Lawfare’S New Frontier: International Commercial Arbitration In The Shadow Of Sanctions, Sophie Yue Zhao, Han-Wei Liu Oct 2026

Lawfare’S New Frontier: International Commercial Arbitration In The Shadow Of Sanctions, Sophie Yue Zhao, Han-Wei Liu

Vanderbilt Journal of Transnational Law

This Article examines how international commercial arbitration is being reshaped by economic statecraft through the lens of lawfare—the strategic use of law as a substitute for traditional coercive tools. Building on Orde Kittrie’s framework, it identifies two modalities of State-driven lawfare affecting arbitration. Instrumental lawfare operates where domestic legal measures displace arbitral authority, exemplified by Russia’s assertion of exclusive jurisdiction over sanctions-related disputes. Compliance-leverage lawfare, by contrast, does not bar arbitration outright but raises the costs and risks of participation, evident in restrictions on legal services and banking access that complicate representation and payment in arbitral proceedings. Beyond State action, …

The End Of Unmeasured Exploitation: How A.S.M., C.A.S., And S.I.A. Challenge Digital Attention Capitalism, Delante Clark Oct 2026

The End Of Unmeasured Exploitation: How A.S.M., C.A.S., And S.I.A. Challenge Digital Attention Capitalism, Delante Clark

Graduate Scholarship and Creative Works

Digital attention capitalism generates value through the capture and monetization of human attention, yet it has historically lacked standardized mechanisms for measuring attention-related harm. This paper argues that the Attention Safeguard Models (A.S.M.), Cognitive Attentional Standards (C.A.S.), and Sociological Impact Assessment (S.I.A.) collectively challenge this system by introducing an integrated framework for classifying, measuring, and evaluating digital attention harm and its societal consequences. C.A.S. provides standardized measurement of digital attention harm, A.S.M. identifies and classifies patterns of attentional disruption and manipulation, and S.I.A. evaluates broader impacts on institutions, communities, civic engagement, education, social cohesion, and inequality. Together, these systems transform …

Marine Spatial Planning In The Asean Countries: Lesson Learned For Future Ocean Governance In Malaysia, Husni Alhan Md Salimun, Mohd Fadzil Akhir, Nazli Aziz, Che Din Mohd Safuan, Wan Izatul Asma Wan Talaat

Journal of Environmental Science and Sustainable Development

Marine Spatial Planning (MSP) has emerged as an important governance instrument for balancing ecological protection, economic development, and social inclusion amid the rapidly intensifying blue economy in Southeast Asia. Although several ASEAN Member States (AMS) have initiated MSP processes, the existing literature on MSP governance in this region  remains fragmented and largely descriptive, limiting systematic cross-country comparison and evidence-based lessons. This study addresses this gap by assessing MSP governance performance across ASEAN countries and againts internationally recognized MSP governance benchmarks. A structured narrative review was conducted using selected PRISMA-informed procedures for literature identification and screening. Academic publications from 2003 to …

Good Governance In The Concept Of Climate Justice: Decarbonisation Policies In Economic Considerations Of Losses And Sacrifices, Daryanti Daryanti, Albertus Sentot Sudarwanto, Erna Dyah Kusumawati, Rosita Candrakirana Oct 2026

Good Governance In The Concept Of Climate Justice: Decarbonisation Policies In Economic Considerations Of Losses And Sacrifices, Daryanti Daryanti, Albertus Sentot Sudarwanto, Erna Dyah Kusumawati, Rosita Candrakirana

Journal of Environmental Science and Sustainable Development

Projections of losses resulting from the impacts of climate change in Indonesia are estimated to reach USD 30.5 million, affecting four key sectors: agriculture, water supply, health, and the maritime sector. This study shows that good governance based on climate justice in the implementation of decarbonization policies is the most important factor in avoiding long-term economic losses caused by the adverse impacts of climate change or investing in climate resilience. This study employed a normative methodology using a statutory approach to examine efforts related to climate change mitigation and adaptation. The findings of this research indicate that regulations in Indonesia, …

How Legal Systems Reflect Societal Views Of Nature, Devorah Corvo Oct 2026

How Legal Systems Reflect Societal Views Of Nature, Devorah Corvo

Latin American & Caribbean Law Review

Pre-Columbine Indigenous communities differed from European settlers in many ways. One of the most striking differences was the way each group viewed itself in relation to nature and wildlife. Indigenous communities generally did not see themselves as separate from the natural world, while European settlers often viewed themselves as distinct from it. In the United States today, many people care about the environment but are unsure how to protect it. By contrast, pre-Columbian Indigenous communities were so deeply connected to their surroundings that harm to wildlife would have been seen as harm to the community itself. By examining three pre-Columbian …

The Silent Bench: How The Chilean Judiciary Failed To Check Pinochet's Executive Power And The Continued Struggle For Judicial Independence, Daniela González García Oct 2026

The Silent Bench: How The Chilean Judiciary Failed To Check Pinochet's Executive Power And The Continued Struggle For Judicial Independence, Daniela González García

Latin American & Caribbean Law Review

Although authoritarian regimes are often associated with lawlessness, many consolidate power through carefully crafted legal framework that create the illusion of illegality. Chile under Augusto Pinochet offers a critical case study of this phenomenon. In Chile, Pinochet ushered in his “authoritarian legality” after spearheading a military coup in 1973 that toppled a democratically elected left-wing government. Through Chile’s 1980 Constitution, drafted by hand-picked loyalists and approved in a tightly controlled setting, Pinochet’s regime embedded executive supremacy, restricted judicial review, and transformed Chile’s courts into a silent bench. Applying David S. Clark’s theory that judicial review must be evaluated within a …

The Colorado River Upper Initial Units Take Center Stage, Eric Kuhn, Anne Castle, Jack Schmidt, Kathryn Sorensen, Katherine Tara Oct 2026

The Colorado River Upper Initial Units Take Center Stage, Eric Kuhn, Anne Castle, Jack Schmidt, Kathryn Sorensen, Katherine Tara

The Traveling Wilburys of the Colorado River

In 1956, Congress authorized the Upper Initial Units—Flaming Gorge Reservoir,

Navajo Reservoir, and the Aspinall Unit (UIUs)—for a variety of water use

purposes in the Upper Colorado River Basin, including compliance with the

1922 Colorado River Compact (1922 Compact). The historical record is clear

that the primary reason these reservoirs exist is to satisfy the math of the 1922

Compact and the obligations it imposed on the Upper Division States

regarding flows at Lee Ferry.

Arbitration In Name Only, Myriam Gilles Oct 2026

Arbitration In Name Only, Myriam Gilles

Northwestern University Law Review

Modern arbitration clauses hide a dirty secret: many don’t actually provide for genuine arbitration. These provisions masquerade as mutual commitments to fair and efficient private dispute resolution but, in truth, are mere imitations of genuine arbitration provisions. Some reserve for the drafter the power to amend or terminate the clause at will without notice or consent; others design the arbitration process to ensure bias from the start; still others depart so radically from the bilateral, informal model blessed by the Supreme Court that they scarcely resemble arbitration at all. These arrangements are arbitration in name only, falling outside the Federal …

Fake News From Fake Dudes: Why State Statutes Regulating Political Deepfakes Are Both Necessary And Constitutional, Jay Kennedy Oct 2026

Fake News From Fake Dudes: Why State Statutes Regulating Political Deepfakes Are Both Necessary And Constitutional, Jay Kennedy

Northwestern University Law Review

As technology advances and more Americans use the internet to get their news, AI-generated “deepfakes” have become a powerful tool for misinformation. One common use of deepfakes is to make fake, but convincing, videos of electoral candidates or government officials. Deepfakes pose particular harm to local governments and officials because, unlike federal leaders, local leaders usually do not have the financial resources to fund the counterspeech sufficient to disprove deepfakes. Thus, to help defend the integrity of local governments, this Note argues that every state should enact legislation prohibiting deepfakes of public officials and proposes a First Amendment-compliant framework for …

Tech Oligarchs And Corporate Vigilantism, Joao Marinotti, Asaf Lubin Oct 2026

Tech Oligarchs And Corporate Vigilantism, Joao Marinotti, Asaf Lubin

Articles by Maurer Faculty

Big Tech’s unchecked power has evolved from a regulatory crisis into one concerning the rule of law itself. Shielded by the First Amendment, Section 230 of the 1996 Communications Decency Act, corporate law, and contract law, technology giants have circumvented traditional government oversight, amassing a level of power that eclipses even that of some sovereign states. No longer guided by cautious boards of directors, today’s tech empires are often ruled by impulsive billionaire CEOs, who, through a single policy change or algorithmic tweak, can upend individual rights, destabilize global markets, and erode democratic governance itself.

The scale of such dangers …

The Mirage Of Meta Pixel Code: Redefining Pii In The Era Of Generative Ai, Sophie Venter Oct 2026

The Mirage Of Meta Pixel Code: Redefining Pii In The Era Of Generative Ai, Sophie Venter

Fordham Law Review

Data privacy laws are intended to put consumers in control of whether their identifying data can be sold and used for targeted advertising. However, these laws do not provide adequate protections in the era of generative artificial intelligence (AI). This Note examines one way that existing privacy law permits companies to profit from selling data for targeted advertising without obtaining user consent: transferring video watching data in a pixel code. Some U.S. Courts of Appeals have determined that these data transfers do not sufficiently identify users and the videos they watched to constitute violations of user privacy. This has led …

Student Perceptions Of Artificial Intelligence-Generated Child Sexual Abuse Material: An Qualitative Content Analysis, Paige Horton, Amanda Isabel Osuna

Dignity: A Journal of Analysis of Exploitation and Violence

The rapid growth of artificial intelligence (AI), especially generative AI and deepfake technology, has introduced new challenges in the production and dissemination of child sexual abuse material (CSAM). While existing research has examined the technological and legal implications of AI-generated child sexual abuse material, less is known about how the public, especially young adults who are most likely to use AI technologies, perceive these developments. The present study addresses this gap by examining undergraduate student perceptions of AI-generated child sexual abuse material at a medium-sized private university in the Southeastern United States. Using data from a Qualtrics survey, this study …

Senate Bipartisan Permit Reform Bill Would Upend Many Environmental Laws, Michael B. Gerrard Oct 2026

Senate Bipartisan Permit Reform Bill Would Upend Many Environmental Laws, Michael B. Gerrard

Faculty Scholarship

On September 26, the Republican chairs and Democratic ranking members of two key Senate committees released the Bipartisan American Affordability and Jobs Act of 2026 (BAAJA). The full Senate is expected to take up the bill on November 9 (a week after the midterm elections). Its future in the House is uncertain.

The bill, the culmination of years of negotiations on permitting reform, is very good for the proponents of many kinds of energy projects (both clean and fossil), especially electricity transmission. It is very bad for environmental groups and other project opponents who want to challenge these projects in …

Jurnal Hukum & Pembangunan

The dual system model in the implementation of credit information in Indonesia makes the relationship between the Financial Services Authority (OJK) as a public credit registry and the Credit Information Management Institution (LPIP) as a private credit bureau interesting to observe. In particular, the relationship is related to access to the Financial Information Service System (SLIK), which is one of the data sources used by LPIP in carrying out its activities. This study aims to examine the implication of the principle of reciprocity in the exchange of credit information through SLIK, as well as the fairness aspect of the imposition …

Journal of Hate Studies

Philosopher Joan Braune reviews Ronald Beiner’s Radical Right Ideologues in the Age of Trump: Heralds of Nihilism, which examines how fascist ideologues such as Steve Bannon, Aleksandr Dugin, Jason Jorjani, and Costin Alamariu (known online as “Bronze Age Pervert”), invoke philosophers, including Plato, Nietzsche, and Heidegger, in their arguments. It also considers why traditional philosophy departments have hesitated to acknowledge the use of philosophers in right-wing movements and how Beiner manages the risk of validating fascism as intellectual by studying the topic.

Ensuring "The Right To Live In The World": The Right To Repair Powered Wheelchairs, Maximillian J. Grahl Sep 2026

Ensuring "The Right To Live In The World": The Right To Repair Powered Wheelchairs, Maximillian J. Grahl

Duke Law Journal

Twenty-seven years ago, in Olmstead v. L.C., the Supreme Court held that improperly institutionalizing people with disabilities is a form of unlawful discrimination. In doing so, the Court acknowledged that people with disabilities have a right to live free from confinement. Yet today, repair restrictions and outdated Medicare standards combine to threaten powered-wheelchair users' ability to live out in the world. Some states have responded by passing right-to-repair laws, which require powered-wheelchair manufacturers and suppliers to provide the resources necessary for more accessible and more timely repairs. This Note analyzes these state laws in the context of previous right-to …

Private Equity For All: The Paradoxical Push To Democratize Private Markets, William W. Clayton, Elisabeth De Fontenay Sep 2026

Private Equity For All: The Paradoxical Push To Democratize Private Markets, William W. Clayton, Elisabeth De Fontenay

Duke Law Journal

The recent push to open private equity and other private assets to retail investors represents one of the most profound changes to U.S. capital markets in decades. This "retailization" effort is often framed as an overdue democratization of superior investment opportunities. Indeed, private equity has long been viewed as special, both for its market-beating returns and its success in making companies more profitable. Yet it has historically been off-limits to retail investors.

This Article argues that the push to democratize private equity is subject to a glaring paradox: Expanding access to private equity undermines the very benefits that access aims …
