The tort of false imprisonment is one of the most severe forms of human rights violation, and this paper aims to define and to understand the concept of false imprisonment as a tort in India. It also seeks to know about the evolution of the notion of false imprisonment as a tort, with reference to Indian and foreign cases, and understand who and when can one be held liable for the tort of false imprisonment. It further deals with the remedies available for the said tort.

The economic downturn since 2007 and the rising tide of bankruptcies have focused attention on the consequences of abandonment in bankruptcy.1 While bankruptcy law in the United States (in contrast to the treatment in some other countries) has long assured individual debtors a “fresh start” in life following bankruptcy,2 with such debtors in liquidation bankruptcy (Chapter 7)3 as well as reorganization bankruptcy4 generally eligible for discharge of debt, the way abandonments in bankruptcy are handled under prevailing case law5 interferes substantially with the vaunted fresh start after bankruptcy.6 A 1989 letter ruling issued by ...

Recently, the question was asked, “what are the consequences of incorporating or forming an LLC after electing to defer crop insurance and disaster payments?”1 It is tempting to change entities (for the business entity involved), particularly if income shifting to a lower tax bracket taxpayer is possible. Climate resilient communities can be achieved with the support of global research, development, deployment, and diffusion of environmentally sound low GHG emission technologies and processes. Technology cooperation should lower emissions remaining mindful of biodiversity, ecosystem services and livelihoods. China and the United States need to respond effectively to both economic and climate crises and can do so in part by cooperating on environmentally sound technology that transforms the global use of energy.

The World Economic Forum recognizes that while restrictions on energy affect water systems and vice versa, energy and water policy are rarely coordinated. Under the Massachusetts Clean Water Act, a loophole exists that allows fertilizer-laden waters to escape “wet crop” farms and to flow into nearby waterways, causing detrimental effects. Blackmore Pond, located near Cape Cod, Massachusetts, has seen such effects, and its residents are eager for change. Considering that past lawsuits have failed to close the wet crop loophole, the residents of Blackmore Pond may petition the Massachusetts Department of Environmental Protection to amend the Massachusetts Clean Water Act regulations.
