The Right To Privacy And Data Protection In Times Of Armed Conflict, Asaf Lubin, Russell Buchan Jan 2022

The Right To Privacy And Data Protection In Times Of Armed Conflict, Asaf Lubin, Russell Buchan

Books & Book Chapters by Maurer Faculty

Contemporary warfare yields a profound impact on the rights to privacy and data protection. Technological advances in the fields of electronic surveillance, predictive algorithms, big data analytics, user-generated evidence, artificial intelligence, cloud storage, facial recognition, and cryptography are redefining the scope, nature, and contours of military operations. Yet, international humanitarian law offers very few, if any, lex specialis rules for the lawful processing, analysis, dissemination, and retention of personal information. This edited anthology offers a pioneering account of the current and potential future application of digital rights in armed conflict.

The Culture Police: Manning The Barricades Of Allowable Art And Culture, Ramy Aly

Faculty Book Chapters

In this chapter I look at the history and ontology of censorship in Egypt from the Monarchical era to the present. I focus on the post-1952 era and how a tutelary state culture has been deployed as part of a broader cultural militarism. The chapter also covers the legislative architecture that has ensured a stranglehold on the part of syndicates and the creation of a broad range of crimes associated with art and culture production and exhibition.

U.S. competitors pursuing meaningful revision or rejection of the current U.S.-led status quo are employing a host of hybrid methods to advance and secure interests contrary to those of the United States. These challengers employ unique combinations of influence, intimidation, coercion, and aggression to incrementally crowd out effective resistance, establish local or regional advantage, and manipulate risk perceptions in their favor. So far, the United States has not come up with a coherent countervailing approach. It is in this “gray zone”—the awkward and uncomfortable space between traditional conceptions of war and peace—where the United States and its defense enterprise face …

Efficiency In Bello And Ad Bellum: Making The Use Of Force Too Easy?, Kenneth Anderson Jan 2012

Efficiency In Bello And Ad Bellum: Making The Use Of Force Too Easy?, Kenneth Anderson

Contributions to Books

This article criticizes a widely asserted claim that drones make the resort to force and violence — war — “too easy.” Attractive on the surface to many, this article says that “too easy” is not a coherent notion as applied in war. The “too easy” argument comes in two forms, a moral argument and a maximization of social welfare argument. The maximization of social welfare version (on which the article focuses) frames “too easy” as a matter of creating an “inefficient” level of disincentive to use of force on account of insufficient risks to one’s own forces in so doing …

Diplomats, Scientists, And Politicians: The United States And The Nuclear Test Ban Negotiations, Harold Karan Jacobson, Eric Stein

Michigan Legal Studies Series

This study began in 1961 as a limited attempt to assess the impact of science and modern technology on the negotiating process and concepts of international organization, using the test ban negotiations then in progress as a case study. When the Moscow Treaty was signed, however, it seemed wise to broaden the focus and to capture as many of the details as we could that might help to explain this first formal arms control agreement between East and West in the nuclear age. Our analysis is clearly not definitive, but hopefully, it will be a useful source, even after all …
