Join us for the first session in the Purposes of Incarceration series as we explore the historical and present-day framing of incarceration. We will examine how retribution and deterrence have shaped the criminal justice system through statistics, context, and discussion, and consider when punishment crosses the line from justice into systemic harm.

Human Rights And Foreign Policy: South Africa's Genocide Complaint Against Israel At The International Court Of Justice, Penelope Andrews
Articles & Chapters
On December 21st, 2023 the South African Government filed an urgent application to the International Court of Justice (ICJ) in the wake of Israel's military activities in Gaza in response to the attack in Israel on October 7th in which more than 1,200 Israeli citizens were killed and several hundred were taken as hostages. The Israeli government responded to the attacks and the taking of hostages by launching a military campaign into Gaza, with the express purpose of destroying Hamas and especially its ability to attack Israel in the way that it did on October 7th. The first few days …

Can Prosecutors' Offices Preserve Public Confidence In Their Nonpartisanship - And, If So, How?, Rebecca Roiphe, Bruce Green
Can Prosecutors' Offices Preserve Public Confidence In Their Nonpartisanship - And, If So, How?, Rebecca Roiphe, Bruce Green
Articles & Chapters
Politicians, the media, and others erode public confidence in prosecutors by accusing them of “weaponizing” their power in cases with political implications. This essay argues that prosecutors’ offices have a responsibility not only to do their work in accordance with professional norms, training and policy that call for nonpartisan decision-making, but also to make affirmative efforts to restore and preserve public faith that prosecutors are in fact acting neutrally, objectively and impartially. Despite limits to what prosecutors’ offices can do in the current climate, this essay suggests some possible measures to counteract the perception of political bias.

Prosecutorial Reform And The Myth Of Individualized Enforcement, Justin Murray
Prosecutorial Reform And The Myth Of Individualized Enforcement, Justin Murray
Articles & Chapters
The American prosecutor’s legitimacy faces unprecedented challenges. A new wave of reformist prosecutors has risen to power promising to transform the criminal justice system from within, sparking fierce backlash from defenders of the prosecutorial status quo. Central to this conflict is a debate over the nature of prosecutorial discretion, influenced by a set of claims and assumptions that this Article terms the myth of individualized enforcement. This myth posits that prosecutors base discretionary decisions on case-specific facts and equitable circumstances rather than generalizable criteria or categorical nonenforcement practices, such as the policies some reformist prosecutors have adopted that disfavor prosecuting …

The Nyc Office Of Administrative Trials And Hearings: Forty-Five Years Of Delivering Impartial Adjudications And Providing Access To Justice, Asim Rehman
Articles & Chapters
It was an honor to deliver the 2024 Uri and Caroline Bauer Memorial Lecture at the Benjamin N. Cardozo School of Law, and to follow in the footsteps of the many legal luminaries who have delivered this lecture before.1 Given their chosen professions, it may be fair to assume that Uri Bauer was a believer in the rule of law and Caroline Bauer was a believer in government. Accordingly, I would like to talk about those two topics as they relate to the work of the New York City Office of Administrative Trials & Hearings (OATH). First, after a general …
