The Nonexceptionalism Thesis: How Post-9/11 Criminal Justice Measures Fit In Broader Criminal Justice, Francesca Laguardia

Contrary to the assumption that ‘‘9/11 changed everything,’’ post-2001 criminal justice practices in the area of terrorism show a surprising consistency with pre-2001 criminal justice practices. This article relies on an analysis of over 300 terrorism prosecutions between 2001 and 2010, as well as twenty full trial transcripts, content-coding, and traditional legal analysis, to show the continuity of criminal justice over this time in regard to some of the most controversial supposed developments. This continuity belies the common assumption that current extreme policies and limitations on the due process are a panicked response to the terror attacks of 2001. On …

This study explores a series of events that occurred in the spring of 1876. The relationship between the Indianapolis city government, the Marion County Courts, the Indianapolis Police Department, and the African American community came together to usher in changes never before envisioned. The Indianapolis Police Department (IPD) was formed in 1855, then disbanded 12 months later in a political dispute. From 1857-to-1876, the IPD was all white. These changes took place as the Reconstruction era was coming to a close. The first Ku Klux Klan was at its apex, terrorizing black communities, and Jim Crow was coming into its …

This paper uses the concepts of ethnosphere and ethnodiversity to frame the stakes of cultural genocide in the context of the emerging global society. We are in an era of rapid global ethnodiversity loss. Global ethnodiversity is important because different cultures produce different solutions to the subjective and objective problems of human society, and because cultures have an intrinsic value. Rapid ethnodiversity loss is a byproduct of the expansion of the modern world-system, and Lemkin’s invention of the concept of genocide can be understood as a dialectical reaction to this tendency. Problem analysis conducted by a university-based research partner can provide communities with data-driven options to address the local drivers of serious youth and gang violence. Situated in Worcester, Massachusetts, this article describes how after early childhood trauma was identified as a potential driver of adolescent and young adult violence, problem analysis using local data confirmed that being the victim or witness of a traumatic incident before the age of 12 was significantly correlated with involvement in violence in adolescence or young adulthood. This project presents a case study of Northern Ireland’s District Policing Partnership (DPP)/Policing and Community Safety Partnership (PCSP) model. The case study relies on analysis of statues, government reports, public perception surveys, and governing documents, as well as relevant literature and scholarship. Through analysis of its structure, function, and efficacy of the model, key features of the model will be identified. These key features fit into the three conceptually distinct, but functionally inseparable, threads: buy-in, influence, and composition. The ways in which these three threads interact and impact the legitimacy of the model will be explored, as well as how …

In 1966, the Supreme Court delivered the landmark Miranda v. Arizona decision that created the Miranda warning, which reminds citizens of their rights to remain silent and have an attorney present during custodial interrogations. However, through Schneckloth v. Bustamonte in 1973, the Court decided not to create a mandatory warning that reminds citizens of their right to refuse a consent search. Through these cases and the others discussed, the Court has often argued over whether or not these types of warnings impair police work, whether the contexts surrounding these instances amount to coercion, and whether or not a warning is …

This study investigates the process of reentry after prison for women in Wooster, Ohio, using theories of morality and punishment by Durkheim and Foucault, general strain theory by Broidy and Agnew, and intersectionality by Hill Collins. Both quantitative and qualitative data was collected to gain a broad understanding of this particular court system and the people involved in it. Statistics on the people sentenced to prison through this court from January 2012 to October 2015 were gathered and analyzed to learn of the demographics of those sentenced to prison and how different backgrounds, especially gender, affect the charge and sentence …

In a lucid and trenchant style characteristic of Professor Hiroshi Motomura’s writing, Immigration Outside the Law offers rich descriptive and prescriptive analyses of three major themes underlying debates about unauthorized migration: the meaning of unlawful presence, state and local involvement in the regulation of unauthorized migration, and the integration of unauthorized migrants into American society. This review advances several ideas that I argue are important to understanding these key themes. In brief, I suggest that a more comprehensive understanding of public debates about unauthorized migration requires examining lay moral judgments about unlawful presence, the expressive functions of immigration law, and …
