Genocide Memorialization Through Law In Bosnia And Herzegovina: Reconciling The Irreconcilable?, Carna Pistan

This article focuses on the law banning genocide denial and other war crimes and the glorification of convicted war criminals imposed in Bosnia and Herzegovina by the former High Representative Valentin Inzko in mid-2021 to facilitate the country’s reconciliation process. It first positions the genocide denial ban into the vast category of memory laws by examining its content and scope, as well as the reactions and consequences it has provoked up to now. The article maintains that an internationally imposed memory law cannot create reconciliation in a deeply divided society. It shows, on the contrary, that the imposed legislation has …

The study investigates whether atheism in B&H is treated, a priori, as amoralism and how this affects plural civic space. If religion is privileged, is it a politically dictated value system or pure ideology? Besides in-depth critical literature review, the author refers to a number of structural interviews focusing on both groups (theists and agnostic atheists) as a direct indicator of variability. The B&H Constitution obstructs the creation of a plural civic identity, hypostasizes the collective political mentality, and stigmatizes atheism and agnosticism in everyday life. The post-conflict societies of Bosnia and Kosovo continue to be plagued by the deleterious effects of ethno-nationalism and ethnic enclaves. Unfortunately, this mix impedes both democracy and peace building within these Balkan countries. One way to promote such building is for these enclaves to collapse, thereby allowing multiethnic societies to develop. This essay proposes that enclaves be dealt with physically by ridding them of those evocative objects that help to create and maintain enclaves. This paper aims to outline the existing policies aimed at providing protection for sexual abuse survivors in the Democratic Republic of the Congo. In an attempt to provide justice for the survivors of sexual abuse, an analysis of the 1992-1995 Bosnia and Herzegovina post-conflict reconstruction is included. In particular, prosecution of sexual violence and rape as a weapon of war will be provided in order to weigh the benefits and weaknesses of international criminal law. Bosnia and Herzegovina is a country that suffers from a lack of a national identity as it has three main ethnic groups, Bosniaks, Croats and Serbs, who are all fighting for power. After the Bosnian war, which lasted from 1992-1995 and involved genocide that was committed against the Bosniaks, the ethnic divisions were further entrenched. These divisions were not helped by the provisions of the Dayton Peace Accords, which was the peace settlement that brought an end to the war. Utilizing an heuristic model that incorporates aspects from several theoretical perspectives this dissertation examines the German Green Party debate on the use of military force from 1990-2002. From the absolute rejection of any use of force to evict Saddam Hussein during the Gulf War in 1991, the Greens evolved over the course of a decade to support the deployment of German forces to Afghanistan in the wake of the 9/11 terrorist attacks. This dissertation argues that this evolution was the result of a conscious will to govern by German political leaders in particular and external shocks—Srebrenica, Kosovo, and 9/11. It …
