Described as the crisis of our generation, the coronavirus pandemic has had a profound effect on consumption behaviour, in turn devastating businesses globally. Marking a departure from the sanctity of contract and causing perceived incursions to accrued legal rights, the Coronavirus Act 2020 and related legislation provide business tenancies protection, among others, against forfeiture for non-payment of rent. While this regulation of commercial tenancies appears to be justified on the basis of pragmatic utility, I suggest that Honoré’s incident of ownership prohibiting harmful use also allows for these emergency laws to be vindicated from a property perspective. This provides an …

Don’t blame the technology. COVID-19 control technology depends on the cooperation of people to be fully effective, says SMU Professor Mark Findlay. Singapore has one of the best subscribed COVID-19 tracing, tracking and safe entry apps worldwide. Then how is it that we are back to Phase 2 (Heightened Alert)? It would be tempting but wrong to blame the technology as being insufficiently intrusive or robust. A look at the recent outbreak suggests we should avoid an over-reliance on tech solutions when incompatible human behaviours are at work.

In this commentary, the author opined that even as political competition in Singapore sharpens, a deeper understanding and broader consensus must develop on critical issues. He believes that remaking Singapore to be a fairer, more just, and compassionate society in a post-Covid world is a key responsibility for Parliament.

In a commentary, SMU Associate Professor of Law Eugene Tan opined that “a total of 13 ministries having new ministers in two Cabinet reshuffles within a span of nine months is significant” and “these significant moves underscore not only the urgency of leadership renewal and succession, but also the need for certainty and confidence as Singapore transitions to the 4G leadership which will coincide with the post-Covid era”. He highlighted the need for a strong, cohesive leadership to emerge from the Cabinet reshuffle amid these exceptional times, as he believes that “a leadership that can galvanise the people will enable …

The authorities previously assured citizens that the TT data "will only be used for contact tracing", but subsequently indicated that the data may be used for criminal investigations. TT is the vital tool in our fight against the pandemic as it helps with contact tracing. It is in the government's interest to ensure optimal usage of TT. Some are now feeling that the government has "betrayed" their trust, so public confidence in using TraceTogether must be restored.

In a matter of months, the emergence and spread of the coronavirus has massively disrupted and radically changed life, causing untold suffering and staggering losses. It will be some time before the pandemic ends and the world returns to normal or, more likely, move to a new normal. Since the beginning of 2020, health authorities and governments worldwide have devoted huge amounts of resources studying the science surrounding the coronavirus – its origin, spread, mutation, symptoms, treatment, containment and the like – and taking regulatory action to manage the crisis. The outbreak of the virus and the attendant governmental measures …

Singaporeans went to the polls on July 10 amid an unprecedented set of public health and safety precautionary measures put in place to prevent the spread of Covid-19 infections. Among other things, GE2020 would also be remembered for long queues at some polling stations and the less than positive voter experience. There was also the first-ever extension of polling hours nationwide by two hours to 10pm.

In more ways than one, the five-year term of Singapore’s 14th Parliament has been and will be defined even before it begins. How this institution of the people’s representatives leads the nation amid the raging Covid-19 global pandemic and positions Singapore for the post-Covid world matters immensely.

The controversial legal theorist Carl Schmitt’s challenge to the possibility of meaningful legal constraint on executive power in emergencies could not be more relevant in a world struggling to deal with Covid-19. Scrambling against time, governments around the world have declared states of emergency and exercised a swathe of broad executive powers in an effort to manage this highly infectious disease. In times like these, if Schmitt is indeed right that emergencies cannot be governed by law, we are on the cusp of (or perhaps have already entered) a post-law world – where the business of government is characterised by …

After the outbreak of the coronavirus (COVID-19), the Singapore Government responded with a quick and comprehensive package of legal, economic and financial measures that sought to put the economy into hibernation and avoid the destruction of jobs and viable businesses, at least while companies were unable to generate revenues and cash-flows due to a variety of factors, including travel restrictions and lockdowns imposed in many countries around the world. To that end, the Government spent SGD$97.3 billion (that is, around 20% of the country’s GDP) to support businesses, households and employees. Most of this financial support was given in the …

The international spread of the coronavirus is not only generating dramatic consequences from a social perspective but it is also heavily affecting the global economy. For this reason, governments, financial regulators and international organizations are responding to this pandemic with a package of legal, economic and financial reforms. Among the legal measures included in these packages of reforms, many countries, including Australia, Germany, Spain, India, Singapore, the United Kingdom and the United States, have proposed or implemented several changes to their insolvency frameworks.

The Covid-19 outbreak has placed significant and urgent demands on Budget 2020 that will be unveiled on Tuesday (Feb 18). The Government has given a strong affirmation that the Budget will be equal to the task and that it will reinforce the “never fear” spirit that Singapore and Singaporeans will need to adopt to come out stronger of this challenging period.
