The Intersection Of Sport Betting And Consumer Behavior: A Systematic Review, Jackson Sears, Beth Cianfrone
UNLV Gaming Research & Review Journal
Sport betting is a popular and lucrative entertainment segment of the sport industry. As such, understanding consumer behavior across the betting experiences is critical for the many stakeholders involved. The current study is a systematic quantitative literature review which assesses the current state of literature that intersects sport betting and consumer behavior literature, specifically cognitive, affective, conative, and consumption behavior of the sport bettors. The purpose of the systematic review is to (1) identify the most recent sport betting consumer behavior research, (2) compile and examine theoretical frameworks guiding sport gambling consumer research, (3) provide a descriptive summary of findings …

Nil And Contract Law: Advising A Prospective College Athlete Through Competing Name, Image, And Likeness Agreements, Jason Kight, Marcy Faircloth, Lori Mikl, Rachel Silverman
The COSMA Journal
Name, Image, and Likeness (NIL) agreements have created significant financial opportunities for amateur and collegiate athletes while also introducing complex legal, ethical, and strategic decision-making challenges. This decision-focused teaching case places students in the role of trusted advisors to Archie Stafford, a highly recruited high school athlete who must evaluate and compare multiple NIL contract offers connected to his preferred college options. By analyzing NIL agreements, students assess contract enforceability, identify key legal and business risks, weigh legal, contractual, ethical, and reputational disclosure obligations, and formulate a reasoned recommendation aligned with Archie’s academic, athletic, financial, and long-term career goals. The …

Rewriting The Playbook: The X’S And O’S Of The House Settlement And The Future Of Student-Athletes’ Voice In Their Compensation, Matthew K.V. Glazer
Seattle University Law Review
Since the formation of the National Collegiate Athletic Association (NCAA) in the 1900s, collegiate athletes (student-athletes) have been prohibited from using their own name, image and likeness (NIL) for profit. But on July 1, 2021, the NCAA changed course and began allowing student-athletes to profit from their own NIL. In the past few years, U.S. college athletics have undergone significant changes, most notably introducing monetary compensation for student-athletes’ NIL. While these changes were long overdue and ultimately beneficial, they have significantly disrupted the landscape of college sports, giving rise to numerous challenges that some experts have compared to the “Wild …

Rewriting The Podium: An Evaluation Of The Court Of Arbitration For Sport’S Efficacy Through Olympic Medal Disputes, Sarah E. Smith
Senior Theses
International sport holds unique power and opportunity to unite the global population around a common entity. Large-scale international sporting events such as the Olympic Games and the World Cup maintain influence and importance across cultures and societies, and offer the world the opportunity to celebrate the tenacity, hard work and willpower of their fellow citizens. At the same time, they also provide the space for all of the world’s nations to engage with one another peacefully and constructively to build relations that extend far beyond the boundaries of a single competition. Therefore, an area of society which holds such clear …
Guarding The Game: Building A Defensive Line Between Athletes' Biometric Data And Gambling Interests, Caroline Hébert
Guarding The Game: Building A Defensive Line Between Athletes' Biometric Data And Gambling Interests, Caroline Hébert
The Journal of Business, Entrepreneurship & the Law
This comment examines the intersection of wearable technology, professional sports, and the burgeoning sports betting industry. Focusing primarily on the National Football League (NFL), the author explores how biometric markers such as heart rate, stress levels, and fatigue—originally intended for player health and performance—are increasingly targeted for commercialization in the gambling market. The comment provides a critical analysis of the current legal landscape, noting that existing frameworks like HIPAA and GINA, as well as current Collective Bargaining Agreements (CBAs), offer insufficient protections for athletes' sensitive personal data. Hébert identifies key points of exploitation by third-party vendors and highlights the conflicting …

Censorship And Human Rights Violations: The Suppression Of Freedom Of Expression, Press, And Assembly In Cuba, Nicaragua, And Venezuela, Elisabell Laura Velázquez
University of Miami Inter-American Law Review
As the days, months, and years go by, Cuba, Nicaragua, and Venezuela continue to violate the fundamental human rights of their citizens. Despite worldwide technological advancements and increased access to the digital world, these regimes continuously monitor and censor their citizens, depriving them of the fundamental rights to freedom of expression, press, and assembly. This article explores how censorship can represent a systemic violation of human rights. This article argues that strengthening cooperation between different international organizations is necessary because censorship in Cuba, Nicaragua, and Venezuela is a human rights crisis that impacts civil society. Furthermore, this article explains the …

Game Face: Legal Tackle On Facial Recognition And Privacy Rights At Nfl Games, Shanthi E. Senthe
Canadian Journal of Law and Technology
The unprecedented rapid uptake of facial recognition technology (‘‘FRT”) in commercial and public spaces for data capture and surveillance has entrenched every aspect of our daily lives from mundane tasks, such as grocery store shopping to family and experiential moments, such as participation in spectator sports. As such, the rapid adoption and integration of FRT into sports security is reshaping aspects of sporting events and fan experiences, often without adequate consideration of privacy and ethical implications. Professional sports leagues, specifically the NFL, are in the process of adopting the use of this type of technology to enhance security measures, streamlining …

From Amateurism To Open Markets: The Ncaa's Reckoning With Antitrust Lawsuits, Jesse Giffin
William & Mary Business Law Review
Throughout the 2000s the National College Athletic Association (NCAA) has been the subject of many high-profile antitrust lawsuits regarding the financial restrictions imposed on student athletes. The aftermath of some of the most recent decisions has given athletes new ways to earn compensation while competing in college athletics. In House v. NCAA, another historic antitrust lawsuit against the NCAA, the Court for the Northern District of California was tasked with deciding whether student athletes can be paid directly for their athletic performance. By comparing these NCAA antitrust lawsuits with other blockbuster antitrust cases such as the Microsoft antitrust case, …

The University of Tennessee Men’s Basketball team entered Week Ten of the 2024–25 college basketball season ranked number one in the country. The Southeastern Conference’s leading scorer going into Tennessee’s game against Texas that week was Tennessee’s Chaz Lanier. On the first play of the second half, Lanier launched a pass into Tennessee’s bench instead of taking an open jump shot. Rick Barnes, Tennessee’s head coach and one of the winningest coaches in college basketball history, immediately took Lanier out of the game. Barnes said in the post-game press conference, “[t]hat play was designed for that shot. I told him, …

Embodied Overcrowding And Sensory Tensions: A Carceral Autoethnography Of Philippine Jails, Dwayne Antojado
Embodied Overcrowding And Sensory Tensions: A Carceral Autoethnography Of Philippine Jails, Dwayne Antojado
Ateneo School of Government Publications
In this paper, I undertake a sensorially oriented autoethnography of two Philippine jails, illuminating the visceral textures of carceral life that conventional sociological or criminological discourses often overlook. Drawing inspiration from Jewkes and Young's (2021) examination of Kyoto Prison, I foreground the overlapping realms of sight, sound, smell, and touch, arguing that incarceration is inherently a profoundly embodied phenomenon. By weaving personal reflections, field observations, and broader scholarly insights, I reveal how overcrowded dormitories, suffocating heat, and lingering bodily odours converge to redefine detainees' spatial, temporal, and psychosocial realities in ways rarely captured by quantitative metrics. While mindful of Nelken's …

Investigating The Relationship Between Noun Classes And Plant Folk Taxonomy In Chasu Language Of Kilimanjaro Region In Tanzania, Peter Rabson Mziray
Journal of Humanities and Social Sciences
The current study investigates the relationship between noun classes and plant folk taxonomy in Chasu (G 22). The study focuses on two objectives: the first objective is to describe the plant folk taxonomy in Chasu and the second objective is to determine the relationship between noun classes and plant folk taxonomy in Chasu. Data were collected from rural villages in Same and Mwanga districts by using free listing, field interviews (jungle-walk-and-identify), and written texts containing Chasu plant names. The findings reveal that Chasu folk taxonomy reflects different ethnobotanical categories; including a unique beginner which is mmea/mimea ‘plant(s)’, and three life …

Games Played In The Off-Season: A Teaching Case Study On Major League Baseball Arbitration And Game Theory, Rebekah Ansbro
The COSMA Journal
Each January and February, professional baseball players with three to six years of Major League service time endure a process exclusive to Major League Baseball (MLB): arbitration. Though arbitration itself is not an unfamiliar form of dispute resolution, the structure MLB employs in contract arbitration is unlike any other industry, as it incorporates an all-or-nothing result that does not allow arbitrators to “split the pie” between parties. Because of this, teams and players are not only responsible for preparation of their own arguments and filed salary, but also for anticipation of their opponent’s filed salary. The hurdle of needing to …
Rule Or Reason? The Role Of Balancing In Antitrust Law, Michael A. Carrier, Mark A. Lemley
Rule Or Reason? The Role Of Balancing In Antitrust Law, Michael A. Carrier, Mark A. Lemley
Notre Dame Law Review Reflection
In this Essay, we argue that the proper test for antitrust’s rule of reason is a four-step, burden-shifting framework that ends with a balancing of the likely harms and benefits of particular conduct. One reason balancing has become rare even in circuits that permit it is that it seems hard. Antitrust is shot through with economic theory and evidence, and courts aren’t experts in economics. So they tend to look for shortcuts that allow them to resolve the case without having to apply that economic evidence to assess the likely net effect of a defendant’s conduct. But those shortcuts themselves …

What is the best way to reduce economic inequality? Economists, lawyers, political philosophers, and politicians have pondered this question for decades. Yet there is another group of savvy and highly motivated individuals who have been thinking about redistribution for just as long. Commissioners of the National Football League, the National Basketball Association, the National Hockey League, and Major League Baseball, together with team owners and player unions, have been inventing and reinventing ways to redistribute resources, and they continue to do so today. The same is true of the President of National Collegiate Athletic Association, along with the heads of …

Responsible Gambling (RG) includes prevention messages aimed at mitigating harms. Research examining the experiences of college students who sports bet is lacking, hindering efforts to tailor messaging to college students. This qualitative study explored how college men who sports bet perceive and respond to existing RG messages, gathering their feedback on the characteristics of messages they find effective. Online focus groups were conducted with college men who sports bet (N = 12) using a semi-structured interview guide. The discussions were recorded, transcribed, and analyzed using an open coding Thematic Analysis approach. Codes were independently identified and analyzed resulting in …

Enhancing The Sport Spectatorship Market For Hearing-Impaired Audiences: Accessibility And Engagement Strategies, Niveditha Karthikeyan
Enhancing The Sport Spectatorship Market For Hearing-Impaired Audiences: Accessibility And Engagement Strategies, Niveditha Karthikeyan
Journal of Applied Sport Management
This paper examines the application of the Americans with Disabilities Act (ADA) to the in-person sport spectatorship experience of hearing-impaired individuals. The delivery of the core sport product, especially at the stadium, is not equally accessible to individuals with disabilities, particularly for audience with hearing impairments. While the ADA mandates accessibility in public accommodations, its implementation for communication access within sport venues remains inconsistent. Through a focused review of legal frameworks, venue practices, and emerging technologies, the paper identifies gaps in current accessibility efforts and outlines practical recommendations to enhance inclusivity. Key strategies include the use of AI-powered real-time captioning, …
Nil Speeds Ahead While Title Ix Trails Behind: Finding Room For Title Ix In The Evolving Nil Landscape, Sophie Zelony
Nil Speeds Ahead While Title Ix Trails Behind: Finding Room For Title Ix In The Evolving Nil Landscape, Sophie Zelony
Vanderbilt Journal of Entertainment & Technology Law
Title IX was enacted to eliminate sex-based discrimination in educational programs receiving federal funding, including intercollegiate athletics. While the law has successfully increased female participation in sports, disparities in the treatment of male and female athletes persist, particularly in the context of publicity and promotional resources. The rise of name, image, and likeness (NIL) opportunities has further widened this gap, as universities and their affiliated collectives disproportionately promote male athletes, enhancing their marketability and NIL earning potential. Schroeder et al. v. University of Oregon presents a novel legal issue—whether Title IX applies to NIL deals when universities provide unequal publicity …

Class Is In Session: Anders V. Cal. State Univ., Fresno And The Debate Over Class Certification In Title Ix Athletics Cases, Fuller Kolsrud, Morgan
Santa Clara Law Review
The world of college athletics is changing rapidly and dramatically. Conferences are disintegrating and realigning. The COVID-19 pandemic exacerbated the cutting of varsity sport programs at universities around the country. Student-athletes are signing multi- year name, image, and likeness (NIL) deals with major brands such as Gatorade, State Farm, and Nike that are worth millions of dollars. Yet with all of these changes, a college or university receiving federal funds remains obligated to abide by the anti-discrimination requirements of Title IX of the Education Amendments of 1972, widely known as Title IX.
Though Title IX has been federal law for …

Does Name, Image, And Likeness Increase Gender Inequality In College Athletics?, Aimee Christenson
Political Science Theses and Capstones
In June of 2021, the National Collegiate Athletic Association adopted its first interim policy regarding Name, Image, and Likeness. From here, college athletes have been able to benefit from opportunities regarding their brand as an athlete. While this development has been historic in its expansion of rights to athletes, it highlights the inequities between male and female athletes. Title IX requires equal opportunity for male and female students. This research raises questions about whether NIL is increasing the disparity between male and female athletes. To answer this question, I looked at NIL data collected by Kyle Ems on the NIL …

Preserving Pixels: The Dmca And The Quest To Preserve Video Gaming’S Legacy, Samantha Ennis
Washington and Lee Law Review
Video games have fundamentally transformed how humans learn, play, and connect, becoming essential cultural artifacts that warrant careful preservation for present and future study. Yet, video game preservation has emerged as a critical challenge for cultural institutions as the medium rapidly evolves and early works become inaccessible due to technological obsolescence and legal barriers. Without immediate action to address the limitations of current Digital Millennium Copyright Act (“DMCA”) exemptions for video game preservation, libraries, archives, and museums risk permanently losing access to historically significant games, with studies showing 87% of pre-2010 video games are already inaccessible. Congress should amend the …

“Burned At The Stake”: Unpacking Disinformation In The Story Of A Coach Allegedly “Terminated” For Expressing Anti-Transgender Women Athlete Beliefs, Ellen J. Staurowsky
Journal of Issues in Intercollegiate Athletics
On August 29, 2023, a video testimony entitled ‘Burned at the Stake’: One NCAA Coach’s Battle to Protect Women’s Sport was released. The film was part of a “female athlete storytelling series” developed and funded by the Independent Women’s Forum (IWF) designed to support the IWF’s stated agenda to “fight to save women’s sports and counter the radical agenda that seeks to erase women” by allowing transgender girls and women on teams that match their identities. The central figure in the video is Kim Russell, then head women’s lacrosse coach at NCAA Division III Oberlin College, who claimed her right …

Eating What They Kill: The Stark Reality Of Athlete Compensation In Mixed Martial Arts And Potential Solutions, Christopher Piel
Arkansas Law Review
“They eat what they kill.” Dana White, President of the Ultimate Fighting Championship (“UFC”) said this about the state of fighter pay in the organization. White, the voice of the company, holds firm that fighters are adequately compensated for their services. The reality is that UFC fighters are not paid what they deserve, and, one way or another, there are big changes coming to the organization and the sport of Mixed Martial Arts (“MMA”) as a whole. In this Comment, I will discuss how the UFC has used its market power to suppress fighters’ wages and subject fighters to inequitable …

The Score Act Is Unconstitutional: Private Nondelegation Problems With Congress’S Latest Attempt To Regulate College Sports, Sam C. Ehrlich, Ryan M. Rodenberg
Cardozo Law Review de•novo
The Student Compensation and Opportunity through Rights and Endorsements Act (“SCORE Act”) is Congress’s most ambitious effort yet to bring stability to college sports, codifying the recent House settlement while granting sweeping regulatory power to private athletic associations such as the National Collegiate Athletic Association (“NCAA”) and the College Sports Commission (“CSC”). However, by delegating policymaking authority to these private, self-interested entities without any sort of public oversight, the bill raises serious constitutional concerns under the private nondelegation doctrine. Drawing on parallels to a string of litigation involving the Horseracing Integrity and Safety Act (“HISA”) and recent Supreme Court signals, …
