International Jurisdiction In Cyberspace: Which States May Regulate The Internet?, Stephan Wilske, Teresa Schiller
Federal Communications Law Journal
The Internet now reaches 60 million users in 160 countries, with the number increasing each year. Although cyberspace has been viewed as a self-regulating entity controlled by no government, this myth is being destroyed as the global Internet community expands. With this expansion comes a question: Who has the authority to regulate cyberspace? Given that decisions about the Internet reach far beyond national borders, the answer to this question is unknown, but certainly has broad implications. Traditional laws of international jurisdiction, including jurisdiction to prescribe, jurisdiction to adjudicate, and jurisdiction to enforce, offer some clear answers. Global Responses: The Search For Cures In The Development Of Pharmaceuticals, Stuart R. Walker

In this article, Professor Stuart Walker examines several challenges that
will be faced by the global pharmaceutical industry in the near future. These
involve the question of improving the overall quality of life and care for
millions in an era of cost containment. In order to respond to the increasing
demands for advances in medicine while simultaneously retaining an
industrially strong, innovative, and resilient economy, responsibility for the
necessary changes will need to be shared among governments, the
pharmaceutical industry, and health care professionals.

In this article, Professor Dale Jamieson examines the relationship between
climate change and public health from an ethical perspective. He begins by
exploring the link between global environmental change and public health and
concludes that global warming poses a serious potential threat to human
health. Professor Jamieson then questions why the potential health effects of
climate change have received so much attention when the other ramifications
of climate change have been left unaddressed He argues that the combination
of several factors has brought the issue of potential health effects to the

The Globalization Of Public Health: Emerging Infectious Diseases And International Relations, David Fidler

In this article, Professor Fidler explains how the processes of
globalization have altered traditional distinctions between national and
international public health. Professor Fidler begins the article by
familiarizing the reader with globalization, reminding the reader that
globalization refers to the various factors that infringe upon a sovereign
state's ability to control what occurs in its territory. Next, the article defines
and discusses emerging infectious diseases (EIDs) and examines the
contributions made by globalization to the emergence and reemergence of
EIDs. The article then develops a "pathology of the globalization of public

The International Criminal Court: Taiwan's Last Hope?, Christa Tzu-Hsiu Lin

In 1989, the United Nations General Assembly began work on establishing the first-ever permanent International Criminal Court. Eight years later, the draft code for the International Criminal Court is nearing completion and establishment of the Court is proposed for 1998. The goal of the International Criminal Court is to enhance international cooperation in international criminal matters. This Comment discusses the International Criminal Court in light of China's missile tests off the coast of Taiwan. The lack of international response to the missile tests in the past demonstrates the need for an international body to intervene in this act of aggression. …

The European Union (EU), and its Member States, is currently struggling with the question of if and/or how to regulate the rapidly expanding content and services available over the Internet, an international communications medium. Some Member States are unilaterally acting to regulate the delivery of Internet related services, while other Member States are still debating whether they should regulate. The EU continues to study the issue, proposing that the Member States cooperate together to resolve the issue.

The process of European integration has been accompanied by a movement towards decentralization and devolution of power in many states within the European Union (EU). Subnational governments like L.nder, regions, or autonomous communities are seeking increased participation in the design and implementation of EU policies and in EU-level institutions. This Article explores the role of regions within the EU. It considers why subnational governments have assumed a growing role in European affairs, summarizes the mechanisms available in the most decentralized states for subnational input into EU policy formulation and implementation. Exporting Ethics: Lessons From Russia's Attempt To Regulate Federal Lobbying, Jason D. Kaune

After the collapse of the Soviet Union, U.S. experts have attempted to assist the Russian Federation in developing legal means to control and regulate lobbying. Faced with rampant corruption and the lack of a democratic tradition, the Russian government must address questions concerning lobbying that have troubled the United States for decades.
Mr. Kaune analyzes the 1995 attempt to export the U.S. model of regulating business-government contracts through a Russian federal law on lobbying. Although that attempt failed, the effort provides a number of lessons about both lobbying in Russia and relations between Russia and the United States.
