response is used where the available degrees of freedom are essentially frozen. The current study investigated if such a strategy is also utilized during more dynamic situations of postural control as is the case with walking. This study attempted to answer this question by using the Locomotor Sensory Organization Test (LSOT). This apparatus incorporates SOT inspired perturbations of the visual and the somatosensory system. Ten healthy young adults performed the six conditions of the traditional SOT and the corresponding six conditions on the LSOT. The temporal structure of …

Journal Articles
Lion-tailed macaques are generally considered to have more despotic than egalitarian dominance relationships; however, research lacks any conclusive evidence. In the present study, we examined dominance relationships among the females (of which the genealogical relationships were known) of a captive female-only group of lion-tailed macaques (Macaca silenus) during the course of introduction of a new adult male to the group at the Wels Zoo, Wels, Austria. We determined the structure of dominance hierarchy and the corresponding changes in dominance relationships, possibly mediated by an increase in sexual competition among the females. When the females were housed together without any adult …

On The Nature Of Experience In The Education Of Prospective Teachers: A Philosophical Problem, Christi U. Edge
Journal Articles
In this exploratory paper, the author argues that a core, ontological assumption—the nature of experience—could be a part of the enduring problem in preparing prospective teachers. The paper begins by identifying contrasting perspectives of teaching as simple versus teaching as complex in order to illuminate how perspectives relate to a construction of reality. Positioning this literature review as creative inquiry, the author first identifies seventeen assumptions related to the preparation of teachers in the United States and analyzes the constructs of place, purposes, practice, and the nature of field experiences. Finally, the author asserts that the foundation for the purposes …

How To Sync To The Beat Of A Persistent Fractal Metronome Without Falling Off The Treadmill?, Melvyn Roerdink, Andreas Daffertshofer, Vivien Marmelat, Peter J. Beek
Journal Articles
In rehabilitation, rhythmic acoustic cues are often used to improve gait. However, stride-time fluctuations become anti-persistent with such pacing, thereby deviating from the characteristic persistent long-range correlations in stride times of self-paced walking healthy adults. Recent studies therefore experimented with metronomes with persistence in interbeat intervals and successfully evoked persistent stride-time fluctuations. The objective of this study was to examine how participants couple their gait to a persistent metronome, evoking persistently longer or shorter stride times over multiple consecutive strides, without wandering off the treadmill. Twelve healthy participants walked on a treadmill in self-paced, isochronously paced and non-isochronously paced conditions, …
Hyperlegality And Heightened Surveillance: The Case Of Threatened Species Lists, Irus Braverman
Hyperlegality And Heightened Surveillance: The Case Of Threatened Species Lists, Irus Braverman
Journal Articles
My contribution to the Debate "Thinking about Law and Surveillance" focuses on the project of governing nonhuman species through care, briefly pointing to how law and surveillance are interwoven in this context and to how conservation's biopolitical regimes are increasingly becoming more abstract, standardized, calculable, and algorithmic in scope. I argue that conservation’s focus on governing through care lends itself to heightened modes of surveillance and to hyperlegality - namely, to the intensified inspection and regulation of both governed and governing actors. I start with some preliminary explanations about my atypical use of the terms surveillance, law, and biopolitics.

Patterns of human locomotion are highly adaptive and flexible and depend on the environmental context. Locomotor adaptation requires the use of multisensory information to perceive altered environmental dynamics and generate an appropriate movement pattern. In this study, we investigated the use of multisensory information during locomotor learning. Proprioceptive perturbations were induced by vibrating tactors, placed bilaterally over the plantar surfaces. Under these altered sensory conditions, participants were asked to perform a split-belt locomotor task representative of motor learning. Twenty healthy young participants were separated into two groups: no-tactors (NT) and tactors (TC). All participants performed an overground walking trial, followed …

The Hughes Court Docket Books: The Early Terms, 1929-1933, Barry Cushman
Journal Articles
For many years, the docket books kept by a number of the Hughes Court Justices have been held by the Office of the Curator of the Supreme Court. Yet the existence of these docket books was not widely known, and access to them was highly restricted. In April of 2014, however, the Court adopted new guidelines designed to increase access to the docket books for researchers. This article offers a report and analysis based on a review of all of the docket books that the Curator’s Office holds for the early Hughes Court, comprising the 1929-1933 Terms. Only one of …
How To Kill A Zombie: Strategies For Dealing With The Aftermath Of The Foreclosure Crisis, Judith Fox
How To Kill A Zombie: Strategies For Dealing With The Aftermath Of The Foreclosure Crisis, Judith Fox
Journal Articles
The foreclosure crisis which began in 2008 is old news; or is it? A lot of attention has been paid to the plight of homeowners struggling to save their homes from foreclosure. Legislative and regulatory changes have made it easier for homeowners to navigate the loss mitigation process. A significant number of people, however, did not try to save their homes. In fact, some actively tried unsuccessfully to give the homes back to their lender. These abandoned homes and abandoned foreclosures have become zombie mortgages. This is the legacy of this crisis.
The existence of these homes is well documented …
Sustaining Neighborhoods Of Choice: From Land Bank(Ing) To Land Trust(Ing), James J. Kelly Jr.
Sustaining Neighborhoods Of Choice: From Land Bank(Ing) To Land Trust(Ing), James J. Kelly Jr.
Journal Articles
This essay is based on my closing presentation at the Washburn Law Journal's 2015 symposium entitled “The Future of Housing -- Equity, Stability and Sustainability.” It explores how land banks and land trusts promote social goods, including socioeconomic integration, by connecting with and shielding against, respectively, market forces. Both engage in stewardship of land. Land banks take temporary ownership of vacant, abandoned properties in order to make them available for productive use. Land trusts hold land indefinitely to ensure a social purpose is met. Community land trusts hold land for a purpose that is responsive to the human environment, often …
Substantive Parenting Arrangements In The Usa: Unpacking The Policy Choices, Margaret Brinig
Substantive Parenting Arrangements In The Usa: Unpacking The Policy Choices, Margaret Brinig
Journal Articles
Policy makers in the US currently debate whether to keep discretionary child custody standards, that is, “best interests of the child” clarified by some factors, or to move to a more rule-based system, such as a presumptive shared parenting regime. This article briefly sets out the problem, theoretical and evidence-based ways of approaching it, and some new results from a study of court documents from one US state indicating that a strong presumption of shared custody is associated with an increase in post-decree domestic violence. While presumptions or de facto rules should facilitate bargaining, these results may tip the balance …

In a previous paper, Review of habitat dependent impacts of mobile and static fishing gears that interact with the sea bed (2014) we offered definitions for benthic habitat, fishing gear and fisheries management and a way of thinking about the challenge of understanding best practices for measuring, monitoring, managing and mitigating benthic impacts of fishing in the context of the MSC’s certification requirements. These informed our review in the previous paper’s classification of habitats and fishing gears and helped us highlight likely variations in benthic impact depending on habitat and gear used (Grieve, Brady & Polet, 2014). In this paper, …

Old Suburbs Meets New Urbanism, Nicole Stelle Garnett
Journal Articles
This essay examines the growing popularity among inner ring suburban communities of new urbanist regulatory tools, including transect zoning and form-based codes. Given the demographic realities facing these communities, the essay raises concerns about the temptation to use legal regulation to "upscale" older suburbs and argues for more-organic, deregulatory approaches to redevelopment. The essay will be included in an edited volume entitled Infinite Suburbia (Alan Berger and Joel Kotkin, eds.).

An optimal level of variability enables us to interact adaptively and safely to a continuously changing environment, where often our movements must be adjusted in a matter of milliseconds. A large body of research exists that demonstrates natural variability in healthy gait (along with variability in other, healthy biological signals such as heart rate) and a loss of this variability in aging and injury, as well as in a variety of neurodegenerative and physiological disorders. We submit that this field of research is now in pressing need of an innovative “next step” that goes beyond the many descriptive studies that …

Anglo-American jurisprudence, before it insulated itself in conceptual analysis and defined itself in opposition to broader questions, was properly a “sociable science,” to use Professor Postema’s phrase from his symposium article. And, in part due to the exemplars of history, so it may become again. By drawing on Bentham and Hobbes, Professor Dan Priel’s Toward Classical Positivism points forward toward more fruitful methods of jurisprudence while illuminating the recent history and current state of inquiry. His article demonstrates the virtues and promise of a more catholic approach to jurisprudence. It also raises challenging questions about the direction to take this …
