Studies of translation memory usage among even the most technically advanced users show that the benefits of using a translation memory - beyond reusing existing translation - are still not well understood.

What Determines Professionals’ Bankruptcy Fees: An Empirical Investigation, Gijs Van Dijk, Martin Gramatikov

Martin Gramatikov

Countries have adopted different approaches to compensate bankruptcy trustees for winding up the estate. The approaches vary from state trustees to funding mechanisms where bankruptcy trustees receive a fixed fee, to a system where their fees depend on the size of the assets. Few studies have addressed the cost-effectiveness of the different approaches. This study contributes to this topic by examining the fees of the winding up, including an analysis of the determinants of these fees. After analyzing 289 Dutch bankruptcies consisting of short-term and medium-term cases, we find substantial differences in the mean hourly remuneration fees of bankruptcy trustees ...

Canada: Managing Diversity And Social Cohesion Under Bill C-50 And Beyond, Hristina Petrova

Hristina Petrova

The recent changes in the Canadian immigration system have led to the development of other programs designed to attract highly skilled immigrants. Bill C-50 was implemented in order to reduce the immigration backlog and match supply with demand on the labour market. Whatever the scheme, there’s one particular group of immigrants whose entry into the country has been encouraged via numerous parallel initiatives – the one of international students. Their retention is strategic because they could be just what Canada needs – young people proficient in the official languages, with Canadian credentials and work experience.

The Hypocrisy Of The Acquiescence Canon, Blair C. Warner

Blair C Warner

This Article will argue that this practice is based on a number of faulty assumptions. Moreover, the canon is applied inconsistently and creates perverse incentives for the legislature. The Article will then explore the Court’s guidance to lower courts against deriving similar inferences from the denial of certiorari, a similar form of inaction. Drawing parallels between Congress and the Court, and noting the many reasons why conclusions should not be drawn from apparent inactivity, this Article will ...
