Corporate Complicity In Human Rights Violations Under International Criminal Law, Danielle Olson 2015 DePaul University

Corporate Complicity In Human Rights Violations Under International Criminal Law, Danielle Olson

International Human Rights Law Journal

This paper examines the main legal elements of corporate criminal responsibility for involvement in serious human rights violations, focusing specifically on the mens rea, or mental element requirement of a crime. It analyzes in detail what it means for a business to be complicit, the degree of knowledge corporations and their officials must have to be implicated in accomplice liability, and a case study demonstrating the consequences of such liability on corporations.

Collective Amnesia, Boca Floja 2015 QuilomboArte

Collective Amnesia, Boca Floja

South

A wide gap exists between the phenomenon of cultural appropriation and historical claim. How do you justify when you are 12 and at that age you have been programmed by an information structure and culture that has defined every identifying feature?

The migration phenomenon, the informal market, and the constant flow between the idealization of the First World in the northern corner and the underworld in the backyard, made it possible for me one day, while walking with my grandmother in a street market in Mexico, to stumble across a cassette tape with Ice Cube’s face on it that said …

Protecting Ecosystems, Culture, And Human Rights In Chile Through Indigenous And Community-Conserved Territories And Areas, William G. Crowley 2015 SIT Graduate Institute

Protecting Ecosystems, Culture, And Human Rights In Chile Through Indigenous And Community-Conserved Territories And Areas, William G. Crowley

Capstone Collection

In environmental conservation circles around the world, the contributions of indigenous peoples and local communities to the sustainable maintenance of ecosystems and natural resources are being given increased attention. Whether for cultural, spiritual, economic, or other purposes, the use of traditional and local knowledge of habitat and resource management is slowly making its way into the modern environmental movement, and is being incorporated into the dominant conservation paradigms. These managed areas, known as Indigenous and Community-Conserved Territories and Areas, or ICCAs, are defined by the International Union for Conservation of Nature as “natural and/or modified ecosystems containing significant biodiversity …

Elusive Peace, Security, And Justice In Post-Conflict Guatemala: An Exploration Of Transitional Justice And The International Commission Against Impunity In Guatemala (Cicig), Daniel W. Schloss 2015 The University of Western Ontario

Elusive Peace, Security, And Justice In Post-Conflict Guatemala: An Exploration Of Transitional Justice And The International Commission Against Impunity In Guatemala (Cicig), Daniel W. Schloss

Electronic Thesis and Dissertation Repository

Guatemala has, until today, struggled to achieve security and justice following the end of nearly half a century of civil war in 1996. One specific institution, the International Commission Against Impunity in Guatemala (CICIG), has been implemented to rectify many of the Guatemalan state’s difficulties in establishing and maintaining the rule of law. In this thesis, I look to better explain CICIG’s role in Guatemala relative to security and justice in a post-conflict setting: I define CICIG as an institution potentially capable of building societal trust, and I explain how the inclusion of procedural justice within transitional justice can help …

Ideology Versus Clientelism: Modernization And Electoral Competition In Brazil, Cássio da Silva Muniz 2015 University of Wisconsin-Milwaukee

Ideology Versus Clientelism: Modernization And Electoral Competition In Brazil, Cássio Da Silva Muniz

Theses and Dissertations

This study investigates how parties utilize the political dimensions of ideology (left-right) and clientelism (programmatic-patronage) to compete electorally in developing democracies. It proposes a combined utility theory, which suggests polarized competitive elections in modernizing national electoral markets compel programmatic parties to coalesce with clientelistic parties to gain access to regional private electoral markets. Methodologically, this study draws on a mixed-method approach focusing on Brazil as a crucial test case. It applies spatial voting models to assess the validity of ideological competition as well as geospatial voting distribution based on clustering and dispersion to devise a new quantitative measurement of clientelism …

Gustavo GutiéRrez – Liberation Theology & Marxism, Todd Cameron Swathwood Jr 2015 Liberty University

Gustavo GutiéRrez – Liberation Theology & Marxism, Todd Cameron Swathwood Jr

The Kabod

Since 1968, liberation theology has emerged as a prominent feature of religion and politics, particularly in South America. Originally stemming from the writings of Peruvian priest Gustavo Gutiérrez, this at-once theological and overtly political ideology decries the institutionalized violence of the world’s capitalist society on the poor and oppressed, and argues that God is particularly concerned with the plight of the suffering masses. Christians should therefore make assistance of these poor souls their highest priority, and advocate for any and all methods of alleviating suffering, especially those that work from the premise that society must be toppled and rebuilt for …

Does Market Integration Buffer Risk, Erode Traditional Sharing Practices And Increase Inequality? A Test Among Bolivian Forager-Farmers, Michael Gurven, Adrian V. Jaeggi, Christopher von Rueden, Paul L. Hooper, Hillard Kaplan 2015 University of California, Santa Barbara

Does Market Integration Buffer Risk, Erode Traditional Sharing Practices And Increase Inequality? A Test Among Bolivian Forager-Farmers, Michael Gurven, Adrian V. Jaeggi, Christopher Von Rueden, Paul L. Hooper, Hillard Kaplan

ESI Publications

Sharing and exchange are common practices for minimizing food insecurity in rural populations. The advent of markets and monetization in egalitarian indigenous populations presents an alternative means of managing risk, with the potential impact of eroding traditional networks. We test whether market involvement buffers several types of risk and reduces traditional sharing behavior among Tsimane Amerindians of the Bolivian Amazon. Results vary based on type of market integration and scale of analysis (household vs. village), consistent with the notion that local culture and ecology shape risk management strategies. Greater wealth and income were unassociated with the reliance on others for …

A Market Study Of Organic And Fair Trade Coffee In Bolivia, Christopher L. Estevez 2015 Florida International University

A Market Study Of Organic And Fair Trade Coffee In Bolivia, Christopher L. Estevez

FIU Electronic Theses and Dissertations

The purpose of this research is to study the commercialization of Fairtrade and Organic coffee in the Bolivia. Fairtrade and Organic coffee are alternative trade systems designed to promote the equitable and environmentally sustainable production of coffee. However, these alternative trading systems often fail to meet these goals. The producers and environment these systems are intended to protect remain marginalized. These failures are due to a number of local institutions. In order to better understand these institutions, this research conducted interviews of various stakeholders including producers, cooperative leaders, organic/Fair Trade certifiers, government agencies and private buyers. All these stakeholders influence …

Venezuela In The Times Of Chavez: A Study On Media, Charisma, And Social Polarization, Jorge Capetillo-Ponce 2015 University of Massachusetts Boston

Venezuela In The Times Of Chavez: A Study On Media, Charisma, And Social Polarization, Jorge Capetillo-Ponce

Jorge Capetillo-Ponce

My main objective in this study is to deepen the reader's understanding of Venezuela's ongoing socio-political conflict by focusing on the struggle for control over one of the key agents of mobilization and politicization in the country: the media outlets, and particularly television. My methodology strives to interweave the chronological record of events with analysis of the equally relevant theoretical, institutional, political, economic, and cultural components that helped to create those events. Central to my presentation is its analysis of the decline of Venezuela's two traditional parties and the emergence of a charismatic and populist form of leadership.

Depression As Sickness Behavior? A Test Of The Host Defense Hypothesis In A High Pathogen Population, Jonathan Stieglitz, Benjamin C. Trumble, Melissa Emery Thompson, Aaron D. Blackwell, Hillard Kaplan, Michael Gurven 2015 Institute for Advanced Study in Toulouse,

Depression As Sickness Behavior? A Test Of The Host Defense Hypothesis In A High Pathogen Population, Jonathan Stieglitz, Benjamin C. Trumble, Melissa Emery Thompson, Aaron D. Blackwell, Hillard Kaplan, Michael Gurven

ESI Publications

Sadness is an emotion universally recognized across cultures, suggesting it plays an important functional role in regulating human behavior. Numerous adaptive explanations of persistent sadness interfering with daily functioning (hereafter “depression”) have been proposed, but most do not explain frequent bidirectional associations between depression and greater immune activation. Here we test several predictions of the host defense hypothesis, which posits that depression is part of a broader coordinated evolved response to infection or tissue injury (i.e. “sickness behavior”) that promotes energy conservation and reallocation to facilitate immune activation. In a high pathogen population of lean and relatively egalitarian Bolivian foragerhorticulturalists, …

Their Story Is Our Story:The American Dream And The Construction Of Transnationalidentities In The Literary Production Of Puerto Rican And Dominican Writers In The Usa, Tamara Maravalli 2015 Union College - Schenectady, NY

Their Story Is Our Story:The American Dream And The Construction Of Transnationalidentities In The Literary Production Of Puerto Rican And Dominican Writers In The Usa, Tamara Maravalli

Honors Theses

Puerto Rican and Dominican writers in the United States express the human cost of displacement of migrants and immigrants to a new socio-cultural environment where they face discrimination, racism, labor exploitation or governmental abandonment. Many of these writers explore cultural identity of their communities and are questioning the viability of the “American Dream.” The American Dream is connected to the prevailing, mainstream social expectation of assimilation, but these communities come to the United States when the dynamics of globalization facilitates maintaining close ties with the countries of origin, facilitating the construction of transnational identities. Chapter One concentrates on Puerto Rican …

The Brics And The Global Human Rights Regime: Is An Alternative Norms Regime In Our Future?, Lucas Rivers 2015 Union College - Schenectady, NY

The Brics And The Global Human Rights Regime: Is An Alternative Norms Regime In Our Future?, Lucas Rivers

Honors Theses

Since the end of World War II, the ‘West’ has enjoyed economic and ideological dominance in the international arena due to institutions built around favorable multilateral agreements. This position has allowed the ‘West’ to craft an international system rooted within the individualistic norms of democracy and capitalism. However, the BRICS [Brazil, Russia, India, China, South Africa] – a global unit of states with increasing economic power – views this international system as unfair. Accordingly, these states have increased their cooperation to advocate for a developmental-multipolar world order. But what implications does this shared interest by the BRICS have on the …

Rebellion Under The Palm Trees: Memory, Agrarian Reform And Labor In The Aguán, Honduras, Andres Leon 2015 Graduate Center, City University of New York

Rebellion Under The Palm Trees: Memory, Agrarian Reform And Labor In The Aguán, Honduras, Andres Leon

Dissertations, Theses, and Capstone Projects

On December 9, 2009, the Unified Peasant Movement of the Aguán (Movimiento Unificado Campesino del Aguán; MUCA) occupied over 20,000 hectares of oil palm covered lands in the Aguán region in the Honduran northern coast. This was the latest, and probably most dramatic, chapter in the region's tumultuous recent history. This dissertation explores this history and the process of creation of the Aguán region from the perspective of a set of impoverished peasant families that migrated from different parts of Honduras towards the Aguán from the 1970s onwards, in search of a better present and future.

It asks about the …
