South African President Mandela addressed his words to the leaders of political parties in Northern Ireland, including David Trimble and Martin McGuinness, at De Hoop, a secured conference facility in Arniston, a small town in the Western Cape. The Eastern Cape Province of South Africa struggles with high poverty, poor public infrastructure, and dysfunctional administrative systems. One result is that the Eastern Cape has the worst health outcomes in the country. This case study illustrates how a South African civil society organization has used its budgetary analysis to advocate for improvements in health service delivery.

Formed in 2008, the Social Justice Coalition (SJC) is a coalition of civil society organisations in the informal settlement of Khayelitsha in Cape Town, South Africa. In response to reports from residents about the inadequate and unsafe conditions of sanitation facilities in the settlement, the SJC therefore launched the Clean and Safe Sanitation Campaign in 2010. The campaign aimed to ensure that the City Council properly maintained existing toilets and also provided additional clean and safe sanitation facilities in informal settlements. SJC’s campaign had several concrete achievements, such as the City’s introduction of a janitorial service for regular maintenance of …

The Legal Resources Centre (LRC) is a South African nonprofit human rights organisation that conducts public interest litigation. In response to the South African government’s delays to remove mud schools in the Eastern Cape Province, LRC took the government to court in August 2010. As a result of the mounting legal pressures, in January 2011 the Eastern Cape Department of Education signed an agreement with LRC. According to the agreement, the national government would introduce a new three-year grant to address infrastructure backlogs, of which Eastern Cape would receive 78 percent of the total. In The Face Of Crisis: The Treatment Action Campaign Fights Government Inertia With Budget Advocacy And Litigation, Neil Overy, International Budget Partnership

At the turn of the millennium the South African government allocated a total of R214 million (US$28.5 million) to the fight against HIV/AIDS, an epidemic that had reached crisis proportions. Less than 10 years later this figure has risen, in inflation-adjusted terms, to R3.96 billion (US$528 million), a real increase of over 1,850 percent. This study looks at how a civil society organization’s ongoing campaigns for treatment access that combined negotiations with the government, mass mobilization of its members (including civil disobedience campaigns), and litigation contributed to this increase.

South Africa: Civil Society Uses Budget Analysis And Advocacy To Improve The Lives Of Poor Children, Neil Overy, International Budget Partnership

In South Africa a range of civil society organizations and coalitions have been central to post-Apartheid efforts to protect vulnerable children through social security grants. This case study describes how the persistent campaigning of these organizations has contributed to significant budget and policy changes over the last decade such as the expanded eligibility for the Child Support Grant.

Judgments Of The United States Supreme Court And The South African Constitutional Court As A Basis For A Universal Method To Resolve Conflicts Between Fundamental Rights, Daniel H. Erskine

This article describes the methods utilized by the United States Supreme Court to resolve specific cases involving conflicts between federal constitutional rights, a federal constitutional right and a state constitutional or statutory right, and an international treaty right and a federal constitutional right. Consideration of particular decisions representative of the manner the Court resolves conflicts between rights in the three typologies described above, illustrates how the Court views such conflicts and the rationales employed to resolve apparent conflicting rights.
