Systemic Racial Bias And Rico's Application To Criminal Street And Prison Gangs, Jordan Blair Woods

This Article presents an empirical study of race and the application of the federal Racketeer Influenced and Corrupt Organizations Act (RICO) to criminal street and prison gangs. A strong majority (approximately 86%) of the prosecutions in the study involved gangs that were affiliated with one or more racial minority groups. All but one of the prosecuted White-affiliated gangs fell into three categories: international organized crime groups, outlaw motorcycle gangs, and White supremacist prison gangs. Gangs, Violence, And Victims In El Salvador, Guatemala, And Honduras, Juan J. Fogelbach
San Diego International Law Journal
Country conditions in El Salvador, Guatemala and Honduras will require U.S. courts to address complex protection law issues involving current and former gang members, as well as their victims. For example, just three months after the Seventh Circuit's decision, the Sixth Circuit also held that former gang members were a particular social group. In order to ensure proper handling of these cases, advocates, adjudicators, government attorneys, and judges must acquire a high level of understanding of gangs and violence in the affected countries.
