The Behaviour Of Family Lawyers And The Implications For Legal Education, John H. Wade Dec 2017

The Behaviour Of Family Lawyers And The Implications For Legal Education, John H. Wade

John Wade

Legal educators have often developed courses with the purported goal of teaching students to “think like lawyers.” Yet little is known about the ways various classes of lawyers think or behave. This paper offers some insights through anecdotal observations of the behaviour of family lawyers in Sydney. It must be conceded, however, that even beginning to demystify lawyerly behaviour does little to resolve current debates about the goals and methods of legal education.

Building Positive Relationships Through Team Building, Paul Parker Dec 2017

Building Positive Relationships Through Team Building, Paul Parker

Georgia Association for Positive Behavior Support Conference

It is vital for us in the education profession to develop leaders. It is my belief that we have to prepare our young people for the challenges and demands they will inevitably face in today’s society. Our students must be equipped with the knowledge and character needed to run Fortune 500 companies, teach the future generation of scholars, and lead this nation back to its worldwide power. In order for that to happen, they need great models. Our youth have to have the best teachers that we can offer. Based upon my experience, I can assist with the selection and …

Reflecting On Performance Feedback: The Effect Of Counterfactual Thinking On Individual Learning, Kelly R. Hall, Neal P. Mero, Robin Cheramie Nov 2017

Reflecting On Performance Feedback: The Effect Of Counterfactual Thinking On Individual Learning, Kelly R. Hall, Neal P. Mero, Robin Cheramie

(HIDDEN) Management & Entrepreneurship Faculty Publications

Despite the importance of performance feedback for employee learning, research suggests that when that feedback conveys a performance discrepancy, subsequent performance does not improve. Researchers have found support for the value of encouraging individual reflection to increase feedback effectiveness and for subsequent learning and performance improvement. However, these studies have not accounted for the effects of specific types of reflection on performance. Our research examines the role of counterfactual thinking, a form of reflection, for learning following a performance discrepancy. We explore boundary conditions that might influence self-focused upward counterfactual thinking–reflection particularly important for learning and performance improvement–and examine whether …

The questions that chemical oceanographers prioritize over the coming decades, and the methods we use to address these questions, will define our field's contribution to 21st century science. In recognition of this, the U.S. National Science Foundation and National Oceanic and Atmospheric Administration galvanized a community effort (the Chemical Oceanography MEeting: A BOttom-up Approach to Research Directions, or COME ABOARD) to synthesize bottom-up perspectives on selected areas of research in Chemical Oceanography. Representing only a small subset of the community, COME ABOARD participants did not attempt to identify targeted research directions for the field. Instead, we focused on how best …

Change In Police Organizations: Perceptions, Experiences, And The Failure To Launch, Joseph A. Schafer, Sean P. Varano Nov 2017

Change In Police Organizations: Perceptions, Experiences, And The Failure To Launch, Joseph A. Schafer, Sean P. Varano

Arts & Sciences Faculty Publications

Studies and accounts of change in police organizations frequently emphasize case studies of specific efforts enacted during relatively discrete periods of time in one or a few agencies. The narratives often emphasize the success of change efforts or seek to explain why initiatives failed in the case study agency. While instructive, such accounts do not provide broader insights into successes and failures with change across longer periods of time, differing types of change, and diverse organizational contexts. Using survey data from mid-career police supervisors attending the FBI National Academy program, this study considers change experiences. In particular, consideration is given …

Invisible Outsiders: Developing A Working Alliance With Appalachian Clients, Jake J. Protivna, Cassandra G. Pusateri, Matthew J. Paylo, Kyoung Mi Choi Sep 2017

Invisible Outsiders: Developing A Working Alliance With Appalachian Clients, Jake J. Protivna, Cassandra G. Pusateri, Matthew J. Paylo, Kyoung Mi Choi

ETSU Faculty Works

Appalachian clients are often ‘invisible’ within the majority culture and possess characteristics unique to the region that must be considered within the counseling relationship (Tang & Russ, 2007). Individuals in Appalachia have higher incidences of certain mental health disorders and substance use as compared to the national average (Appalachian Regional Commission [ARC], 2008). Although the need for mental health services is evident, limited research exists to inform mental health professionals how to deliver culturally competent interventions to build a working alliance with Appalachian clients. The authors will discuss a framework for mental health professionals to develop a strong working alliance …

The Integration Of Erm And Strategy: Implications For Corporate Governance, Therese R. Viscelli, Dana R. Hermanson, Mark S. Beasley

Accountancy Faculty Publications

Since the early 2000s, expectations have increased for organizations to strengthen corporate governance with enterprise risk management (ERM) processes, with the accounting profession playing a major role in these efforts. The ultimate goal of an effective ERM process is to help boards and senior executives to manage risks in the context of strategy so that the organization is more likely to achieve its key objectives. We conduct semi-structured interviews of 15 ERM champions to provide insights about whether the ERM process is integrated with the strategic-planning and execution processes of the firm. We find that while the decision to launch …

The Dilemma Of Defining Academic Quality, Norman L. Jones, Linda George Apr 2017

The Dilemma Of Defining Academic Quality, Norman L. Jones, Linda George

History Faculty Publications

Academic quality is part of virtually every university strategic plan as well as the central focus of accreditation standards. In the past, this has often been defined by a series of input measures such as the percentage of faculty with terminal degrees. Today, the call is to identify outcome measures – but which ones? This session will discuss how institutions and systems can define and be held accountable for academic quality in a sea of uncertainty with multiple constituents, and the role of the provost in meeting that challenge.

Unique Characteristics Of Predator Frauds, Dana R. Hermanson, Scot E. Justicce, Sridhar Ramamoorti, Richard A. Riley Jr Apr 2017

Unique Characteristics Of Predator Frauds, Dana R. Hermanson, Scot E. Justicce, Sridhar Ramamoorti, Richard A. Riley Jr

Accountancy Faculty Publications

Previous research has called for examination of differences in the fraud profile between “predator” fraudsters (repeat offenders) and “situational” fraudsters (first-time offenders). Using data from nearly 2,800 fraud cases included in the Association of Certified Fraud Examiners' Report to the Nations database, we identify unique characteristics of predator frauds. In the primary analysis, we find that predator fraudsters are less likely to be in leadership positions, are less educated, and tend to target smaller companies, while appearing less likely to target public companies. Predator frauds are shorter, but more costly overall, and there is some evidence that predator frauds are …

Institutional Review Board: Ally Not Adversary, Melanie M. Domenech-Rodriguez, Samantha M. Corralejo, Nicole Vouvalis, Alan K. Mirly

Institutional Review Boards (IRBs) were developed in response to a historically demonstrated need for ethical guidance and accountability in research with human subjects. The inhumane and unethical treatment of prisoners of war and underrepresented populations in the pre-IRB era are the antithesis of today’s national and international acts, codes, and declarations. Over the last five decades of IRB-reviewed research, several concerns about the IRB process have been raised. In this editorial, we review common concerns regarding the scope and functioning of IRBs. We also review the updated federal Common Rule, effective January 2018, and discuss how some of the reviewed …

This article, collaboratively written by the presidents of the National Latina/o Psychological Association (NLPA), presents leadership as conceptualized and practiced in NLPA. We first identify key leadership constructs in the available literature as well as relevant cultural values, describe liderazgo (leadership) through cultural lenses, and articulate the connections to counseling psychology and the social justice underpinnings that have guided NLPA’s formation and development. We then present a number of events and decisions to illustrate how we have operationalized these organizing principles in both the daily management and long-term goals of NLPA. We conclude with a discussion of the future paths …

Research Data Sets

Geospatial tools have become a critical component to most wildlife studies and management questions. With a diversity of approaches available, current and future wildlife professionals deserve guidance on the most important tools to answer these questions. Younger professionals may be expected to know a separate set of skills from those required further on in their career. We conducted an online survey and a year-long search of job advertisements to identify the most important geospatial approaches, techniques, programs, and ancillary skills for wildlife professionals. We provide the results of these 2 efforts so that wildlife professionals interested in geospatial tools can …

A Learning Style Comparison Between Synchronous Online And Face-To-Face Engineering Graphics Instruction, Wade H. Goodridge, Oenardi Lawanto, Harry B. Santoso

Engineering Education Faculty Publications

The implementation of a successful engineering program to a synchronous online curriculum is subject to many impacting factors. One such factor, that has not seen much investigation, concerns learning styles. Student learning styles may have a dramatic influence on the success of a synchronous online deliverable engineering graphics curriculum. The immediate objective of this research was to look at the effectiveness of teaching Engineering Graphics with a synchronous online delivery method and to compare it to a more traditional face-to-face delivery method. Using Kolb’s learning style inventory, student learning styles in both educational settings were investigated and analyzed to discover …
