In its six decades of post-independence, Nigeria has experienced the best and worst in military and democratic governance fluctuating from one to the other. It has purportedly settled into a democracy but with highly flawed electoral processes. This paper interrogates the February 25, 2023 Presidential election with a view to assessing the perception of voters in the exercise to determine whether there has been an improvement or otherwise in the status quo of how previous elections were conducted. Contested Borders And National Identity In Southeast Asia: An Analysis Of Thailand– Cambodia Dispute Through Nontawat Numbenchapol’S Documentary Film, Boundary, Mirwan Andan

International Review of Humanities Studies

Southeast Asia remains a region marked by numerous interstate border disputes. Among these, the Thailand–Cambodia border dispute surrounding the Preah Vihear Temple, located between Sisaket Province in Thailand and Preah Vihear Province in Cambodia, represents one of the conflicts with the greatest potential to affect regional stability and harmony in the region. This dispute extends beyond questions of territorial sovereignty, encompassing the construction of national identity, historical memory, and the domestic political dynamics of both countries. The Algorithmic Collusion Problem: A Judicial Framework For Analyzing Algorithms Under § 1 Of The Sherman Act, Rix Ryskamp

Washington Journal of Law, Technology & Arts

Courts are increasingly seeing Sherman Act Section 1 claims that involve AI and other software algorithms at the center of alleged conspiracies to unreasonably restrain trade—often called algorithmic collusion claims. Adjudicating these claims can involve complex analyses of how algorithms interact with alleged conspiracies. However, most of the Section 1 case law stems from traditional agreements and can be hard to apply to algorithmic collusion scenarios. This Article provides a framework that judges and other adjudicators might use to analyze the role of an algorithm in an alleged conspiracy without becoming bogged down in technical details early in the case. …

A growing number of states have recently enacted new laws with the goal of protecting young people from potential harm allegedly caused by social media use. These laws are diverse in their approaches but broadly seek to limit youth access to social media platforms by imposing age verification and parental consent requirements. These laws directly implicate the First Amendment rights of both young users who will no longer be able to access speech or speak on social media platforms as well as adult users who must now submit to age verification to access these quintessential forums for political discourse.

From its campaign against anti-war protesters in World War I to the present, the government has tried to restrict the pure political speech of noncitizens, defined as noncitizens’ expression of views about the structure and policies of the U.S. government and governments of foreign nations. Threats to academic freedom are also a hallmark of government action in this domain. Taking a page from this book, the Trump administration has targeted noncitizen students who participated in campus protests against Israel’s military actions in Gaza after Hamas’s brutal attacks on October 7, 2023.

The United States copyright system has become increasingly complicated and has developed a bias toward written, notated mediums over performance mediums. This bias can be traced from the Statute of Anne through the modern system under the Copyright Act of 1976, and it directly affects jazz musicians' ability to comply with copyright laws and properly receive royalties for their work. Critical Geopolitics And The Reconstruction Of Meaning: A Discourse Analysis Of The 'Terrorism' Label Applied To Hamas By Western Hegemony, Cahaya Mulyani Sakti, M.Hamdan Basyar

Journal of Terrorism Studies

The emergence of Hamas in 1987 cannot be separated from the configuration of modern colonialism and the continuity of occupation that shaped the political reality. Hamas’s early phase was rooted in socio-religious activities through education and community empowerment programs, before evolving into armed resistance against the occupation. The labeling of Hamas as a “terrorist” organization began in the mid-1990s in U.S. legal documents, which subsequently generated debate and gave rise to counter-narratives. This study employs the frameworks of critical geopolitics (Ó Tuathail & Agnew) and the Discourse-Historical Approach (Wodak) to analyze the labeling of Hamas as “terrorist” by Western hegemony. …

As legal practitioners confront the potent impacts of society’s latest technological innovation, legal education can and should say “yes, and” to all the change and uncertainty by leaning into the teaching of human skills. That’s “yes, and,” as in the guiding principle of improvisational theater, or improv. This study examines how legal professionals describe their preparation for legal and law-adjacent careers, with the goal of identifying practical guidance for college students entering the field. Existing literature on legal career preparation often emphasizes measurable qualifications, while offering broad or generalized advice. This thesis explores the inspiration of adaptability skills, pivoting from television and film into theatre, and the potential of unconventional pathways as a catalyst for reconciling anti-traditionalism within the mediums. In this comment, the author argues that theatrical stage directions should be recognized as copyrightable material under the U.S. Copyright Act, primarily by categorizing them as "choreographic works". Sakin highlights that while the 1976 Copyright Act explicitly protects choreography and pantomimes, stage directions—which serve as the "blueprints" for a production's blocking, technical cues, and artistic mood—currently exist in a legal gray area. Based on the 1948 Convention, its legal framework rests on two constitutive elements, – material and mental – whose interaction determines the recognition of the crime. This is the first article to broadly explore the possibility of state copyrights and patents in AI-generated creations and what it could portend for the future of intellectual property law.

The U.S. Constitution delegates to Congress, via Article I, the power to pass laws “securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.” It reserves to the states or to the people, via the Tenth Amendment, certain unspecified powers not delegated to the federal government. New federal public access policies—mandated by the 2022 OSTP Memo and already adopted by several key federal grant-making agencies—require authors funded by federal grants to deposit peer-reviewed publications for immediate public access. This paper explains how grant- receiving institutions and their affiliated authors can dispel legal uncertainties and comply with the new public access policies. Section I delineates how valid prior licenses enable public deposit of manuscripts notwithstanding later publishing agreements transferring copyright to the journals. The practice of convoy involves the concentration of a group of merchant vessels under the control and direction of warships and military aircraft for the purpose of protecting it from belligerent capture or attack. The practice has often been described as obsolete, but asserting the demise of the convoy has been as regular as it has been premature. It is fitting that this operational practice be subject to an updated legal treatment and identification of new legal challenges. This Article examines the limitations of intellectual property law in the United States for fashion designers and their creations. In doing so, it considers the impact generative artificial intelligence technologies have had on such protections. Despite fashion’s cultural and economic significance, U.S. law offers only fragmented protection through copyrights, trademarks, trade dress, and patents. Copyright law is significantly constrained by the useful article doctrine and the separability requirement articulated in Star Athletica v. Varsity Brands. Thus, copyrights only protect separable artistic elements rather than garments as a whole. Trademark and trade dress protections are typically only effective for well-established brands, …
