Houve tempo em que a Constituição servia para poisar ou charuto ou tirar um argumento político, como ironicamente afirmaria o grande escritor oitocentista Eça de Queiroz. Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

The trafficking of women has been a lucrative moneymaker for transnational organized crime networks, ranking third, behind drugs and arms, in criminal earnings. The U.S. military bases in South Korea were found to form a hub for the transnational trafficking of women from the Asia Pacific and Eurasia to South Korea and the United States. Transformation Of Japan’S Civil Society Landscape, Mary Alice Haddad

Japan’s civil society is being transformed as more people volunteer for advocacy and professional nonprofit organizations. In the American context, this trend has been accompanied by a decline in participation in traditional organizations. Does the rise in new types of nonprofit groups herald a decline of traditional volunteering in Japan? This article argues that while changes in civil rights, political opportunity structure, and technology have also taken place in Japan, they have contributed to the rise of new groups without causing traditional organizations to decline, because Japanese attitudes about civic responsibility have continued to support traditional volunteering.

Recognized as a principal figure in ecological anthropology, Roy Rappaport is best known for his studyPigs for the Ancestors(1968). His work in the anthropology of religion has received less attention. Least acknowledged is Rappaport’s role in defining an “engaged” anthropology. Drawn from interviews Tom Fricke conducted with Rappaport in the year before his death in October 1997, this article gives insight into these three facets of his professional life. Studies have examined the impact of environmental variables on academic achievement among student athletes in the revenue-generating sports of men’s basketball and football. However, while evidence concerning the positive impact of male student athlete and faculty interaction is virtually unequivocal, we are not certain whether the benefits accruing from particular types of interaction vary across different racial/ethnic groups. This study explores the relationship between male Black and White student athletes and faculty as well as the impact of specific forms of student athlete– faculty interaction on academic achievement. The paper describes the history of the public library in Santa Barbara from 1870 to 1926 while taking into account two of the thematic underpinnings of the American library tradition: women in the profession and the importance of books and libraries in the community. It is divided into three sections including, the importance of books and libraries, women librarianship, and the history of the Santa Barbara Public Library. This paper discusses the annual Elvis Revival Festival in the small town of Parkes, 350 km to the west of Sydney, in rural Australia. It explores the way in which a remote place with few economic prospects has created a tourism product, and subsequently captured national publicity, through a festival based around commemoration of the birthday of Elvis Presley, a performer who had never visited Australia, and certainly not Parkes. The abuse of methamphetamine ( or meth) is dramatically evident in the "before and after" faces of meth arrestees. Yet these pictures provide only a glimpse of the larger personal, environmental, and community fallout from methamphetamine use and production, an issue that barely existed 15 years ago in rural America, but has since grown into a large more serious problem.

Contrary to the forecasts of the scholarship on immigrant transnationalism, foreigners continue to get transformed into nationals. Engaging in the necessary adjustments is often acceptable to the people earlier willing to abandon home in search of the good life; the everyday demands of fitting in, as well as the attenuation of home country loyalties and ties, make the foreigners and their descendants increasingly similar to the nationals whose community they have joined. But the ex-foreigners also respond to the message conveyed by nationals and state institutions, all of which signal that acceptance is contingent on demonstrating a commitment to belonging. …

The Domestic Violence Experiences Of Women In Community Corrections, Rachel Bridges Whaley, Angela M. Moe, J. Mark Eddy, Jean Daugherty

A variety of studies indicate high rates of domestic violence in the backgrounds of women offenders. We examine and extend this work through a qualitative study of women on probation or parole in a western U.S. county. In-depth interviews were conducted with 14 women who participated in a larger study in which only questionnaire data were collected. Participants completed a brief telephone interview about prior experiences of partner violence and then a face-to-face extensive in-person interview. In the analyses, several notable themes emerged regarding the women's histories of child victimization, partner abuse, substance abuse, coercion into crime, and a lack …

“Utilization And Cost Of Mental Health, Substance Abuse, And Medical Services Among At-Risk Drinkers, Michael T. French, Paul J. Nieter, Joann E. Kirchne, Brenda M. Booth

The objective of this research was to examine whether users of mental health or substance abuse (MH/SA) services incurred greater costs for non-MH/SA services than nonusers of MH/SA services. Two years of health care utilization data were collected on 443 at-risk drinkers from six southern U.S. states. We then examined predictors of using MH/SA services and costs associated with non-MH/SA services. The results showed that use of MH/SA services was associated with female gender, military service, health insurance, and not being employed full-time. Unadjusted analyses indicated that non-MH/SA service costs were significantly higher among MH/SA service users than nonusers. However, …

Research on the "new second generation" takes the success of the earlier second generation of southern and eastern Europeans as its point of departure, but with little empirical basis. The hypothesis of "segmented assimilation" asserts that the children of 1880-1920 immigration moved ahead due to the availability of well-paying, relatively low-skilled jobs in manufacturing. By contrast, defenders of the conventional approach to assimilation accent diffusionary processes, while conceding that the specific means by which the children of immigrants improved on their parents' condition remains a matter about which relatively little is known.
