Gandhi: The Spirituality And Politics Of Suffering, Charles R. Disalvo
Gandhi: The Spirituality And Politics Of Suffering, Charles R. Disalvo
Law Faculty Scholarship
This Article examines the 1982 film Gandhi. Although it took factual liberties with Gandhi's life, Professor DiSalvo concludes that it accurately conveyed Gandhi's dedication to self-suffering and philosophy of non-violence. The Article analyzes excerpts from the film which illustrate Gandhi's five fundamental beliefs on the spirituality and politics of suffering. Those beliefs are in suffering as a weapon, as empowerment, as self-interest, as propaganda, and as reconciliation. The film Gandhi also masterfully introduced millions to Gandhi's life, message, and legacy.

A Jewish Voice In The Public Square, Gerard V. Bradley
A Jewish Voice In The Public Square, Gerard V. Bradley

David Novak: Jewish Social Ethics. (New York: Oxford University Press, 1992. Pp. xii, 252. $45.00.)
Jewish participation in American public life has been either genuinely or constructively de-Judaized. (Admittedly, many orthodox Jews - the Hasidim among them - have steered clear altogether of the public square.) "Genuinely" de-Judaized Jews are simply those like Frankfurter who have a thoroughly secular outlook. "Constructively" de-Judaized Jews include the orthodox, observant Pfeffer. For them religious conviction (and practice) are private matters, checked at the entrance to the "naked public square." Quite obviously, Jews had good reason, especially in 1947, to prefer a secular …

Arbitration And The U.S. Supreme Court: A Plea For Statutory Reform, Thomas E. Carbonneau
Faculty Scholarship
This Article argues for stabilizing and preserving arbitration's necessary and valuable vocation in dispute resolution. It outlines the basic stages in the evolution of the American law of arbitration and studies the underlying motivation of each of its historical phases. It attributes vital significance to the legislative and decisional law developments that led to an early rehabilitation of arbitration in American law, beginning with the enactment of the United States Arbitration Act (FAA) in 1925 and continuing with the ratification of the New York Arbitration Convention and the elaboration of a "hospitable" federal caselaw. Eventually, these developments gave rise to …

Religion And Right In The Philosophia Christriana Of Erasmus From Rotterdam, Erik Wolf
UC Law Journal
Although the works of the great humanist, Erasmus, have had a profound effect upon modern discussions of social questions, his attempt to formulate a Christian theory of justice has been almost completely ignored. In this Article, the author examines Erasmus's Philosophia Christiana and discusses the elements of legal theology which it contains.
