The Ministerial Exception And Defamation: Navigating Churches’ Autonomy And Their Communications, Zachary Runge
The Ministerial Exception And Defamation: Navigating Churches’ Autonomy And Their Communications, Zachary Runge
Pepperdine Law Review
In two recent cases, the Supreme Court has adopted what scholars and lower courts have called the “ministerial exception.” The Court only addressed the ministerial exception’s application to employment discrimination claims. But the Court did not foreclose the possibility of its application to other claims. This Comment argues that the ministerial exception applies to defamation claims arising out of a minister’s termination. After providing the background for the ministerial exception, this Comment explains the current state of the law. Then, this Comment argues that the ministerial exception, as a form of the church autonomy doctrine, applies to the defamation claims …

Testimony Of Professor Zalman Rothschild Before The House Subcommittee On Early Childhood, Elementary, And Secondary Education Regarding Mahmoud V. Taylor, Zalman Rothschild
Testimony
On February 10, 2026, Professor Zalman Rothschild, Horn Family Distinguished Research Scholar in Law and Religion at the Benjamin N. Cardozo School of Law, testified before the House Subcommittee on Early Childhood, Elementary, and Secondary Education of the House Committee on Education and Workforce. His testimony addressed the Supreme Court’s decision in Mahmoud v. Imposing New Tariffs During The Pandemic Could Have A Detrimental Impact On Society, And Here’S Why:, Samantha Grosinger
Imposing New Tariffs During The Pandemic Could Have A Detrimental Impact On Society, And Here’S Why:, Samantha Grosinger
Cardozo International & Comparative Law Review (CICLR) Blog
While the merits of imposing tariffs are highly disputed, Americans should agree on one thing: no new tariffs during the Pandemic. A tariff is a government levied tax on an imported good. As a general rule, the importing party pays the tariff once the good passes through customs at any American port. The leading argument for imposing tariffs is that tariffs can protect American industries by raising the price of foreign goods, which allows comparable American products to compete at an advantage. Ignoring the merits of this reasoning, it is impossible to ignore the truth, which is American consumers and …

Kenneth S. Stern’S, The Conflict Over The Conflict: The Israel/Palestine Campus Debate [2020 Toronto And Buffalo: The New Jewish Press/University Of Toronto Press. $29.95], Steven Leonard Jacobs
Journal of Hate Studies
The Conflict Over the Conflict is an important contribution to the overall literature regarding the (seeming) turmoil on many of our college and university campuses—but not all, including my own where controversial issues surface rarely if at all—vis-à-vis the Israel/Palestine conflict, free speech and controversial speakers, and the like. Stern brings to the discussion not only his lawyerly training and his skill set, but, as of late, his directorship of the academic Bard College Center for the Study of Hate and thus combining both with a singular focus. Even more importantly, perhaps, his firm commitment to the campus as the …
The Right To Education Under State Constitutions As Applied To Juvenile Delinquents, Laurenne Ferber-Kaufmna
The Right To Education Under State Constitutions As Applied To Juvenile Delinquents, Laurenne Ferber-Kaufmna
Cardozo Journal of Equal Rights & Social Justice
The note argues that while the U.S. Constitution does not guarantee a fundamental right to education, many state constitutions, including New York's, explicitly recognize this right for children. It contends that juvenile offenders in New York prisons are entitled to the same educational rights as other children under the state's education clause but are currently not receiving an adequate education that meets state standards. The note advocates for reforms to align New York's juvenile education system with its constitutional obligations and suggests adopting practices from other states, such as Florida and Virginia, to improve educational outcomes for juvenile offenders.

David and Amy Carson v. A. Pender Makin
On Writ of Certiorari to the United States Court of Appeals for the First Circuit
From the Summary of Argument
This Court should reverse the decision below and hold that the First Amendment permits no distinction between discrimination against religious groups based on their religious status and discrimination based on their religious use of generally available state benefits.

Georges Lieber Essay Contest on Resistance
I created a protest called the "Where Are the Children Project" to bring attention to the immigrant children held in detention centers. Throughout the project I was able to see how much others cared about helping these children gain better living conditions, and I was able to learn about leadership and resistance. My values helped drive me into action, and the importance of what I was working towards helped me become more confident. After months of protests, the Homestead Detention Center where reports of maltreatment had been especially high was closed, but my work to improve the rights of immigrants …
