Guilty Property: A Qualitative Analysis Of Civil Forfeiture, Brian Johnson, Greg Warchol

The objective of this article is to explore how property seized under the federal civil-judicial forfeiture laws for drug law violations is proceeded against by the government. The methodology is primarily exploratory. A sample of federal civil-judicial drug forfeiture cases is described and then analyzed in regard to the relative importance of the cases’ characteristics. The findings raise serious questions about the use of this policy and the government’s intent behind forfeiture. Implications and suggestions for future research are also presented.

The success of a Scottish team in cloning a mammal from an adult tissue cell has generated considerable speculation in the popular press about potential applications to conservation biology. Possibilities that have been mentioned include cloning endangered species and creating gene banks for the germplasm of rare species. Sensational or inaccurate reports might encourage the mistaken notion that cloning technology is more advanced or reliable than it actually is. More important, such reports might foster the myth that there is no longer an urgency to conserve endangered species or their habitats as long as we have frozen germplasm and cloning …

PURPOSE: To identify prognostic or treatment factors influencing the response of superior vena cava obstruction (SVCO), time to SVCO recurrence, and overall survival of SCLC patients with SVCO at presentation; and to assess the role of retreatment in patients with SVCO at recurrent or persistent disease. METHODS AND MATERIALS: Between January 1983 and November 1993, 76 consecutive patients who had small-cell lung cancer (SCLC) with SVCO were treated in our institution. The Trans-Pecos Closed Basin is a hydrographically closed region covering 20,000 km centered on Salt Basin, 160 km east of El Paso, Texas. Geomorphic and limnetic evidence have been used to identify four major highstands for Lake King during the last glacial maximum (LGM). Additional geomorphic features from a second, recently identified, paleolake, Lake Sacramento, have been found in the Beargrass subbasin, a nested subbasin approximately 75 km northwest of Salt Basin. Radiocarbon ages of the organic material in Lake King sediments date four abrupt climate changes and rapid lacustrine transgressions during the LGM with a quasi-periodicity of 2000 yr. …

Procedures for the selection of subjects for participation in randomized clinical trials--usually formalized as eligibility criteria in the study protocol--have both scientific and ethical implications. In this thesis, I undertake an examination of eligibility criteria at three stages in the genesis and dissemination of medical knowledge: clinical trial protocol, interpretation by investigators, and reporting of study results.

Investigators sometimes find that their obligations with respect to a research project come into conflict with their obligations to individual patients. The ethical conduct of research rests on 3 guiding principles: respect for persons, beneficience, and justice. Respect for persons underlies the duty to obtain informed consent from study participants. Beneficence demands a favourable balance between the potential benefits and harms of participation. Justice requires that vulnerable people not be exploited and that eligible candidates who may benefit from participation not be excluded without good cause. Studies must …

Extensive new data on the odd-parity, single-colour, two-photon optogalvanic spectra of argon in the visible region is reported using an excimer-pumped dye laser in conjunction with an argon discharge cell. Purpose: Different radiotherapy fractionation schedules were used over a 10-year period to treat patients with early squamous cell carcinoma of the vocal cords at McGill University. A retrospective analysis was performed to study the effect of fraction size on local control in this group of patients. Methods and materials: A total of 126 previously untreated patients with T1 invasive squamous cell carcinoma of the true vocal cords were irradiated between January 1978 and December 1988 in the Department of Radiation Oncology at McGill University. Many endohedral metallofullerenes have a C82 cage surrounding the metals, even though the normal arc-vaporization method of fullerene preparation does not generate C82 in significant abundance.1-10Manolopous et al.11-13attribute the low abundance of empty-cage C82 to the unfavorable electron configuration of this species. Consequently, the prevalence of C82 in metallofullerenes may be the result of an electron transfer from the encapsulated metal atoms to the fullerene cage.10-13 The extent of this charge transfer also contributes to the properties (e.g. catalytic, superconductive, nonlinear optical, and ferromagnetic) that are attributed to the endohedral metallofullerenes.14,15Because of the importance of the charge transfer reaction, characterization …

To investigate the extent and size of root-soil air gaps that develop during soil drying, resin casts of roots of the desert succulent Agave deserti Engelm. were made in situ for container-grown plants and in the field. Plants that were droughted in containers for 7 and 14 d had 24 and 34% root shrinkage, respectively, leading to root-soil air gaps that would reduce the hydraulic conductivity at the root-soil interface by a factor of about 5. When containers were vibrated during drought, root-soil air gaps were greatly diminished, and the predicted conductivity at the interface was similar to that of …
