Revisiting Mary Ann Glendon: Abortion, Divorce, Dependency, And Rights Talk In Western Law, Margaret Brinig, Linda Mcclain

This essay revisits Mary Ann Glendon’s comparative law study, Abortion and Divorce in Western Law and her subsequent book, Rights Talk: The Impoverishment of Political Discourse. Glendon’s comparative study actually included a third topic: “forms of dependency which are connected with pregnancy, marriage, and child raising.” The topic of dependency has obvious relevance to consideration of intergenerational obligations and the interplay between family responsibility and societal responsibility for addressing dependency needs. A central claim Glendon made in both books is that the U.S. legal tradition is “libertarian,” views individuals as “lone rights bearers,” and exalts the “right to be …

Federal laws that regulate state institutions give rise to what the Supreme Court has described as the oldest question of constitutional law. In recent years, the Court has confronted questions of congressional power to regulate state legislatures and executives, but has not directly confronted any question of congressional power to regulate state courts. Since the Founding, questions of congressional power to regulate state court jurisdiction of Article III cases have arisen - most notably, congressional power to assign jurisdiction of federal criminal cases to state courts. Promises, Trust, And Contract Law, Anthony J. Bellia

The need for individuals to be able to trust that promises will be performed is central to justifying a law that renders certain promises enforceable. This Article argues that the legal enforcement of certain promises to meet this need does not necessarily diminish the personal relationships of trust in which such promises are made, as has been argued. Rather, this Article argues, the making and performance of legally enforceable promises can assist individuals in building relationships of trust, as it assists them in the pursuit of myriad goods.

In British Columbia, legislated responsibilities for the protection of marine values are a shared responsibility between federal and provincial governments. Traditionally, the governments of Canada and B.C. have established marine protected areas (MPAs) independently, on an ad-hoc basis, and often in response to single species or habitat specific conservation issues. This is challenging because dual designation may be required to meet MPA objectives, and ad hoc approaches may lead to gaps in biophysical representation and greater uncertainty for marine stakeholders. Reducing the high level of deaths and injuries in the construction industry is a continual challenge. It is a specific challenge in WA where the industry is adapting to the additional pressures of the development boom. In 2006, Worksafe WA responded by introducing mandatory certification in basic safety training for all employees, before they could set foot on a work site. This paper reviews the impact of this training on the commercial sector of the industry, the training organisations, and the employees.
