The skills and processes of ADR are indeed more broadly dispersed throughout society. Over the past decade, ADR and Conflict Resolution (CR) concepts and skills have been added to the core curricula and continuing education trainings in most fields, from law and medicine to engineering, education, and business management. The term “mediation” is rarely confused with “meditation” as it once was. Increasingly, terms like “mediation”, “arbitration”, and “ombudsman” are used in the media without the need to define them for the general public. This article will explore the question of creeping legalism in mediation of statutory disputes arising out of employment. First, it will briefly review the issue of creeping legalism in arbitration. Second, it will introduce dispute systems design (DSD). Third, it will review the analogous debate on legalism in mediation in three design contexts: evaluative mediation of employment disputes in the court-connected setting, grievance mediation embedded in the collective bargaining agreement, and transformative mediation of employment disputes in the United States Postal Service's (USPS's) REDRESS program. The Sustainable Groundwater Management Act (SGMA), passed in 2014, is changing the way California manages its groundwater resources. SGMA calls for the creation of local Groundwater Sustainability Agencies (GSAs) and tasks them with developing and implementing Groundwater Sustainability Plans (GSPs) to achieve sustainable groundwater management. SGMA offers GSAs a broad palette of tools to choose from and significant flexibility to tailor their management activities to local conditions and needs. Because it allows GSAs to assign groundwater extraction allocations to pumpers and to authorize transfers of these allocations under certain circumstances, SGMA potentially opens the door for the development of local …

Diasporas are fluid cultural constructs that foster identity, community, and connections over time, distance, and social space. This study explores a derivative secondary diaspora to illustrate how and why diasporas are interesting social phenomena established out of complex socio-cultural, economic, and political conditions. Outside of the large Cape Verdean diaspora of New England, relatively little is known about other U.S. Cape Verdean communities. How do they maintain ties to both the primary diaspora in New England and their Cape Verdean homeland? On January 23, 2012, Resolution No. 3 enacted the National Immigration Strategy for the island nation of Cabo Verde, the first of its kind in the country. As a buffer nation to Western Europe with a rapidly developing economy and good governance indicators, Cabo Verde is transitioning from a sending and transit country to a receiving nation for African mainlanders, especially from Guinea-Bissau. This article both acknowledges and celebrates the role of women in re-making the nation of Guinea-Bissau. A gendered perspective and historical and multi-scalar framing demonstrates that women have played integral roles in nation-building over time and space in Guinea-Bissau. How have the women of Guinea-Bissau fashioned their agency? Where are the new forms of agency for women in Guinea-Bissau? Drawing on both ethnographic and historical accounts, this paper describes how ethnic identification patterns of belonging are fashioned out of localized, national, regional, and global processes of both engagement and protectionism. The Bijagos of Guinea-Bissau have maintained a sense of group cohesion during periods of contact, conflict, and resistance. This paper argues that the contemporary local-global interplay is fostering a new moment of rupture in time and space for the Bijagos. The Bijagos, oft footnoted in the accounts of Bissau-Guinean culture and history, are actively contributing to the social dialogue of resistance against the homogenizing effects of globalization. Neoliberal values are dramatically affecting higher education in the United States, with a focus on running these institutions as businesses and molding students into productive workers. This shift toward training and away from traditional liberal arts education at U.S. universities and colleges has occurred even as studies demonstrate that the ability to adapt in a rapidly evolving marketplace promotes long-term professional success. While neoliberalism and traditional liberal arts education are often seen as antithetical, we show how one anthropology program has combined these values into pedagogical practice through a select subset of high impact practices to improve academic outcomes for …

This article, which examines epidemiological and policy correlates of homeless populations in 351 Massachusetts towns and cities, is based on an analysis of data from the 1990 U.S. census. It reviews the reliability of the most recent census data, reports findings on the distribution and characteristics of homeless persons in Massachusetts, and presents preliminary correlational findings on the impact of key demographic conditions and policies.
The report includes a meta-analysis of several studies that monitored the Census Bureaus street counts. It is estimated that 42.6 percent of the homeless on the streets in selected urban areas were counted by the …

The use of movies provides educators with a valuable tool for presenting information as learners are able to benefit from the powerful images being presented before them. The purpose of this study was to identify the value of the use of movies as a teaching tool. This was an exploratory study aimed at identifying characteristics of movie use as an educational device in recreation, parks, and tourism classes. In this study, respondents (n = 67) indicated that the use of movies in the classroom was supported, and the findings of this study suggest that most instructors provided advance preparation activities …
